A public hearing was conducted on March 25, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
E I hereby certify that pursuant to a notice dated November 13, 2018, and duly published
November 19, 2018, in the Greeley Tribune, a public hearing was conducted on December 19,
2018, to consider the request of Bonanza Creek Energy Operating Company, LLC, c/o DCP
Operating Company, LP, for a Site Specific Development Plan and Use by Special Review Permit,
USR18-0099, for a Mineral Resource Development Facility, Oil and Gas Support and Service,
Natural Gas Compressor Facility, one (1) up to 100 feet in height secure communications tower,
a temporary laydown and storage yard, up to eight (8) construction office trailers and sixteen (16)
conex containers for use during the construction of the facility in the A (Agricultural) Zone District,
at which time the Board deemed it advisable to continue the matter to January 23, 2019, to allow
for a full quorum to be present, at which time the Board deemed it advisable to continue the matter
to March 25, 2019, to allow the applicant time to consider an alternative location and work on the
remaining concerns of surrounding property owners. Bob Choate, Assistant County Attorney,
made this a matter of record.
El Patrick Groom, Attorney, represented the applicant, and stated the applicant had sent a letter
to the Department of Planning Staff to withdraw the application. He explained the continuance
allowed DCP time to evaluate the site and they determined there is no need for compression at
this site at this time.

CI In response to Commissioner Conway regarding "regulatory uncertainty", Mr. Groom
confirmed Senate Bill 181 was a factor in the applicant choosing to withdraw their application and
there was additional discussion regarding the impacts of the bill.
IR Commissioner Moreno moved to accept the withdrawal of Bonanza Creek Energy Operating
Company, LLC, c/o DCP Operating Company, LP, for a Site Specific Development Plan and Use
by Special Review Permit, USR18-0099, for a Mineral Resource Development Facility, Oil and
Gas Support and Service, Natural Gas Compressor Facility, one (1) up to 100 feet in height secure
communications tower, a temporary laydown and storage yard, up to eight (8) construction office
trailers and sixteen (16) conex containers for use during the construction of the facility in the
A (Agricultural) Zone District. The motion was seconded by Commissioner Conway, who stated
there will be consequences with Senate Bill 181, and appreciated the applicant's honestly. The
motion carried unanimously, and there being no further discussion, the hearing was completed at
10:19 a.m.
This Certification was approved on the 27th day of March, 2019.
