When Weld County decided to no longer tax the property as agricultural
and tax it as residential instead , the land owner Daryll Propp, who owned the
property for 41 , years submitted an initial plat pian to the county in 1998 . He
bought 13 water taps and started the platting process to have 13 residential lots
on the 31 plus acres he owned . After neighborhood feedback, 7 lots were
settled on and the platting process began in earnest .

Range 68 West an Weld County. The reports that were included in the referral were Subsidence
and Surface SD -am Analysts prepared by John Abel IJune 20011: Review of Mine Subsidence
Investigation prepared by Cneg Shennim (June 2001 arid Third Party Review Subsidence
Potential pteparcd by John Ivey I June 2001). A suuutary report by you indicated the proposed
building envelopes for lots 3 through 7
Nature of Subsidence. There is discussion in all of the imports of how much subsidence has

Records do show these were room and pillar mines . It is believed the
Morrison Mine is 82 to 102 feet below the surface and the depth that was
mined is believed to be 8 to 10 feet . Much of what they used to confirm the
mine location are three aerial photographs taken between 1949 & 1974 . Since
then they took photographs at four-year intervals until 1994 . The findings
indicate that all subsidence occurred within the first decade the mine was
abandoned .

The Morrison mine was abandoned in 1953 . The Clayton mine is
not relevant since there is no proposed building sites over it . It was
abandoned in 1942 .
According to County codes the plat was referred to the Colorado
Geological Survey ( CGS ) for review.
E - 21 , an engineering firm , was hired by the developer and ;
proceeded to take 13 different borings on 6 of the proposed lots . �

Conclusions
1. Most areas mined by the Morrison Mine have been tilled by collapse of roof rock. bulking of the
collapsed material, and/or sagging of the overlying strata creating some shallow subsidence
topographic features at the site.

3. The limited amount of void space present at the site indicates that evaluation of surface strains
may identify areas of the site suitable for development.
4. Based on review of aerial photographs for the site and the surrounding area depressions have been

aerial photographic review through 1994.
5. Based upon the depth to observed groundwater. depth to the mine, length of time since mining
activities have been performed and observations made during the drilling program
Recommendations

Based upon the findings of this investigation. it appears suitable areas for development are
present at the site Site-spccilic strains should be evaluated to assess specific development sites.
Colorado statutes require disclosure of geologic and other natural hazard risks or problems to
property hucrs Propert buyers must be intbrmed of the past mining activities at the site and the
risk of subsidence and should he provided with appropriate technical documentation and reports.
Second , another engineer had used these findings to calculate the building lengths and
envelopes .
As I have come to learn in dealing with CGS they do not accept only one engineers opinion .
They required the developer to have another review done . The second review came back, of course,
with a slightly different opinion . CGS still did not like his findings so they required a third engineer to
review the data . Unfortunately, the original two engineers who worked on the project are deceased .
The reviewer for CGS who worked on the proJ' ect is no longer employed with them . The third
engineer took the 200 plus pages of data and came up with even more restrictive building lengths
and envelopes . He based his findings by using the average void that was found . He is still with us
and I met with him to discuss how he came up with his recommendations . The simplest explanation
of how he came up with his findings is he took 5 bores and added the voids listed above and then
averaged them over the 5 bores . He came up with a 1 . 33 average . This is significant because the
voids should have been averaged over the 13 bores giving a 0 . 33, which would have significantly
chan �ed his findings . Now over 50 years later the average void is 4". The recommendations that the
buildings could be only 60 feet in length and foundations only 7 feet in depth were recorded on the
plat .

Due to other factors, the plat was never completed .
Where we are to date : My son and I acquired the unrecorded plat in September of 2016 from Mr. Propp. We then
worked with Michele Martin to get it recorded and start the infrastructure. It was recorded on October 24�h 2016.
In February of 2017 we sold our first lot (4) and the owners began designing their house . I wanted to understand
the GEO Hazard permitting process and emailed CGS. I did not receive a response, so I emailed a second and third time with
still no response . I then began calling them and couldn't get a return phone call from the person assigned to this. I finally got
someone to respond at the main number and they said they would email me the file which he did . Again, unfortunately the
restrictions they recommended were not part of the file .
The owners of lot 4 completed their house design and I submitted it for permit. There was some confusion if I
needed to submit another GEO Hazard permit since one was done at platting but ultimately is was decided I do a separate
one for each lot. The way the house was designed was 98 feet in length induding the garage . I submitted a GEO permit, ihe
County could not get CGS to respond to them either. When the permit became ready it was held up due to lack of CGS
response . I drove to Greeley to see if I could get this moving and again was told they are waiting for a CGS resp onse. Out of
anger and frustration I got back in my truck and drove to Golden . I got into the building and confronted the CGS person
responsible. After a terse conversation I was told they were "not engineers" and I should go see Greg Sherman the third
engineer who worked on this project to help me.
I called Mr. Sherman and set up an appointment . Without telling him what my problem was, I went over with him
how he came up with his recommendations. After explaining his approach, he admitted he was "very, very conservative".
However, it became apparent that he was unwilling to change them which is understandable . I explained I had a building
length problem . I had spent $25, 000 on drawings and the county would not let me build it. He was agreeable to see if he
could help me . He told me he would look at the boring log and get back to me . I had not driven 30 minutes down the road
from the meeting and he called me and said he had good news he could recommend the change based on the log. I asked
him what this would entail, and he quoted me 8 - 10 hours. I said please go ahead . He wrote a three-page letter and attached
numerous pages of existing material not done by him .

