This parcel was valued as a mixed use property from 2010 through 2017, being used as partial residential and partial commercial. This was supported by two USR's issued in 2009 and 2011 and was listed for sale twice with a mixed use description. The commercial status was removed in 2018 based on a conversation with Mr. O'Keefe on 10/4/2018 and the physical inspection on 9/25/2018. Petitioner requests an abatement for tax years 2016 & 2017. Petitioner lives in Belize and is difficult to get ahold of. I initially left him a voice message on 8/7/2018. Then emailed him on 9/12/2018. Receiving no reply from the owner, I reached out to the Realtor listing the property for sale and requested an inspection and explained that the petitioner, Mr. O'Keefe was seeking an abatement. I inspected the property on 9/25/2018. Mr. O'Keefe did phone me on 10/4/2018. Per that conversation, I requested that Mr. O'Keefe provide documentation showing that the parcel was no longer being used in a commercial capacity during 2016 and 2017. Mr. O'Keefe was waiting for the property to sell as it was under contract and stated that he didn't know if he wanted to proceed with the abatement. I requested that if he wished to withdraw his abatement that I would need something in writing to withdraw it. I sent a follow up email on 12/18/2018. On 1/3/2019, I phoned Mr. O'Keefe. I stated that I still needed proof that the property was not being ran commercially in 2016 and 2017 and he agreed that he would provide a copy of the lease on the property. I also informed him that my deadline was 1/7/2019. As of 1/15/2019 I have not received evidence that the property was not operating commercially in 2016 and 2017 nor have I received a request for withdrawal. The property sold on 10/12/2018 for $295,000.00. Through the sales confirmation process, it will be determined how this property is being operated for 2019. Currently, the property is being valued as residential since 2018. Appraiser requests that this abatement be denied.
