On May 2, 2018, a PUC application was filed jointly by the Commissioners, CDOT and Union Pacific Railroad for WCR 2.5. The Public Utilities Commission recently approved closure of the public crossing. Therefore, the Board's Resolution from September 17, 2018 for this location may be recorded. The attached closure and maintenance agreement is the same as the ones the Board approved for WCR's 72 and 104. in the past, Union Pacific Railroad included their Crossing Closure and Maintenance Agreement as part of the Resolution to the Board for the closure. Union Pacific Railroad has recently updated their template agreement and is making this a three -party agreement with them, us, and CDOT. They are requesting the Board execute it and then forward to CDOT for signature who will then send it back to UPRR for final execution. The attorney's have reviewed and approved the agreement. What options exist for the Board? (include consequences, impacts, costs, etc. of options): • Allow the attached agreement to be placed on the next available BOCC agenda for signature. • Request a work session to discuss. Recommendation: This closure and maintenance agreement is the same as the one approved by the BOCC for WCR's 104 and 72, therefore, staff recommends approval of this agreement.
