ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL)
ZONE DISTRICT - CHRISTOPHER AND DEBRA CARPENTER
A public hearing was conducted on August 21, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
F I hereby certify that pursuant to a notice dated June 12, 2019, and duly published
June 14, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of
Christopher and Debra Carpenter, for a Site Specific Development Plan and Use by Special
Review Permit, USR19-0031, for accessory buildings with gross floor area larger than four
percent (4%) of the total lot area, as detailed in Section 23-3-30, per building on lots in an
approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District. Karin McDougal,
Assistant County Attorney, made this a matter of record.
F Chair Kirkmeyer reviewed for the applicant and the public, the procedures to follow should
this case result in a tie vote, due to four (4) Commissioners being present and Commissioner
Moreno excused.
F Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal
and stated the site had a current zoning violation for the existing structures, which exceed the
4 percent (4%) total lot area, and noted all structures are for personal use.

July 2, 2019, hearing.)

▪ Zackery Roberson, Department of Public Works, provided a brief overview of the
transportation plans and requirements, and stated the applicants are proposing to use an existing
access on Caroline Avenue. He indicated there are no traffic counts in the area and the site meets
a drainage exception.
la Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions, and stated water is provided by Aristocrat Ranchettes Water Project, the septic system
is permitted for two (2) bedrooms, and the Department of Public Health and Environment had no
outstanding issues with the request.
e Debra and Christopher Carpenter, applicants, stated they purchased the home in 2018, and
did not realize there was a regulation for gross floor area larger than 4% of the total lot area, and
described the upgrades they had made to the property.
El No public testimony was offered concerning this matter.
e After discussion about the resolution, the Board made no changes.
El In response to Chair Kirkmeyer, Ms. Carpenter indicated they had reviewed, and agreed to
abide by, the Conditions of Approval and Development Standards, as entered into the record.
e Commissioner James moved to approve the request of Christopher and Debra Carpenter
for a Site Specific Development Plan and Use by Special Review Permit, USR19-0031, for
accessory buildings with gross floor area larger than four percent (4%) of the total lot area, as
detailed in Section 23-3-30, per building on lots in an approved or recorded subdivision plat or
part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the
A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning
Commission, with the Conditions of Approval and Development Standards as entered into the
record. The motion was seconded by Commissioner Freeman, and it carried unanimously. There
being no further discussion, the hearing was completed at 11:02 a.m.
