RE: APPROVAL OF PRELIMINARY PLAN OF WALTER J. PETERS FOR PETERS
SUBDIVISION.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on the 31st day of July, 1978, the Preliminary Plan
of Walter J. Peters for Peters Subdivision was submitted to the
Board of County Commissioners for approval in accordance with the
Subdivision Regulations of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners heard all of the
testimony and the statements of those present, and
WHEREAS, the Board of County Commissioners had evidence pre-
sented in support of the approval of said Preliminary Plan, and
no evidence was presented in opposition to the approval of the
Preliminary Plan for the following described real estate, to-wit:
A tract of land located in the Northeast Quarter
(NE-1/4) of the Northwest Quarter (NW;) of Section
32, Township Six North (T6N) , Range 65 West
(R65W) , of the Six Principal Meridian (6th P.M.) ,
Weld County, State of Colorado, being more parti-
cularly described as follows:
Beginning at the Northeast Corner of the Northwest
Quarter (NWa)of said Section 32, and considering
the East Line of the Northwest Quarter (NWa) to
bear S 00°00'00" E, with all other bearings herein
being relative thereto, thence S 00°00'00" E a
distance 40 feet flora said Northeast Corner to
the True Point of Beginning, thence follaaing
these seven courses:
N 90°00'00" W, a distance of 388.20 feet,
S 00°00'00" E, a distance of 280.00 feet,
N 90°00'00" W, a distance of 275.03 feet,
S 24°22'03" E, a distance of 665.19 feet,
to the North R.O.W. of U.S. Highway 85, thence
S 76°28'48" E, a distance of 227.94 feet along
said North R.O.W. , thence S 74°56'58" E, a
distance of 173.10 feet, along said North R.O.W. ,
to the East Line of said Northwest Quarter (NWa) ,
Section 32, thence N 00°00'00" E along the East
Line of said Northwest Quarter (Nigh) , Section 32,
a distance 984.17 feet to the True Point of
Beginning.
The above described tract contains 10.239 acres.
WHEREAS, a representative of the petitioner was present, and

WHEREAS, the Board of County Commissioners has studied the
request as submitted, and having been fully informed and satis-
fied that the submitted Preliminary Plan conforms in all respects
with the requirements of Section 5 of the Weld County Subdivision
Regulations, and that approval of said Preliminary Plan would be
in the best interest of Weld County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the Preliminary Plan
of Walter J. Peters for Peters Subdivision located in the
Northeast Quarter (NE4) of the Northwest Quarter (NWa) of Section
32, Township Six North (T6N) , Range 65 West (R65W) , of the
Sixth Principal Meridian (6th P.M. ) , Weld County, Colorado, be
and hereby is, approved subject to the request by the City of
Greeley Planning Commission that the cul-de-sac be improved with
a maximum cross section and that no-parking restrictions on the
street be applied. This would allow for an open roadway for
emergency access and egress.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated July 19, 1978 , be and hereby are, incorporated as the findings
of fact of the Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 31st day of
July, A.D. , 1978.

the comprehensive plan of the City of Greeley.
3. The West Greeley Soil Conservation District has no objections to
the preliminary plan provided the applicant addresses the
recommendations contained in their letter dated June 20, 1978, at
the time of final plat .
4. The Weld County Health Department has no objections to the preliminary
plan provided the applicant complies with the stipulations as out-
lined in their letter dated June 21, 1978.

5. The Colorado Geological Survey has no objections to the
preliminary plan provided the applicant complies with the
recommendations contained in their letter dated June 12, 1978.
6. The Colorado Division of Highways has no objections to the
preliminary plan provided the applicant addresses the points
contained in their letter dated June 8, 1978, at the time
of final plat.
7. The Weld County Engineering Department has set forth no
objections to the preliminary plan provided the points
enumerated in their memo dated July 17, 1978, are addressed
by the applicant at the time of final plat .
8. The Weld County Utilities Advisory Board on July 13, 1978,
recommended approval of the utility plan for the preliminary
plan as presented.
Comments :
1. The Eaton Fire Protection District failed to respond to the
referral sent to them.
2 . School District #6 has no comments or suggestions to offer
regarding this preliminary plan.
3. The City of Greeley Planning Commission in a letter dated
June 15, 1978, has requested that the cul-de-sac be improved
with a maximum cross section and that no-parking restrictions
on the street be applied. This would allow for an open road-
way for emergency access and egress .

As per our discussion , July 14 , 1978 , I offer the following
comments concerning Peters Subdivision :
1 . My earlier request that the problem of storm water
retention be considered further , should be addressed
at the time of final platting .
2 . The cul -de-sac radius should be adjusted to Weld
County Standards .
3 . The roadway width should be adjusted to allow for
12 foot driving lanes .
4 . The roadway ditches should be designed to allow for
driveway culverts with proper cover .

