We would like to address these comments individually with this letter. Please refer to our original application narrative dated June 11, 2018. Below are your comments and our responses in italics: Building Inspection: No comment. Thank you Environmental Health Department: 1. Will the house be utilized for restrooms for employees or will a portable toilet be provided or will a new commercial septic be installed? We are in process for a commercial septic for the outbuilding. 2. What kind of maintenance will be done on the business vehicles and how will fluids and parts be disposed of? All maintenance of business vehicles will be done inside or on the concrete slabs. Fluids are collected and disposed of properly. Maintenance may include, fluid changes, mechanical repair, cutting, welding, modifications, etc. 3. Is a department of agriculture permit needed for mixing of fertilizer? The fertilizer is for agricultural purposes only. No mixing is being done. The previous narrative misstated this. 4. Please provide a waste handling plan that includes how residual liquids from stored equipment will be addressed. All wastes are handled appropriately. Wastes are recycled if possible. Non- hazardous wastes are disposed of via normal methods as described by provider or diluted and disposed of normally. Hazardous wastes are contained and disposed of per provider requirements. No clients are anticipated to come to this site. The fertilizer is strictly for delivery. Public Works: 1. The proposed number of vehicles accessing the site requires a traffic impact study. a checklist of the items required in a traffic impact study is available from Public Works upon request. We are awaiting information from Hayley Balzano, Weld County Engineering Dept., on this comment. Please be aware that if a traffic study is required, it is our understanding that this could take at least 6 weeks to complete. Planning Services: There appears to be a wide range of uses proposed for the property. To allow County staff to understand the specific uses, please provide greater definition. If the requested use per your application narrative is in red text, there is a defined description associated with this term. Please identify the specific use(s). Section 23-3-40.Y Research Laboratory Our term 'Research Laboratory" is more of a generic term as Mr. Simpson would like to be able to experiment with building and/or modifying different types of equipment and products for uses in the agricultural and oil/gas fields. These may include metal materials, plastic materials., polymers, etc. This research is done primarily indoors. Large equipment may be done outdoors in designated areas. No hazardous material research will be done. We believe transportation is established with the types of uses, as described above in Sec. 23-3-40 and 23-3-320. We wish to continue to maintain an agricultural land use designation to promote the County's agricultural industry and sustain viable agricultural opportunities for the future. We wish to diversify this location for other operations as to not interfere with agriculturally productive lands. We wish to provide other services and opportunities to support the agricultural industry. We wish to establish commercial and industrial uses, which are directly related to or dependent upon agriculture. This will limit the impact to surrounding properties by locating several different operations to one location. We believe this will encourage development of agriculture and agriculturally related businesses and industries. This can include farming, farming equipment sales, support, maintenance and repairs as well as support for a variety of rural businesses. 5. Applications for a change of land use in the agricultural areas will be reviewed in accordance with all potential impacts to surrounding properties. We have sent letters to all of the surrounding property owners as suggested by Weld County. A copy of these letters were provided with the original submittal of this USR on June 11, 2018. The only response we have received is a phone call from the property owner to the northeast. He is fine with the uses proposed. He stated this is a secondary home for him and his wife so they are not there much of the time. 6. Please discuss how the visual mitigation will be addressed with the adjacent neighbors and public rights -of -way for all areas having parking and outside storage. A 6 -foot solid fence is proposed along the ROW and part of the north property line. 7. Please describe the uses occurring on the property outside of the defined areas associated with the request. For example, will the areas not impacted by the request continue to be pasture land for grazing or is there another program element? Correct, the areas outside the defined areas will remain as pasture land or residential uses near the house. We wish to conserve agricultural land by ganging several different operations and services in one location. 3. Historically this site has not been irrigated nor farmed. This site is currently used as a single family residence and farming operation headquarters. With this USR we wish to diversify this location for other operations as to not interfere with agriculturally productive lands. 4. We wish to improve this property for the changing dynamics of agricultural environment by supplementing other services and opportunities to support the agricultural industry. 5. We wish to support and entice agriculturally related businesses and processing facilities on this site and the surrounding community. B. We will continue the commitment to viable agriculture in Weld County through mitigated protection of established agricultural uses. 1. This property is 80 acres in size but only a small portion is being utilized for this USR. We recognize that our operations can function on a small acreage to minimize our footprint and sustain agricultural land. F. This USR is for the expansion of the family business currently located on this property. The property owner lives on the property and is owner of businesses located on this property. O. We believe this USR supports commercial and industrial uses in this agricultural community as they are directly related to and dependent upon agriculture. This USR does not impact surrounding properties and has adequate services to operate. H. Adequate services and facilities are currently available to support this USR. 1. Septic field and potable water are available for this site to amply supply its needs. 