HomeMy WebLinkAbout20253224 MEMORANDUM � „ To: Board of County Commissioners From: Maxwell Nader, Planning Manager '� Jim Flesher, Long-Range Planner COUNTY, CO Date: November 24, 2025 Re: Ordinance 2025-16, Chapter 23, Zoning, First Reading (EV Charging Stations) The Board of County Commissioners held a worksession with staff on this topic on November 18, 2025. This ordinance would define "EV Charging Stations" in Section 23-1-90 of the Chapter 23, Zoning, of the Weld County Code and list them as uses by right in Agricultural, Commercial, and Industrial zone districts.This would not affect the ability of an EV owner to charge their vehicle on their own property or on property they lease in any zone district. House Bill 2024-1173 says in CRS 30-28-213 that by December 31, 2025, the County must do one of the following: 1. Adopt the same standards and permitting process as, or one less restrictive than, the Colorado Energy Office's model code. 2. Adopt objective standards and an administrative review process in consultation with the "local fire department or fire district, electric utilities serving the county, and other relevant stakeholders, as determined by the county." 3. Adopt an ordinance or resolution that states the County does not intend to do either of the above and will continue to utilize our existing permitting process for EV chargers. We have until March 1, 2026, to notify the Colorado Energy Office of how the County has chosen to comply with HB24-1173. A separate resolution will be presented to the Board stating that the County has chosen option 3. Due to the December 31 deadline, staff will present this ordinance to the Planning Commission for its review and recommendation on December 2. Scheduling first reading of this ordinance prior to the Planning Commission hearing allows us to complete the three-reading process prior to the end of the year.
