WHEREAS, a public hearing was held on June � , 1975, in the
chambers of the Board of County Commissioners of Weld County, Colorado,
for the purpose of hearing the petition of Gerald Chapin, Route 2, Box 322,
Greeley, Colorado, seeking a conditional use permit for the erection of a
single family dwelling on the following described property, to-wit:
Part of the South Half (SD of Section 11, Township 6 North,
Range 66 West of the 6th P. M. , Weld County, Colorado, being
more particularly described as follows:
Beginning at the West Quarter Corner (W1 Cor) of said Section
11, and considering the North Line of the South Half (SD of
said Section 11, as bearing North 89°57'32" East, with all
other bearings contained herein being relative thereto;
Thence North 89°57'32" East, along the North line of the
South Half (SD of said Section 11, 1083. 21 feet to the True
Point of Beginning;
Thence South 32°18'06" East, 2951. 23 feet;
Thence South 00°00'54" East, 151 , 81 feet to the South Quarter
Corner (S4 Cor) of said Section 11;
Thence North 89°58'48" East, along the South Line of said
Section 11, 345. 54 feet;
Thence North 18°21 '59" East, 662. 50 feet along a dividing
fence to a point on the South and West bank of a irrigation
ditch;
Thence generally along the South and West bank of said
irrigation ditch by the following eight (8) courses and distances:
North 37°13'52" West, 151. 63 feet;
North 34°01'25" West, 389. 28 feet;
North 33°53'02" West, 155. 71 feet;
North 38°17'09" West, 148, 63 feet;
North 37°55'06" West, 303. 33 feet;
North 33°31 '43" West, 283. 11 feet;
North 39°11'20" West, 771, 00 feet;
North 27°47'30" West, 289. 10 feet to a point on the North Line
of the South Half (SD of said Section 11;
Thence South 89°57'32" West, along the North Line of the South
Half (SD of said Section 11, 678. 18 feet to the True Point of
Beginning.
Said described parcel of land contains 43. 342 acres, more or
less, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of petitioner
for the location of the said single family dwelling, and
WHEREAS, the said requested location for the single family dwell-
ing is located in an agricultural zone as set forth by the Weld County Zoning
Resolution, and
WHEREAS, according to Section 3. 3(d) of the Zoning Resolution of
Weld County, said location for said single family dwelling may be authorized
upon the approval of the Board of County Commissioners of Weld County, and
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements of those present; has studied the request of the

petitioner and studied the recommendations of the Weld County Planning
Commission, and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Gerald Chapin, Route 2, Box 322,
Greeley, Colorado, for a conditional permit to locate a single family dwell-
ing on the premises indicated above be, and it hereby is granted under the
-conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. That all applicable subdivision regulations and zoning regulations
shall be followed and complied with in accordance with the Zoning Resolutions
of Weld County, Colorado.
3. That a temporary mobile home permit shall be applied for and
obtained.
4. That a building permit for the erection of a single family dwell-
ing shall be obtained to prior to construction thereof.
5. That the temporary mobile home shall be removed when con-
struction of the single family dwelling is completed or at the termination of
time on the temporary mobile home permit.

Be it Resolved by the Weld County Planning Commission that the
application for site approval of a residential site
covering the following described property in Weld County ,
Colorado , to-wit :

be recommended ( favorably ) (xrmthamxmxaikAjx) to the Board of County
Commissioners for the following reasons : (1 ) Complies with the Weld
County Comprehensive Plan in that non-productive rural land will be utilized.
(Mr. Chapin has sold the productive part of the original farm, and it is
presently being farmed. The land retained by Mr. Chapin is poor agricultural
land because of wet conditions created by seepage from the ditch to the east. )
(2) All requirements for Conditional Use Permit have been met. SUBJECT TO:
(1 ) Temporary mobile home permit being applied for and obtained; (2) Building
permits being obtained prior to construction; and (3) Mobile home to be
removed when construction is completed or at the termination of -time on
temporary mobile home permit.

Planning Commission staff recommends approval for following reasons:

REQUEST BE APPROVED FOR THE FOLLOWING REASONS :
1 . Complies with the Weld County Comprehensive Plan in that non-productive
rural land will be utilized. (Mr. Chapin has sold the productive part
of the original farm, and it is presently being farmed. The land retained
by Mr. Chapin is poor agricultural land because of wet conditions created
by seepage from the ditch to the east. )
2. All requirements for Conditional Use Permit have been met.
SUBJECT TO:
1 . Temporary mobile home permit being applied for and obtained.
2. Building permits being obtained prior to construction.
3. Mobile Home to be removed when construction is completed or at the
termination of time on temporary mobile home permit.

The applicant, his agents and employees shall comply with all the rules, regulations, restrictions and requirements of the Weld County Zoning
Regulations anp the Uniform Building Code governing location,construction and erection of the hereinabove proposed structure for which the permit
is granted. Violation of any of the rules or regulations applicable may result in the revocation of this permit. The Building Inspector or his agents are
authorized to order the immediate cessation of construction at any time a violation of the rules and regulations appears to have occurred.
The'applicant is required to call for inspection at various stages of the completion of the construction and in accordance with the aforesaid rule,
the applicant shall give the Building Inspector not less than one day's notice to perform such inspection.
In the event construction is not commenced within 60 days of the issuance of this permit, then the same is automatically void and of no further
force in effect. Cessation of work for a period of 120 continuous days shall cause the permit herein issued to be void.