Re: Drainage Report Peters Subdivision
Gentlemen:
Included herein is the drainage report for the proposed Peters
Subdivision located in the Northeast quarter of the Northwest
quarter of Section 32 , Township 6 North, Range 65 West, of the
Sixth Principal Meridian, Weld County, Colorado.
Design Criteria. A storm frequency of 100 years is used for cal-
culating storm runoff. The "Rational Method" of design was used
for calculation of storm runoff. The runoff coefficient (C) of
0. 37 was used for the developed subdivision. The undeveloped
coefficient of 0 . 25 was used.
Drawing . Sheet 3 of 4 of the preliminary plat submission has been
used as the basis for the presentation of the drainage information.
Directional flow arrows, preliminary street, runoff concentrations
in acres and cubic feet per second (cfs) at various lot corners,
location of ditches, and culverts are shown on this drawing.
Storm Drainage Area. Contributary drainage areas which affect the
design of drainage facilities for Peters Subdivision are reduced
to zero since the subdivision lies at the top of a hill and all
runoff from the north is intercepted by "0" Street (County Road
64 ) ditches and taken east along "0" Street (County Road 64 ) to
the Eaton Draw. Therefor , the only contributing area is the
subdivision itself.
Drainage Plan. The general drainage plan for the subdivision is
as shown on sheet 3 of 4 'of the preliminary plans. Due to the
natural lay of the land all storm water from lots 1 , 2 , 3 , 4 , 5,
and 6 will flow into a swale along the east side of the sub-
division running north and south and carried in the swale to
the southeast corner of the subdivision and discharged into the
U . S. Highway 85 ditch and carried in this ditch to the Eaton
Draw. The Eaton Draw in turn flows to the Cache La Poudre'

Peters Subdivision
River one-half mile southwest of where the Eaton Draw crosses
under U. S . Highway 85 . The runoff from Lot 7 is carried in
the west ditch along Peters Drive south to the U. S. Highway
R. 0. W. on the south side of the subdivision, then in a
swale along the R. 0. W. to the southeast corner of the sub-
division and discharged in the same manner as lots 1 through
6 above. No problems with erosion are expected due to the
very flat grades of 0 . 2 to 0 . 5 percent. The total historical
100 year runoff from this subdivision is:

= 7 . 9 cubic feet per second
The developed 100 year runoff is:
Q = . 37 X 3 . 1 X 10 . 23
= 11 . 7 cubic feet per second
Development will cause an additional 3 . 8 cubic feet per second
runoff in a 100 year storm over the historical runoff .
Conclusion. According to this analysis, all storm drainage
runoff from a 100 year design storm can be routed through
this subdivision by the drainage plan outlined herein with-
out flooding the proposed improvements. The critical points
of concentration have been discussed in this report. No
special drainage structures other than swales and ditches
are required except for a 18" C .M.P. at the north end of
Peter ' s Drive to allow drainage to the east along "0" Street.
Recommendations. It is recommended that if it is determined
the total additional runoff will overburden the Eaton Draw
then on-site detention facilities may be required. These
could be designed to meet the City of Greeley requirement
for on-site detention of storm runoff.
It is also recommended that the storm drainage runoff be
routed through the subdivision as shown on Sheet 3 of 4
of the preliminary plans.

The following comments are made in regards to a request for the review of a
preliminary plan for Peters Subdivision.
Soils: The subdivision area is located on the soil type Kim loam, 1. to 3
percent slopes. This soil has few limitations for the intended use. How-
ever, it does exhibit a low strength characteristic for commercial building
construction. Soil engineering tests should be made prior to construction
to insure proper design of footings and foundations. There are none to
slight problems encountered for the use of septic tank filter fields.
Surface drainage system: The surface drainage system for storm runoff as
planned is based on "Rational Method" of computation. In review, our cal-
culations indicate 18 cfs anticipated runoff as compared to 12.0 cfs of the
plan. Our calculations are based on the SCS publication "Procedures of
Determining Peak Flows in Colorado". The basic difference is the figure
used for 100 year, 24 hour precipitation level. The plan used 3.1 inches
and our charts indicate 3.8 inches as the proper intensity. The channels
to carry storm runoff along Peters Drive are adequate as designed, however,
the plan did not indicate any size or cross sectional area for the other
drainage ditches planned. These designs should be included and made part of
the final plan so that the adequacy of the plan can be properly evaluated.
The plan also indicates direct discharge of storm flows into the highway
right of way. There is no mention nor permission granted by the highway
department for the discharge. If permission is not granted, there will be
a requirement for the design of a waterway to carry storm flows safely to
Eaton Draw.
Vegetative plan: There is no vegetative protection or restoration plan
included for review. It is our recommendation that a vegetative plan be
prepared and submitted as part of the final plans to insure adequate soil
protection for the prevention of wind and water erosion.