prosaic the CGS's opinion that "structures should be located In the Identified building
envelopes (Lungs Peak Estates PI 11, Final Plat PF-5431. and that the Inundation length utu
structure should be limited to 60 feet." However. the CC'S turner opines that "id additional
unsesttyunc drilling i, performed" an intrcase to die 60 foot foundation length is possible.
Western Ens ironment has reviewed your proposed building design tattached) The total
length of the structure is '16 Feet by 62 feet. substantially huger than the current 60 foot CGS
recommendation. As proposed. the two story wood frame and steel floor joist home with
walkout basement. is entirely contained within the primary building envelope approved by the
' '(iS and adopted and recorded by Weld County (see Figure 5). Coincidentally. three borings
asmpleted for the May 2001, E2I investigation. C -I. C-2 and W-2. arc located within 100 to 150
fe.s from the proposed residence.

Using these data. and comparing the boring locations to the Morrison Mine map (Figuic
3). we conclude that support pillar, and fully collapsed workings are located beneath the
proposed home. The presence of unmined coal. likely associated with a haulage way. panicles
additional support. Recent aastssntent of pillar strength (Greg D. Sherman. Mine Subsidence
Assessment. Boulder Weld Coal Field Using British National Coal Hoard Methods. Mountain
Geologist October. 2008) has determined that the coal has the highest unconfined compressive
strength followed by sandstone and clap:tone. The geo,-physical and htluologic logs from borings
• 1 C- I and W•' all shun that claystone exists as both roof and floor rock indicating that the
undcrlytng pillars we stable and that collapse directly below the primer) building envelope
fur Lot 4 h remote.
Based upon these data. it is our opinion that the pmpovat stnx'turr. even though it
exceeds the CGS res:oinmcitdod 60 foot foundation length. is rcawntuhlely protected from mine
subsidence damage as a result of being located above stable support pillars. litnvescr. as a
precaution from potential residtad collapse adjacent to the specific building envelope, we
recommend the installation of a strain isolation trench (Figure 6) completely surrounding all
below grade occupied areas of the structure.
Development of undermined property. in particular shallow undermining. ,s problematic
The shallower the mine and the larger the structure work together it increase the risk of datnatc
due to mine collapse Moreover. no amount of evaluation or direct assessment can remove this
ask It is our opinion that potential damage to the proposed residence can be reduced by
limiting construction to the existing Lot 4 building envelope and incorporating a strain isolation
trench with the design.

same time we built and sold a spec house on lot 1 with a length of 109 feet .
That is the only lot in the plat that had no restrictions on it .
Mr. Sherman then proceeded to bill me for 52 hours at a cost of
$ 3 , 750 . When I of course questioned him , he told me "that was the cost to
get what I wanted ". The fix was in . He recognized all the building envelopes
were too small to fit the type of houses the development was planning
based on the size and price of the lots . He saw an opportunity to make
another $ 20, 000 based on his previous conservative recommendations . I
attempted to resolve the bill by the following email but as of this date it has
gone unanswered .

Greg first of all you appear not to be sorry based on your explanation so I find it to be disingenuous. Let me
re -cap what my take on this situation is. I meet with you for 30 minutes to discuss how you can recommend
that the house my clients have designed can go on the Lot 4 site if you c.ali do it at all. You decide you want to
look at the boring log map to see what the borings look like on and next to that site 30 minutes later as t am
still driving away from the meeting you call me and say good news Of the three borings next to and on the
site. I wu show no mine below and one shows no void. Based on that information you tell me you can change
your previous recommendations that would allow us to build the proposed house on that site.
I askwd the all-important question what will this cost? You quote me on the phone 8 -10 hours. Based on that
information I tell you to proceed and I am willing to pay that.
You produce a three page letter with d couple of attachments and some of the attachments were not new hilt
re gurgitations previously produced material. This includes your recommendation of a totally unnecessary
"isolation trench" which was not your drawing but a CTL Thompson "canned" drawing that my soils engineer
had to re-create in order for him to stamp it.
I again call you and question why we have to do this and you tell me you had to "throw CGS a bone" not that it
is even necessary At no time do you tell me the 8.10 hours turned into 52 or this took longer than expected.
The rest of the 100 plus pages of documentation you attached were all previously produced material
What this appears to me is that you decided that $3794.20 was an amount that I should pay to able to build
the building I had already invested $20,000 into You did not want to bill it as such because that would appear
to be unprofessional so you put 52 hours on a bill you quoted as 8-10 even though when you quoted that you
had all the information that you needed to make this quote
So bottom line is if you want to get paid you either need to revise this bill back to what you quoted me and I
authorized or you need to call me so we can schedule a meeting face to face to resolve this

