HomeMy WebLinkAbout20192401.tiffHEARING CERTIFICATION DOCKET NO. 2019-75 RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0025, FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS (OFFICE, LIGHT MANUFACTURING, AND OUTDOOR STORAGE OF VEHICLES AND EQUIPMENT) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT - MEADOW RIDGE HOLDINGS, LLC A public hearing was conducted on July 3, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro -Tern Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Department representative, Mike McRoberts Health Department representative, Ben Frissell The following business was transacted: .2 I hereby certify that pursuant to a notice dated May 14, 2019, and duly published May 17, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Meadow Ridge Holdings, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0025, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (office, light manufacturing, and outdoor storage of vehicles and equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. Angela Snyder, Department of Planning Services, presented a brief summary of the proposal. She stated 13 referrals were sent out and eight (8) agencies responded, and indicated the site is within the three (3) mile of referral area of the Towns of Hudson and Lochbuie. She explained one (1) existing building is agriculturally exempt and there are two (2) additional buildings proposed. She provided the hours of operation, the number of employees, and the daily roundtrip counts associated with the business. She further stated there are no signs proposed, and the Department of Planning Staff requested a Landscape and Screening Plan, and a Lighting Plan. She displayed images of the site and surrounding properties and entered the favorable recommendation of the Planning Commission into the record as written. In response to Chair �C PLCINSITPi%Pin(mm),thi3f) lac11a12.014 2019-2401 PL2679 HEARING CERTIFICATION - MEADOW RIDGE HOLDINGS, LLC (USR19-0025) PAGE 2 Kirkmeyer, Ms. Snyder clarified the airplane in the displayed images is in flight, as the site is in the flight path of Denver International Airport (DIA). in Mike McRoberts, Department of Public Works, provided a brief overview of the transportation plans and requirements, explained the access for the site is on County Road (CR) 43, and indicated there are no traffic counts for the area. He stated the applicant will have a temporary tracking control pad during construction, the Department of Public Works (PW) is requiring an Improvements and Road Maintenance Agreement, and he presented the drainage and grading requirements. Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer provisions and stated water is being provided by an existing industrial well, and an existing commercial septic system for six (6) people serves the site. He explained there will be no floor drains or washing of vehicles or equipment, and Development Standards (DS) #9-16 address Environmental Health (EH) items. n Patrick Groom, Attorney, represented the applicant and explained Barry Fehr, one of the principals in Meadow Ridge Holdings, LLC (applicant), as well as Greenleaf Acres, LLC, the company who owns property surrounding the proposed site, wanted a facility to process the seed grown on the Greenleaf Acres, LLC, property. He stated Mr. Fehr also needed office space for his operation and other possible tenants, and space to store equipment for an excavation company he operates. Mr. Groom indicated the site is close to the 1-76 corridor and the Commercial Uses in the area make the proposed Use compatible. He described the accesses to the site, and in response to Chair Kirkmeyer, Mr. Groom confirmed some excavating equipment will be parked outside and he indicated the parking/storage area on the map. El No public testimony was offered concerning this matter. E- Mr. Groom expressed concern with a DS proposed by the Building Department, via email the morning of the hearing, as well as the requirement of a Road Maintenance Agreement. Chair Kirkmeyer suggested deleting COA #1.A (Road Maintenance Agreement), due to limited traffic, and COA#1.C (Landscaping and Screening Plan), and in response to Chair Kirkmeyer, Mr. Groom clarified COA #1.E. She suggested deleting COA #1.G.5 (map to delineate landscaping and screening), COA#1.D (Lighting Plan), COA#1.G.17 (label the parking and traffic circulation flow arrows), as it was a duplicate of COA #1.G.16, and in COA #1.G.16 deleting the words "parking and". Chair Kirkmeyer suggested deleting DS #3 (hours of operation), changing the language in DS #4 (number of employees) to read, "shall be up to twenty (20)", and deleting DS #5 (number of commercial vehicle trips), #8 (Landscape and Screening Plan), #13 (Commercial Zone noise level), #22 (Improvements and Road Maintenance Agreement), and #23 (review Improvements and Road Maintenance Agreement annually), and the Board agreed with all of the changes made. After discussion among the Board and Mr. Groom about his above referenced concern of the proposed DS, the Board decided not to include it. El In response to Chair Kirkmeyer, Mr. Groom indicated he had reviewed, and on behalf of the applicant agreed to abide by, the Conditions of Approval and Development Standards, as amended. 2019-2401 PL2679 HEARING CERTIFICATION - MEADOW RIDGE HOLDINGS, LLC (USR19-0025) PAGE 3 12 No public testimony was offered concerning the changes made to the Conditions of Approval and Development Standards. Le Commissioner Conway moved to approve the request of Meadow Ridge Holdings, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0025, for any Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial or Industrial Zone Districts (office, light manufacturing, and outdoor storage of vehicles and equipment) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Moreno, and it carried unanimously. There being no further discussion, the hearing was completed at 10:31 a.m. This Certification was approved on the 8th day of July, 2019.
