A public hearing was conducted on October 2, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated August 16, 2019, and duly published
August 21, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request
of Joel Velasco, for a Site Specific Development Plan and Use by Special Review Permit,
USR19-0045, for a Use permitted as a Use by Right, Accessory Use or Use by Special Review
in the Commercial or Industrial Zone Districts (vehicle repair establishment including a shop and
truck and equipment storage, and up to one (1) construction office trailer and five (5) conex
containers), provided that the property is not a lot in an approved or recorded subdivision plat or
part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the
A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of
record.
Maxwell Nader, Department of Planning Services, presented a brief summary of the proposal
and stated the proposed use is on Recorded Exemption, RECX19-0044. He provided information
about the number of on-site trucks, lighting, employee parking, the Landscape and Screening
Plan, and the proposed 15,000-square-foot shop. He provided the hours of operation, number of
employees, and indicated one (1) letter of opposition had been received from a surrounding
property owner (SPO), who, after working with the applicant to mitigate concerns, submitted a
letter of support. He stated 11 referrals were sent out, eight (8) agencies responded, and the site
is within the Town of Platteville's Coordinated Planning Agreement (CPA) and the three (3) mile

referral area of the Town of Gilcrest. He described the surrounding uses, entered the favorable
recommendation of the Planning Commission into the record as written, and displayed images of
the site and surrounding views.
▪ Mike McRoberts, Department of Public Works (PW), provided a brief overview of the
transportation plans and requirements, stated the access is on County Road (CR) 36, and
provided the daily roundtrips and average speeds. He indicated PW is requiring a Road
Maintenance Agreement, described acceptable tracking control, and presented the drainage and
grading requirements.
le Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions, stated a commercial well will provide water, a commercial septic system will be
installed when the shop is constructed, there will be no fuel storage onsite, and floor drains will
have to drain into a separate vault. She stated Development Standards (DS) #14-24 address
Environmental Health items, and in response to Chair Kirkmeyer, Mr. Nader confirmed there is
one (1) residence in close proximity to the site.
e Joel Velasco, applicant, provided a PowerPoint presentation (Exhibit D), explained his
background, provided information about Entrec, the company he works for and will lease the site
to. He described the site selection process and the mitigation measures to address SPO
concerns, discussed future plans for the site and displayed a site plan.
• No public testimony was offered concerning this matter.
• In response to Chair Kirkmeyer, Mr. Velasco stated the trucks and cranes are not onsite the
majority of the time; however, when the cranes are onsite, they are stowed (down), and he
indicated the business only operates during daylight hours. In response to Chair Kirkmeyer, he
provided what he thought to be a sufficient number of office employees, commercial trucks, semi-
trucks, cranes, and trailers to accommodate future growth. In response to Chair Kirkmeyer, Ms.
Light indicated the proposed septic system is acceptable for up to 20 office employees, and there
was discussion with Mr. McRoberts concerning the access road and off-site improvements. Chair
Kirkmeyer suggested deleting DS#5 (number of commercial trucks), #6 (number of semi-trucks),
#7 (number of cranes), and #9 (number of trailers), and adding "with triggers for off-site
improvements" in Condition of Approval (COA) #1.A (Improvements and Road Maintenance
Agreement). Mr. McRoberts suggested removing COA#1.B (Final Drainage Report), as the site
meets a drainage exception, and in response to Commissioner Conway, Mr. Velasco indicated
the only lighting will be around the building. Mr. McRoberts suggested deleting COA #1.C.13
(drainage features and stormwater ponds), and Chair Kirkmeyer suggested changing the
language in DS #3 to read, "The hours of operation for the office are from 7:00 a.m. to 6:00 p.m.,
Monday- Friday' and changing DS #4 to read, "The number of on-site employees pertaining to
the office shall be up to 25." In response to Chair Kirkmeyer, Mr. Nader confirmed the closest
residence is 600 feet to the west. Chair Kirkmeyer suggested deleting DS #20 (noise level), and
after discussion about the septic system she suggested adding a new DS #20 (Injection Well
permit for any large-capacity septic system). The Board agreed to all of the aforementioned
changes.

El In response to Chair Kirkmeyer, Mr. Velasco indicated he had reviewed, and agreed to abide
by, the Conditions of Approval and Development Standards, as amended.
No public testimony was provided with regard to changes made to the Conditions of Approval
and Development Standards.
IN Commissioner Conway moved to approve the request of Joel Velasco for a Site Specific
Development Plan and Use by Special Review Permit, USR19-0045, for a Use permitted as a
Use by Right, Accessory Use or Use by Special Review in the Commercial or Industrial Zone
Districts (vehicle repair establishment including a shop and truck and equipment storage, and up
to one (1) construction office trailer and five (5) conex containers), provided that the property is
not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption
of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards, as amended. The motion was seconded by
Commissioner Freeman. Commissioner Conway thanked the applicant for his professionalism in
his presentation, his service to our country, and his due diligence. The motion carried
unanimously. Commissioner James acknowledged the applicant's thorough presentation, and
Commissioners Moreno and Freeman echoed the comments of their fellow Commissioners.
Chair Kirkmeyer thanked Mr. Velasco for his service, commended his presentation, stated why
she supported the application, and expressed appreciation for the applicant taking responsibility
for not understanding the Code, and for being a good neighbor. There being no further discussion,
the hearing was completed at 11:47 a.m.
This Certification was approved on the 7th day of October, 2019.
