HomeMy WebLinkAbout20192362.tiffRESOLUTION RE: APPROVE APPLICATION FOR 2020 VICTIM ASSISTANCE AND LAW ENFORCEMENT (VALE) GRANT FOR VICTIM WITNESS ASSISTANCE UNIT AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Application for the 2020 Victim Assistance and Law Enforcement (VALE) Grant for the Victim Witness Assistance Unit from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the District Attorney's Office, to the Victim Assistance Law Enforcement (VALE) Board, commencing January 1, 2020, and ending, December 31, 2020, with further terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. The Victim Rights Amendment mandates more VRA duties to District Attorney Offices than any other Criminal Justice System entity for crime victims. The Weld County Victim Witness Assistance Unit completes these VRA mandated duties for crime victims as well as Crime Victims Compensation Program statutory duties. VALE provides partial funding for five staff of the VW Unit who provide services to VRA victims as the criminal case moves through the Criminal Justice System. 6. The Victim Witness Assistance Unit is a department in the Weld County District Attorney's Office and was established in 1980 Presently, the Victim Witness Assistance Unit staff consists of 13 staff (12 75 FTE) working with victims of felonies, misdemeanors, and traffic cases The District Attorney's Office Victim Witness Assistance Program is the only program providing VRA crime victims with 1 mandated notices to victims of Victim Rights' Amendment crimes regarding the critical stages of the court system which advise them of their rights with regards to the court system, 2 court case status information to victims, witnesses and law enforcement, 3 a liaison between the victim and prosecutor, 4 a safe and secure court waiting area for victims and witnesses, ,5 a review of criminal cases to compile information to determine victim restitution, 6 "meaningful consultations" with misdemeanor domestic violence victims, 7 Crime Victim Compensation - regular and emergency awards, 8 administrative support to the Crime Victim Compensation and VALE Boards 8 Project Description for which the funds are being requested from Weld County VALE VALE funds will provide partial funding for 5 positions in the Victim Witness Unit of the District Attorney's Office Position 1 -Director of Victim Services supervises the VW Assistance staff of twelve A primary job duty is to be certain that crime victims of VRA (Victim Rights Amendment) are informed of their rights in the criminal justice process She creates VRA policies, procedures and provides oversight to ensure the day-to-day work of the staff of the Victim Witness Unit complies with the statutorily mandated VRA duties of the District Attorney's Office C.R.S. 24- 4.1-301- GUIDELINES FOR ASURING THE RIGHTS OF VICTIMS AND WITNESSES TO CRIMES. The District Attorney's Office VRA mandated duties include informing victims of the critical stages of the court system, the right to be present at the critical stages of the court system, the right to speak at Bond Modification Hearings, Entry of Plea Negotiation, Sentencing, Modification of Sentencing, and hearing regarding the victim's records being subpoenaed She trains staff whenever the VRA statutes are amended Additionally, she provides direct contact to crime victims and facilitates situations involving victims who are upset and frustrated 2 Positions 2 & 3 -County Court VW Assistants have a large misdemeanor domestic violence caseload dealing with approximately 70 new primary victims each month This caseload is challenging as domestic violence victims go through a number of emotions as the case progresses through the court system These VW Assistants also handle Careless Driving Resulting in Death, balancing many family members who may have different feedback as to how the case should be resolved Position 4- The Clerical VW is the first person many victims speak to when phoning the District Attorney's Office Due to the court schedules of the VW Assistants, she many times provides assistance until the VW Assistant can make contact Her patient, caring and calming manner is an essential piece to make a positive experience with the District Attorney's Office Through a letter notification process, she is responsible to notify all VRA victims of the sentence the judge has imposed on the defendant and post sentencing notification information Additionally, she is back up to the Notification Clerk to make sure VRA letters are always sent out timely Position 5 — The Crime Victim Compensation Assistant assists victims who apply for Crime Victim Compensation The CVC Program has increased victim applications and funding awarding This position was first created in 2006 working 20 hours a week, gradually increasing to 30 hours a week After being unsuccessful in obtaining VOCA funding for this position in 2017, the County Commissioners approved funding to absorb the costs not funded by the VALE Grant to make this a full- time position in 2019 9 Is this project located entirely within the 19th Judicial District? Weld County is the third largest county in Colorado, covering 3,996 square miles with much of that area represented by rural sprawl The estimated population (July 2018) is 314,305, with minority populations of 29% Hispanic, 1 5% Black, 1 6% American Indian and 1 7% Asian Underserved populations served by our Unit not only have language barriers, but also barriers related to location, primarily access to transportation and services in their local communities An area of emphasis for our Unit has been serving those with language barriers In order to make sure that non-native English speakers know their rights, and are able to participate in the criminal justice process to the fullest, we have Spanish speaking Victim Witness Assistance staff, access to a language line service, knowledge of local translators for ASL, contact letters in primary East African languages to reach a greater number of our refugee population, and VRA letters in English and Spanish 13 How many victims have you served previously for this project?