2. A water well is not utilized on this property. Domestic water is provided by North Weld County Water District. 3. This property has access to the local roadway of WCR 45 which has a 60 foot R.O.W. and is built to sustain agricultural uses. This USR does not propose a need to enhance this roadway, classification or structural capacity, as its uses are similar to agricultural uses with passenger vehicles and semi -trucks and trailers. 4. No improvements to this property is being proposed with this USR. No change in storm drainage is to be done as the proposed uses are similar to the current uses of the property. 5. Public service providers are informed of this USR via the Weld County USR permit application. No new burden is to be placed on schools, emergency services and fire protection. I. We believe this USR reduces potential conflicts between varying land uses. 1. This USR is intended to continue the positive relationship between this land owner and Weld County. 2. This USR is consistent and compatible with the surrounding land uses as it is primarily an agricultural property with agricultural uses. There is one single family home on the property and one outbuilding. The outbuilding is primarily for agricultural uses. This USR is to expand the use of this outbuilding, and the area surrounding the outbuilding, for uses as described above. These uses are similar and supplement agricultural productivity. The adjacent property owners should not notice any difference in this properties use. The property to the north is owned by Grandparents to this applicant. This property is about 55 acres in size. There is a single family house on this property and the rest is in grass, not farmed. The property to the northeast is a single family residence. The property is approximately 20 acres in size. There is a single family house on this property. The rest of the property is grass, not farmed. The property to the east is vacant in native grass, not farmed. The property to the south is vacant in native grass, not farmed. The property to the southwest is a single family residence. The property is approximately 2 acres in size. There is a single family house on this property. The property to the west is farmed and approximately 160 acres in size. As is the property to the south of this west property. 5. What are the hours and days of operation? The hours of operation for the agricultural use may be 24 hours a day, 7 days a week. Other operations are from 7:3 Dam to 5pm Monday thru Saturday. 6. List the number of full time and/or part time employees proposed to work at this site. Full-time employees = 6 Part/time employees = 14, based on seasonal requirements 7. If shift work is proposed include the number of employees per shift. No shift work is proposed at this time 8. List the number of people who will use this site. If this is a dairy, livestock confinement operation, kennel, etc., list the number and type of animals. Agricultural animals for private use, are on this property. No dairies, livestock confinement nor kennels are Proposed. 10. Describe the type of lot surface and the square footage of each type. (e.g. asphalt, gravel, landscaping, dirt, grass, buildings) There is currently a single family residence on this property of about 7,773 sci t. This residence may have as much as 7,000 sqft of irrigated turf. There is a building on this site that will be used as storage, construction and maintenance for equipment, of about 10,800 sqft. The area around the outbuilding will be gravel/recycled asphalt of about 45,000 sqft. 11. How many parking spaces are proposed? How many handicapped (ADA) parking spaces are proposed? 14 parking spaces are provided for seasonal work. No handicapped parking spaces are proposed. 12. Explain the existing and proposed landscaping for the site. No landscaping is proposed for the outbuilding. A solid fence is to be constructed along the property line to inhibit visibility to the yard and storage areas. The residential house is to have norma residential landscaping. 13. Describe the type of fence proposed for the site (e.g. 6 foot chain link with earth tone slats) The fence will be a 6 foot high solid metal fence. 14. Describe the proposed screening for all parking and outdoor storage areas. If the site is located in a floodplain outdoor storage is restricted. A fence will be installed to screen parking and outdoor storage. The site is not located in a floodplain. 15. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Minimal reclamation will be necessary if this USR is terminated as the site has been used primarily for agricultural uses and wishes to continue as primarily agricultural uses. 16. Who will provide fire protection to the site? Fire protection is provided by the Ault Fire Department? The only improvements to the site is a screening fence. Engineering questions: 1. Describe how many roundtripsiday are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV (Roundtrip = 1 trip in and 1 trip out of site) vehicle roundtrips/day A. Passenger cars I pickups = 48 B. Tandem trucks = 2 C. Semi -trucks = 16 2. Describe the expected travel routes for site traffic. Agricultural traffic will travel primarily south on WCR 45. Non-agricultural traffic will travel north on WCR 45 to WCR 90 and go east and west. Describe the travel distribution along the routes (e.g. 50% of traffic will come from the north, 20% from the south, 30% from the east, etc.) 75% of travel will come from the north and 25% of travel will come from the south. 