Before we would close on the lot the prospective buyer and I met
with Weld County planning to see if it was possible to expand the envelope .
Planning wanted some time to review all the information and reconvene .
We did in February, and they said they would support it . We then closed on
the lot . We also talked about a prospective sale on Lot 3 with an envelope
change as well . I explained my problems with CGS and Mr. Sherman and
came away from the meeting with the understanding planning would
� consider envelope changes on a case by case basis and I would not be
required to use Mr. Sherman any further. If the county deemed it needed
more borings, I could then use a different engineer.

Potable water information Include in application how potable water will be provided Provide a will serve

Public Works
This portion of County Road 12 is under the jurisdiction of the City or Town Imunicipahty) of Erie The
municipality has junsdiction over access to the road Please contact the municipality to verity the access
permit or for any additional requirements that may be needed to obtain or upgrade the permit
Modification of the building envelopes will not modify the drainage of the PUD.
The applicants will be required to maintain the historic drainage Flows and run -oft aft ruunib that exist from the
property.
Ii any modifications of the building envelopes impede on the utility easements. a modified utility map may be
required
Due to the existing geologic hazard in the area, this was discussed in depth with the applicant.
For Lot 2' If the applicant chooses to keep the bulking envelope within the area discussed in the meeting
(please sea PUD-mine map overlay) and stays nr it of the mine areas as delineated by the the red lines they
can proceed with the amended PUDE No new geo study is required
For Lot 3: To expand the building envelope to the north, the applicant shall obtain a new geological study with
site -specific bores and proscribed mitigation for that area. If the geologist completing the report decides that
there are not mitigation efforts needed in this area. that needs to be stated in the report. If the geologist
decides that the existing prescribed building specifications (60 foot max footer. or isolation when exceeding
00' 7 lout maximum excavation of native boll) du not apply. that roust be staled iii the report This will require
an amended PUDF and a Geologic Hazard Development Permit
this site IS NOT in a FEMA regulatory floodplain
A Site Plan will be required identifying the following (if applicable).
u Show and label location of existing road, existing road right-of-way, future road right-of-way, and
easements
Show and label location of the access(es) and label with access permit number
Show and label the access turning radii (Residential — 25' Commercial — 80')
Show and label location of drainage related features i.e. detention pencils), ditches. etc. Detention
ponds shall be labeled as "No Build/Storage Area" and include design volume

This is a seven - bedroom home with a length of 109 feet . Since lot 2 is
not in the hazard area the length is not a problem just the envelope .
In May we sold lot 5 and a house was designed with a length of 104
feet . I sent in a layout and site plan into planning four weeks in advance of
bringing in the plans for permit but due to some personnel changes within
the department I did not get a response . After the permit review was
completed four weeks later, I met with Michele Martin and we discussed the
� length and envelope changes I wanted . She released the permit but
' indicated to me that it would be in both of our interests if I submitted all the
envelope changes that I would like on the remaining three geo hazard lots .

E-1 Boring Log
a
a -Test boring E-1 was advanced to a total depth of 105 feet hgs within the north -central
portion of proposed lot 5. This boring was located within an identified closed depression indicative of a
collapse structure. According to the Morrison Mine map. no pillars or haulage ways were located within
75 feet of this site. Loss of circulation and cuttings return occurred at 95 feet bgs. Geophysical logs
identify a large decrease in natural gamma radiation with increased electrical resistivity, both of which
occur in coal beds. at 100 feet hgs, suggesting that remnant coal from the mined zone was present at this
depth. Coal was circulated out of the hole at 87 feet hgs and may have been present immediately above
the mined zone from 92 to 102 feet bgs. Hard drilling was encountered at 105 feet hgs and circulation
return occurred. The hole collapsed from 105 feet to 102 feet depth after removal of the drill strinc
Caliper logs do not identify voids within the mined zone. hut shove a slightly larger borehole diameter

After Michele's departure from the county, Mr. Parko informed me in a September
phone conversation that the department had informed me incorrectly and that I had to go
through the Commissioners which is why I am before you now. Mr. Parko also indicated to
me that the county would also be referring the proposed changes to CGS .
I decided to take a different tack with them this time . I phoned the Director Karen
Berry of CSG requesting a meeting . I did not get a call back, but she did respond to a
subsequent email and we had a meeting on October 13th We explained our problem and
presented our request to expand the length of the homes and modify the envelopes
slightly. We also challenged CGS over the design of the homes . Subsidence is their major
issue with the mines being underneath the lots . In our discussions I asked if the design of
i the foundations of the homes were ever taken into consideration . Since they are not
Iengineers, they were not . I explained that 17 years ago most foundations in the area were
� designed like this drawing with spread footing and walls that sit on them .

