WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with Amendment #1 to Agreement for Internet Equipment Site (822 8th Street, Greeley) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Buildings and Grounds, and Rise Broadband, Inc., commencing January 1, 2019, and ending December 31, 2020, with further terms and conditions being as stated in said amendment agreement, and WHEREAS, after review, the Board deems it advisable to approve said amendment agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment #1 to Agreement for Internet Equipment Site (822 8th Street, Greeley) between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Buildings and Grounds, and Rise Broadband, Inc., be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said amendment agreement. This lease amendment allows Rise Broadband to add some additional equipment. As a result, the monthly least rate will increase to $370.00 with a 3% consumer price index increase for each subsequent annual period. Their lease will terminate December 31, 2020. ("Rise"), a Colorado Corporation ose address is 61 Inverness Parkway, Suite 250, Englewood, Colorado 80112, and the Board of County Commissioners of Weld County, Colorado ("County"), a body corporate and politic of the State of Colorado, whose address is P.O. Box 758, 1150 O Street, Greeley, Colorado 80632. Rise and County are referred to collectively herein as the "Parties." WITNESSETH: WHEREAS, on December 30, 2015, the Rise and County entered into an Internet Equipment Site Agreement ("Agreement") for the Rise's placement of wireless broadband services equipment on a building owned by County and located at 822 8th Street, Greeley, Colorado ("Building"), and WHEREAS, Agreement did not include an exhibit or other attached document which described the equipment to be placed, and WHEREAS, Rise has provided to County a document entitled, "Landlord Exhibit," a copy of which is attached hereto as Exhibit "A" to depict and described the equipment Rise intends to place on Building, and WHEREAS, the Parties now desire to amend the Agreement to include Exhibit A and to change the monthly lease rate to $370.00, and to leave the remaining provisions set forth in the Agreement the same. NOW, THEREFORE, in consideration of the mutual promises and covenants herein contained and contained in the Agreement, the Parties agree to amend the Agreement with the following: Add Exhibit A to the Agreement to depict and describe the "Rise Equipment" to be placed on the Building. Amend paragraph (5) d. to say the following: 5) RISE OBLIGATIONS. Rise will: d. Pay monthly site rent of three -hundred seventy dollars and no cents ($370.00), beginning January 1, 2019. Rent shall be increased on each anniversary of the Commencement Date by an amount equal to 3% of Rent in effect during the previous year.