4. Describe the time of day that you expect the highest traffic volumes from above. Highest expected travel times from the north will be between 7-7:30am and between 4:30-5pm. Travel times to the south will be spread out during the day. 5. Describe where the access to the site is planned. Access to this site is planned to be at the existing access to this property at WCR 45. No change is proposed. Drainage Design: Detention pond summarized in a drainage report is required unless the project falls under an exception to stormwater detention requirements per code section 23- 12-30 F.1. Per the Weld County Code Section 23-12-30 F.1, This site is exempt to stormwater detention requirements per the following codes: 1) Use by Right or Accessory Use in the A (Agricultural) Zone District. 8) Development of sites where the change of use does not increase the imperviousness of the site. This TIS is for the proposed Simpson USR project located at 43646 WCR 45, Ault, CO in Weld County, CO. See Figure 1: Vicinity Map. Kellar Engineering LLC (KE) has prepared the TN to document the results of the project's anticipated traffic conditions in accordance with Weld County's requirements and to identify projected impacts to the local and regional traffic system. 2.0 Existing Conditions and Roadway Network The project site is located south of the intersection of Weld County Road 90 (WCR 90) and Weld County Road 45 (WCR 45) in Weld County, CO. Access to the project site is proposed from a full -movement access to WCR 45. WCR 90 is an existing east -west roadway with a posted speed of 55 mph. WCR 90 is classified as a collector roadway on the Weld County Functional Classification Map. WCR 45 is an existing unpaved, low volume north -south roadway that is classified as a local street on the Weld County Functional Classification Map. 2.1 Existing Traffic Volumes Existing peak hour traffic volume counts were conducted using data collection cameras at the intersection of WCR 90 and WCR 45 on Tuesday, October 16, 2018. The traffic counts were conducted during the peak hours of adjacent street traffic in 15 -minute intervals from 7:00 AM to 9:00 AM and 4:00 PM to 6:00 PM. These turning movement counts are shown in Figure 3 with the count sheets provided in Appendix A. Additionally, the proposed land use associated with the project is not anticipated to generate additional pedestrian or bicycle trips. Any additional pedestrian or bicycle traffic from this development, if any, would be negligible. 4.0 Proposed Project The proposed project consists of the Simpson USR application. See Section 4.1 and Table 1: Trip Generation. Vehicular access to the project site is proposed from a full -movement access to WCR 45. See Figure 2. 4.1 Trip Generation Site generated traffic estimates are determined through a process known as trip generation. Rates and equations are applied to the proposed land use to estimate traffic generated by the development during a specific time interval. The acknowledged source for trip generation rates is the Trip Generation Report published by the Institute of Transportation Engineers (ITE). The Institute of Transportation Engineers' (ITE) Trip Generation Manual, 9th Edition does not provide detailed data related to the proposed use. Therefore, the trip generation is based upon the below information provided by the client. Vehicle roundtripslday: A. Passenger cars / pickups = 48 B. Tandem trucks = 2 C. Semi -trucks 16 There will be 6 full-time employees which generates approximately 6 rou ndtripslday or 12 tripslday. These full-time employees are primarily for the agricultural business. These employees will be used at times for the commercial uses. We estimate that 85% of the time these full-time employees will be utilized for the agricultural business. Part-time employees will be used seasonally for agricultural farming and harvesting. These employees are exclusively for the agricultural operations. S n a busy day, there may be as many as 4 other vehicles accessing this property for agricultural or commercial reasons. This generates approximately 4 roundtrips/day or 8 trips/day. Altogether, full-time employees + part-time employees + others = approximately 24 roundtri pslday or 48 tri pslday. The tandem truck leaves in the morning and returns in the evening generating 1 roundtrips/day or 2 trips/day. This tandem truck is primarily used for agricultural purposes estimated at 85% of the time. For commercial use this truck may not return to this site each day. The semi -trucks are primarily used for agricultural farming and harvesting purposes. Seasonally these trucks could generate 8 roundtripslday or 16 trips/day, The rest of the time these trucks may be rented to other companies for their transportation needs and not access this site. Otherwise they will be parked in designated areas. These trucks will be utilized for agricultural uses more than 85% of the time, this study will use these numbers as a conservative estimate. The agricultural farming and harvesting seasonal operations are primarily between May and October. This would be the largest amount of agricultural traffic use. The rest of the year traffic will be split between agricultural and commercial use. Below is information showing the 85% use for agriculture and remaining commercial use. The directional distribution of traffic is a means to quantify the percentage of site generated traffic that approaches the site from a given direction and departs the site back to the original source. Figure 4 illustrates the trip distribution used for the project's analysis. 4.3 Traffic Assignment Traffic assignment was obtained by applying the trip distribution to the estimated trip generation of the development. Figures 5 shows the site generated traffic assignment. 4.4 Short Range Total Peak Hour Traffic Site generated peak hour traffic volumes were added to the background traffic volumes to represent the estimated traffic conditions for the short range 2020 horizon. These background (2020) and short range (2020) total traffic volumes are shown in Figures 6 and 7 respectively. The short range analysis year 2020 includes the proposed development for this project plus a 3% per year increase in background traffic. 