The Drainage Plan for Peters Subdivision does not comply
with Weld County Standards at this time . Since this
subdivision is not P . U . D . and since it falls within the
Greeley Comprehensive Plan area , retention facilities
should be included . A single retention area should be
designed with adequate volume to retain the run-off
resulting from a 100 year storm frequency in the
developed condition . The maximum outfall rate should be
equal to the 5 year frequency rate in the undeveloped
condition . Although it is not known exactly what the
improvements will consist of , reasonable estimates can
be made in arriving at run-off values .

In its June 13, 1978 review on referral of the Peters Subdivision,
located on County Road 64 east of U. S . 85 , the Greeley Planning
Commission passed a motion of no objection . However , concern
was noted for the length of the proposed cul de sac , which exceeds
the S00 foot maximum provided in the Subdivision Regulations .
The Fire Department requested and the Commission concurred that
the cul de sac be improved with a maximum cross section and that
no-parking restrictions on the street he applied. This allows
for an open roadway for emergency access and egress .

developed residentially. He poi- tcd out the location of the
Shawsheen- Schoot in the area and parks near the proposed site.
The property in the area is presently zoned R- 2 for duplex develop •
-
ment . This proposal would reduce the development by two lots , or •
four residential units. Minimum parking and open space require-
ments are being met.
.Mr. Maas pointed out that they have tried to design the facility
to be compatible with the neighborhood, and it will be surrounded
by a six foot fence. The design would not only maintain the
character in the area, but also provide a facility which is
needed there.
Commissioner Keirnes asked how close the nearest developed lot
is . Bill Neal, of Webhan, replied that three sides have been
built on. Commissioner Keirnes asked how close the nearest
lot which is privately owned is . Mr. Neal replied that there is
no one living in this area yet. Glenn Billings commented that they
anticipated single parents or husbands and wives with families
to he living in this area , so the facility would fall precisely
in with development in the entire duplex area. Patricia Haas
pointed out that it is desirable to have a day care center near
an elementary school, to provide somewhere close for children to 1
go during the hours of the day when they are not in school,
as kindergarten students. Mr. Billings noted that people buying
the homes in this development would be made aware of the center.
Commissioner Ewald asked whether the permit would limit the number
of students. Mr. Given replied that licensing from the State 1
requires a certain number of teachers and amount of open space
per child. Also, two off-street parking spaces are required for
each teacher by the Zoning Code. Commissioner Ewald questioned
whether this was entirely a private commercial adventure . Mr. Haas
replied that it is . Commissioner Clift made a motion to recommend
approval of the Use By Special Review. Commissioner Modlin
seconded the motion. Vote was taken and the motion carried
unanimously.

V. REFERRAL FROM COUNTY: PETERS SUBDIVISION
LOCATION: County Road 64, East of U.S. 85 Bypass 4
Bob Morris of Zoyiopoulos F, Associates was present to answer •
questions concerning this item. Mr. Given pointed out that this
property is located at County Road 64 between 64 and U.S. 85
Bypass, and east of the Bypass, and contains ten acres zoned
commercially. The subdivision created seven acres with a cul de
sac serving the lots . The property is currently developed with
three buildings. Some comments were received in Administrative
Review noting that County Road 64 is an arterial which requires an
additional 2Q feet for right-of-way. The Fire Department has
expressed some concerns for the length of the cul de sac, which exceeds
the maximum length allowed by the Subdivision Regulations . Problems
• may occur with turning around or blocking the street.

Commissioner Cummins questioned the present use of property near
this site. Mr. Morris replied that it is presently a farm yard.
Commissioner Cummins asked if the farm has access off of County Road
64. Mr. Morris replied that it does. Commissioner Ewald asked
whether this request was for the zoning on this property. Mr. Given
replied that the property has already been zoned. This item con-
cerns the preliminary plat.
He also noted that the length of cul de sacs has come up in other
requests to the department, and this particular request may
be justified by the large size of the lots. Commissioner Cummins A
suggested two circles further down the cul de sac. Mr. Given
said that this is a possibility that might satisfy the Fire Depart-
ment, however if the lanes arc kept open there should be no problem.

Commissioner Keirnes questioned where this property is in the
growth ring. Mr. Given replied that it is suggested for Light
Industrial in the Comprehensive Plan, and it is in the 2010 growth
ring. Commissioner Keirnes asked when annexation was anticipated
for this property. Mr. Given replied that this would be diffi
cult to anticipate because of its location north of the river.
Commissioner Ewald asked if there is a road on the east side of
the site. Mr. Morris replied that there is not. Commissioner
Ewald made a motion to recommend no objections to the preliminary
plat as presented, except some concerns for, fire access . Commis-
sioner Clift seconded the motion. Vote was taken and the motion
carried unanimously.