I explained to her that the foundations we are building are
designed to handle the soil and subsidence issues . We use 55 to 62
caissons that are drilled to bedrock . Void material is then placed
between the caissons and the foundation walls do not touch the soils .
A steel structural concrete floor is then used and is installed again 2 '
feet above the soils . The basement floor in the same that is used for
the second floor of an office building .

They again say that this map shows indentations that you cannot see with
the naked eye on the ground . I asked if they had any subsequent lidar maps to see
if the topography changed since the one taken in 2013 . They do not have any.
When � uestioned how deep the indentations were , they said they were anywhere
from 6 ' to 1 '. I pointed out to them that lidar is only accurate to 6" and they
acknowledge that but feel this still shows where some of the mine pillars exist that
coincide with the mining map and thus present potential for subsidence .
� I then asked them how Scotts acres to the East, which sits on top of the
same mine , did not have the same restrictions put under it . They claimed that the
mine is deeper there and immediately dismissed me , yet their map shows it the
same depth . I asked them if they looked at that subdivision and they said they had
not . In doing my research for the meeting I found a geo hazard recommendation in
1985 for 9 acres within the Scott 's Acres subdivision .

If the design of a lot deviates from (Plate 2131 the residential structure will be
limited to 42 feet in length.
The conclusions and recommendations presented above agree on several points: 1)
collapse is most likely complete under the majority of the project, 2) potential additional collapse
could produce horizontal surface strains sufficient to damage buildings. 3) chimney collapse
(sinkholes) arc possible above the Morrison Mine. and 4) building envelopes identified in the
Abel and Western reports provide the best protection train damage as a result of mine
subsidence.
He says in his findings of June 13 , 2001 that larger structures are possible following site specific investigations
including drilling . Now 34 years later he looks at the existing drillings and says a larger structure is okay for Lot 4. I could rest
my case right there if I was in front of a jury.
Back to CG5. Again I went through the fact that they are not considering the design of the foundations in their
recommendations we discussed how the length of the building has any bearing on what would happen if the ground settled .
They claim it matters . I strongly disagree as does the engineer who designed the foundations . It is inconceivable to me that a
bui �ding is safe in one location but if you move even a foot past that it is unsafe . This makes no sense to my simp le mind . I
explained this to them and Ms . Carlson , who does the reviews for this project, suggested they send a letter to the county
saying that garages and other out buildings that are not inhabited would not be subject to the envelopes and lengths . She
however was overruled by Ms . Berry. I then asked if she would consider the changes if we identified more areas to do
additional borings. She said she would not. Ms . Berry said I was welcome to submit something from my en� ineer for them to
review but that they would also require a third - party review. At that point we ended the meeting and I decided I would
present my case to you rather than go through two more years of reviews by the CGS and them never accepting any
recommendations except those that line up with theirs . In our discussions their biggest concern was lawsuits . They gave us
an example of when they recommended a building not be built and was done anyway and they were involved in a lawswt

Sec. 23-2-570. - Duties of Department of Planning Services.
A.
The Department of Planning Services shall review the Geologic Hazard Development Permit
application and determine if the application requirements of this Division have been met by the
applicant. If the application is not complete as required. the applicant shall be notified of specific
deficiencies.
B.
The Department of Planning Services shall notify in writing the Colorado Geological Survey of
the proposed development and may also forward copies of the complete application to any other
group or agency whose review and comment are deemed appropriate by the Department of
Planning Services. The group or agency to whom the application is referred shall review the
application to determine compliance of the application with any standards of the group or
agency. The failure of a group or agency to respond within twenty-eight (28) days shall be
deemed to be a favorable response to the Department of Planning Services. The reviews and
comments solicited by the COUNTY are intended to provide the Department of Planning
Services with information related to the proposed GEOLOGIC HAZARD Permit. The COUNTY
may consider all such reviews and comments and may solicit additional information if such

In summary, I submit that the length of the house is of no
consequence based on how the houses are designed and is borne out
by Mr. Sherman 's recommendations on Lot 4 and Scotts Acres . The
same would be true for the other four lots . The minor envelope
changes are minor and still consider the envelopes in that they only
expand them slightly. Lastly look at the aerial photo of Longs Peak
Estates .