5.0 Traffic Operation Analysis KE's analysis of traffic operations in the site vicinity was conducted to determine the capacity at the identified intersections. The acknowledged source for determining overall capacity is the 2010 Edition of the Highway Capacity Manual (HCM). Simpson USR Traffic Impact Study Page 14 5.1 Analysis Methodology Capacity analysis results are listed in terms of level of service (LOS). LOS is a qualitative term describing operating conditions a driver will experience while traveling on a particular street or highway during a specific time interval. LOS ranges from an A (very little delay) to an F (long delays). A description of the level of service (LOS) for signalized and unsignalized intersections from the 2010 Highway Capacity Manual (HCM) are provided in Appendix B. 5.2 Intersection Operational Analysis Operational analysis was performed for the short range 2020 horizon. The calculations for this analysis are prodded in Appendix E. Using the short range total traffic volumes shown in Figure 7, the project's intersections are projected to operate acceptably. See Table 4 for the 2020 Short Range Total Peak Hour Operation. 5.3 Intersection Improvements The auxiliary lane analysis for the study intersections were conducted using CDOT State Highway Access Code (SHAG). Based upon the SHAC, a left -turn deceleration lane is required at an intersection with a posted speed above 40 mph and a projected peak hour ingress turning volume greater than 10 vph. Additionally, a right -turn deceleration lane is required at an intersection with a posted speed above 40 mph and a projected peak hour ingress turning volume greater than 25 vph; and a right -turn acceleration lane is required at an intersection with a projected peak egress turning volume greater than 50 vph. Additionally, based upon Section 3.5 of the SHAG, auxiliary lanes requirements are not required for the left -turn deceleration lane when the predicted opposing traffic is below 100 DHV. Based upon the projected traffic of the development and the State Highway Access Code (SHAG), auxiliary lanes are not required for the project. All intersections are projected to operate acceptably upon development of the Simpson U S R project. See Appendix E for Synchro 9 outputs. The findings of the TIS are summarized below: • The proposed project is anticipated to conservatively generate approximately 70 daily weekday trips, 35 AM total peak hour trips, and 35 PM total peak hour trips. See Section 4.1. • The key intersections are projected to operate acceptably (LOS A) with the development of the project and background traffic in the 2020 Short Range Total future. The existing street improvements are sufficient to accommodate the proposed project's traffic. • Auxiliary turn lanes are not required for the project based upon the requirements in the CDOT State Highway Access Code (SHAG). The TIS did not provide data for future potential uses. Response. Thank you for your comments. The TIS actually did provide the trip generation data for the future potential uses on the property. The Traffic Impact Study (TIS) followed the procedures recommended by the Institute of Transportation Engineers (ITE) for traffic impact studies. First, weekday peak hour traffic counts were conducted using Miovision data collection cameras (Recent Traffic). These traffic counts also included any existing traffic counts coming from the property (Recent Traffic). Next, background traffic was conservatively grown per the NFRMPO growth rates (Background Traffic). Next the trip generation for the future potential uses for the property were added (Site Generated Traffic). Finally, all of these peak hour traffic numbers were combined to give the most conservative future traffic generation estimate (Short Range Total Traffic). 2. Comment. The trips traveled currently warrant a left-hand deceleration lane at the access to the site and a left-hand deceleration lane on County Road 45 at County Road 90. Response. Per the CDOT State Highway Access Code (SHAC), the existing and proposed future traffic at the property do not warrant auxiliary lanes (turn lanes). See Figure 3, Figure 5, and Figure 7 in the TIS. As discussed over the phone, County Road 45 is an unpaved roadway. The traffic volumes do not warrant paving CR 45. In order to construct auxiliary lanes in CR 45, it would need to be paved. Additionally, the existing and future proposed traffic do not warrant auxiliary lanes (turn lanes) at the site access or at the CR 90/CR 45 intersection per CDOT SHAC. Per Section 3.5 of the SHAC, auxiliary lane requirements are not required for the left -turn deceleration lane when the predicted opposing traffic is below 100 vph (DHV). As shown in Figure 3, the opposing traffic volumes on CR 45 are less than 10 vph in the peak hour. This is far below the threshold to require turn lanes. See Section 5.3 in the TIS. 1 oft KELLAR ENGINEERING 3. Comment. The author of the TIS states because the speed of County Road 45 is 25 mph, the auxiliary lanes are not warranted. Public Works does not have any records indicating that the speed limit on County Road 45 is 25 mph, so we are requiring the auxiliary lanes. Response. Yes. Thank you. The 25 mph text has been removed from the TIS. This information was incorrect based upon information provided by the traffic counting sub- contractor who assumed the 25 mph posted speed based upon CR 45 being a gravel roadways As discussed over the phone, using a 55 mph posted speed, auxiliary lanes are not required on CR 45 per the SHAC due to the traffic volumes being lower than the threshold. See section 5.3 in the TM. Additionally, all studied intersections operate at Level of Service A (LOS A) for the Short Range Total analysis which is excellent level of service per the Highway Capacity Manual (HCM).