WELD COUNTY
We have reviewed the preliminary plat and attendant information on
the above referenced subdivision. In general, local soil conditions
could adversely affect residences and, thus, should be accounted for
in the design of building foundations. We recommend that all
foundation excavations be inspected by qualified geotechnical
personnel to insure adequate foundation design.
The most critical aspect regarding the proposed Peters subdivision
is the feasibility of on-lot septic systems. Because of the
very small lot size, we strongly recommend that a detailed study of
each lot be conducted. This study should determine at least two
sites on each lot for sewage disposal and develop a homeowner's
maintenance program.
Until the feasibility of on-lot septic systems has been determined,
we cannot recommend approval of this application.

The Colorado Division of Highways has reviewed the Preliminary Plan of the
Peters Subdivision, and we ask your consideration of the following comments.
1 . This subdivision was discussed at the March 29, 1978, meeting of the City of
Greeley Administrative Review Team. At that time, the comment was made that
additional runoff attributable to this development should be retained and
released at the historical rate. According to the drainage report provided
for review, on-site detention may be required if additional runoff over-
burdens Eaton Draw. We suggest that on-site detention be provided whether
or not additional runoff overburdens Eaton Draw, since we feel that new
development should adapt to existing drainage facilities whenever possible.
We note that the cul-de-sac, as shown, intrudes on the 15-foot drainage and
utility easement. We suggest that this easement not be encroached upon,
and that the cul-de-sac be constructed outside of this easement. This would
appear to only require the movement of the cul-de-sac for a distance of
three feet.
2. We re-emphasize our comment concerning the need to have a minimum 100-foot
setback distance from the highway centerline in order to provide adequate
protection from highway noise. This distance assumes no other abatement
measures such as walls , earth berms or noise-insulated construction.
We appreciate the opportunity to review this plan.

GEOLOGIC HAZARD INVESTIGATION
SCOPE
This report will present the results of our geologic hazard investigation
of the Peters Subdivision which is locatedc in Section 32 of Township 6
North, Range 65 West of the 6th Principal Meridian in Weld County, Colora-
do. The purpose of this investigation was to find which , if any, of the
geological hazards identified in H.B. 1041 , or in guidelines of the Colo-
. rado Geological Survey, are present at this site, and to determine their
effects on the proposed development. Consideration is also given to con-
ditions which can be expected to change with the change in land use.
LOCATION
The approximate 10.3 acre site is located at the north edge of Greeley,
just north of the U.S. 85 ByPass. This location is two miles from down-
town Greeley. The specific location is shown on the accompanying map.
TOPOGRAPHY
The site is gently sloping southeasterly and the surface elevation is
approximately 4,700 feet. The general slope is at 0.8 to 1.0 percent.
GEOLOGY
The surface geology of the area consists of silty sands and gravels
which occupy the Cache La Poudre River Valley. This materials is
generally 15 or more feet in thickness. During excavation, a clay was
encountered in lenses and not consistent throughout. The water table
was not located. The deepest hole was 15 feet.
The bedrock was not encountered and no exposures were observed in the
general vicinity. At this site the bedrock is inferred to be near the
contact between the Pierre Shale and Fox Hills Sandstone as shown on the
accompanying map. The exact location of the contact was not identified
and could vary from that shown.
GEOLOGIC HAZARDS
Geologic hazards are defined by H.B. 1041 as "a geologic phenomenon which .
is so adverse to past, current or foreseeable construction or land use as
to constitute a significant hazard to public health and safety or to
property. " Several of the specific hazards usually considered, such as
rock fall , slippage, or creepage, are not applicable to this site because
of the gentle topography.

A. Seismic Acticity - All of Colorado is in Seismic Risk Zone 1 (minor
d(,,mage). There is no history or evidence of seismic activity in
this vicinity.
B. Ground Subsidence - There are no sub-surface excavations such as mine
. 'workings known in this area.
C. Water Table - The water table was not encountered in drilling so it
may be said that it was at least 15 feet in depth.
D. Expansive Soil - The clays found at the site have no tendency for
volume change with change in moisture content.
E. Flood Plain - The site is not within any area designated as flood
prone by the.U.S. Geological Survey studies of this region.
NATURAL RESOURCES
The site is located in an area having very little potential as a future
source of gravel for use as cement aggregate and road material . There is
now a minimum of 15 feet of overburden over the site which would have to
be removed. We know of no other economic minerals which may occur below
surface of this site.
CONCLUSIONS
A. This - clogy of the site is a relatively deep alluvial deposit of
n.; gravel with over 15 feet of silty sand and gravel overburden.
Bedrock was not encountered in drilling.
B. The geologic hazard of this location is limited to a slightly expansive
soil .
