RE: APPROVE QUIT CLAIM DEED TO TRANSFER ONE (1) FOOT STRIPS IN WESTRIDGE
SUBDIVISION, FOURTH FILING AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY
DOCUMENTS - CITY OF GREELEY
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Quit Claim Deed to Transfer One (1)
Foot Strips in the Westridge Subdivision, Fourth Filing, from the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, to the City of Greeley, commencing upon full execution of
signatures, with further terms and conditions being as stated in said quit claim deed, and
WHEREAS, after review, the Board deems it advisable to approve said quit claim deed, a
copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Quit Claim Deed to Transfer One (1) Foot Strips in the Westridge
Subdivision, Fourth Filing, from the County of Weld, State of Colorado, by and through the Board
of County Commissioners of Weld County, on behalf of the Department of Public Works, and the
City Greeley, be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair Pro -Tern, be, and hereby is,
authorized to sign said quit claim deed and all necessary documents.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 29th day of April, A.D., 2019.

SUBJECT: Quit Claim Strips in Westridge Subdivision
RE: QUIT CLAIM STRIPS WITHIN THE WESTRIDGE FOURTH FILING
The Westridge Fourth Filing Subdivision plat was recorded on March 3, 1972 at 1584885. The subdivision
plat includes a note that reads as follows:
Note: All One Foot Reserved Strips as Shown Along Streets are Dedicated in Fee Simple to Weld County,
Colorado
The City of Greeley has been in discussion with landowners and is in the process of making roadway
improvement. To ease in the planning and construction of the roadway improvements the City of Greeley has
requested the Board of County Commissioners Quit Claim the one -foot strips reserved on the West Ridge
Fourth Filing Subdivision Plat to the City of Greeley.

On Monday's BOCC agenda is a quit claim deed to convey to the City of Greeley a one foot strip in that exists along 59th
Avenue in the Westridge Fourth Filing Subdivision. The one foot strip was reserved unto Weld County when the original
subdivision was platted in 1972. Not sure why it was reserved back then, but I have seen similar reservations on a
number of plats from that era and must have been a common practice. At any rate, no need to keep the one foot strip
now and it should be transferred to the City of Greeley who has jurisdiction over this stretch of 59th Avenue.

This is a Quit Claim Deed between Weld County and the City of Greeley for a 1' strip that the City of Greeley has
requested us to convey. We had anticipated it going to the BOCC back in March but I think it fell of the radar. If there is
anyway to get this on the agenda that would be great. I don't know if this is something that needs to go as a full agenda
item or if it can go on consent.
Bruce can you assist in what all needs to occur for this? I know Greeley is very anxious to get it. This is the same deed
and exhibit you reviewed early March. Thanks, Tiffane

QUIT CLAIM DEED
THIS DEED is made this 29th day of April, 2019, from the County of Weld, a political
subdivision of the State of Colorado, by and through the Board of County Commissioners of the
County of Weld, whose address is 1150 0 Street, P.O. Box 758, Greeley, Colorado 80632, of the
first part, and to the CITY OF GREELEY, a municipal corporation of the State of Colorado, of
the second part.
WITNESSETH, that the said party of the first part, for and in consideration of the sum
of One Dollar and no/00's ($1.00), and other good and valuable consideration, to the said party
of the first part in hand paid by the said party of the second part, the receipt whereof is hereby
confessed and acknowledged, has remised, released, sold, conveyed and QUIT CLAIMED, and
by these presents does remise, release, sell, convey and QUIT CLAIM unto the said party of the
second part, its heirs, successors and assigns, forever, all the right, title, interest, claim and
demand which the said party of the first part has in and to the following described lots or parcels
of land situate, lying and being in the City of Greeley, County of Weld, State of Colorado, to wit:
All of the real property shown as "One Foot Reserved Strips Shown Along Streets
Are Dedicated in Fee Simple to Weld County, Colorado," as described on the West Ridge
Fourth Filing Subdivision Plat, recorded in the Office of the Weld County Clerk and
Recorder on March 3, 1972, at Reception Number 1584885, a copy being attached hereto
as Exhibit "A."
TO HAVE AND TO HOLD the same, together with all and singular the appurtenances
and privileges thereunto belonging or in anywise thereunto appertaining, and all the estate, right,
title, interest and claim whatsoever, of the said party of the first part, either in law or equity, to
the only proper use, benefit and behoof of the said party of the second part, its heirs and assigns
forever.
IN WITNESS WHEREOF, the said party of the first part has hereunto set its hand and
seal the day and year first above written.
IN WITNESS WHEREOF, I, Mike Freeman, Chair Pro-Tem of the Board of County.
Commissioners of said County of Weld, State of Colorado, on behalf of said County and by
virtue of the Order contained in the Resolution made by said Board of County Commissioners on
the 29th day of April, 2019, have hereunto set my hand and affixed the seal of said County this
29th day of April, 2019, for the uses and purposes therein set forth.
