A public hearing was conducted on June 12, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated April 26, 2019, and duly published
May 1, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of
Rocky Mountain Midstream, LLC, for a Site Specific Development Plan and Use by Special
Review Permit, USR19-0008, for a greater than 12 -inch High Pressure Natural Gas Pipeline
(24 -inch natural gas pipeline) approximately 13.65 miles in length in the A (Agricultural) Zone
District. Bob Choate, Assistant County Attorney, made this a matter of record.
Chair Kirkmeyer instructed the applicant and reviewed for the public, with two (2) of the
five (5) commissioners being excused, the vote must be unanimous for the case to be approved.
Angela Snyder, Department of Planning Services, presented a brief summary of the proposal
and stated the East Greeley Pipeline will connect the proposed Lathem and Auburn compressor
stations. She indicated a permanent, 50 -foot easement has been acquired for this pipeline and
future pipeline projects through the same corridor, 100 percent of the property owner easements
have been acquired, and a specific site assessment of the biological, aquatic, and cultural
resources, adjacent to the proposed pipeline route was done. She stated 14 referrals were sent
out and seven (7) responded, and mentioned the Department of Planning Services did recieve
phone calls and correspondence from the Lower Lathem Reservoir and Irrigation Company,
regarding the application. She noted some construction was done without permits, specifically
boring under irrigation ditches, and agreements with the Farmers Reservoir and Irrigation
Company (FRICO) and the Lower Lathem Reservoir and Irrigation Company were in place prior

to the Planning Commission hearing. She displayed images of pipeline route and entered the
favorable recommendation of the Planning Commission into the record as written.
• Hayley Balzano, Department of Public Works, explained all access for the USR must be
permitted, and provided all of the County Roads (CR) the pipeline crosses. She indicated the
Department of Public Works (PW) is requiring tracking control, a Road Maintenance Agreement
during construction, and stated pipelines are excepted from the requirement of a drainage report.
• Lauren Light, Department of Public Health and Environment, stated portable toilets may be
used along the construction route, an Air Emissions Permit is required when they disturb more
than 25 acres, and Development Standards (DS) #12-18 address Environmental Health (EH)
items.
• Lito White, applicant, displayed a PowerPoint presentation that provided specific information
about the pipeline, including width, length, and geographic location. He stated all Right -of -Way
(ROW) agreements are in place, and described the design and construction of the pipeline, as
well as depth of coverage. In response to Commissioner Conway, Mr. White stated they bored
prior to permits being issued at the request of a landowner who wanted them off of his field by a
certain date and confirmed they will be more diligent in the future.
• No public testimony was offered concerning this matter.
• The Board added screening language to DS #17 (portable toilets).
In response to Chair Kirkmeyer, Mr. White indicated he had reviewed, and agreed to abide
by, the Conditions of Approval and Development Standards, as amended.
No public testimony was offered with regard to changes made to the Conditions of Approval
and Development Standards.
• Commissioner Freeman moved to approve the request of Rocky Mountain Midstream, LLC,
for a Site Specific Development Plan and Use by Special Review Permit, USR19-0008, for a
greater than 12 -inch High Pressure Natural Gas Pipeline (24 -inch natural gas pipeline)
approximately 13.65 miles in length in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by Commissioner Conway,
and it carried unanimously. There being no further discussion, the hearing was completed at
10:40 a.m.
