Kersey, CO 80644 ' RE: Use of Weld County Road 63 / Right-of-Way Z Mile North of Weld - County Road 46 Dear Mrs. Moore: Please be advised that the Board of County Commissioners has been advised by one of our attorneys that you have been in contact with him regarding plowing operations that the Duells have been conducting which • • apparently infringes on your private use of the Weld County road right of-way. He also advised us of your concerns regarding the wetting of that road by the Duells' sprinkler operations. You will recall that the agreement reached last year was that that section of the road would not be vacated but that your use of the right- of-way as a private access road would require that you maintain the road. This. Board would have the option of vacating the road completely south of your property and exercising•.its right to reopen the road north of ' your property but, in attempting to accommodate you, has chosen, so far, not to do so. The Board is reluctant to become involved in your continued problems • with your neighbor, Mr. Duell) and suggests you solve these matters between yourselves. MOORE TO USE CERTAIN WELD COUNTY RIGHT-OF-WAY FOR INGRESS AND EGRESS TO THE NORTHEAST QUARTER OF SECTION. 7 , TOWNSHIP 4 NORTH, RANGE 63 WEST OF THE 6TH P.M. , IN WELD COUNTY, COLORADO WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, William A. and Sylvia A. Moore have requested permission to use certain road right-of-ways for ingress and egress to the Northeast Quarter of Section 7, Township 4 North, Range 63 West of the 6th P.M. , Weld County, Colorado, and WHEREAS, after considering said request, the Board of County Commissioners finds that said applicants should be given permis- sion to use Weld County road right-of-way on County Road #46 between Roads 61 and 63 and further, use Weld County right-of-way on Road 63 for one-half mile north of County Road #46 in order to gain ingress and egress to the Northeast Quarter of Section 7 , Township 4 North, Range 63 West of the 6th P.M. , Weld County, Colorado, and • WHEREAS, permission is specifically granted on the condition that neither Weld County nor the Board of County Commissioners of Weld County, Colorado, shall be in any way responsible for the maintenance of the rights-of-way granted, to the applicants under this Resolution. Box 758 Greeley, Colorado 80632 Dear Ladies and Gentlemen: We are at this time requesting that the County Commissioners grant us permission to use Weld County's Rights of Way beginning at the Southwest corner of section 7, township 4 north, range 63 west for one mile east to the Southeast corner of the same section and for one-half mile north along the east side of section 7; also beginning at the northwest corner of the same section 7 for one-half-mile east. The purpose for use of the rights of way will be for ingress and egress to our homesite on the northeast quarter of the same section 7. We are requesting two rights of way uses to insure we can get in and out during all weather conditions. We are fully aware that Weld County nor the County Commissioners will in no way be responsible for the maintenance of said rights of way. It appears that this petition is not legal in as much as it done not b•'ar the names of ten free- holders residing within two miles of the proposed road. Neither have the owners of the land adjoin- ing the road in sections five and seven signed the petition. Where all the owners of land adjoining a proposed road do not sign the petition, it becomes necessary for the Board of County Commissioners to appojrt viewers to investigate and make recommenda- tions as to the advisability of establishing such a road. In such cases it is necessary that a d'posit of $16.00 be made to cover the expense of viewing. This letter for your information.
