RESOLUTION
RE: APPROVAL OF FINAL PLAT - GEISERT INDUSTRIAL SUBDIVISION.
WHEREAS, on September 27, 1976 the Final Plat for Geisert
Industrial Subdivision was submitted by Richard Geisert to the
Board of County Commissioners for approval in accordance with
the Subdivison Regulations of Weld County, and
WHEREAS, the Board of County Commissioners heard all of
the testimony and statements of those present, and
WHEREAS, the Board of County Commissioners has studied
the request and studied the recommendations of the Weld County
Planning Commission, as submitted, and having been fully in-
formed and satisfied that the submitted Final Plat conforms
in all respects with the requirements of the Weld County Sub-
division Regulations, and that approval of said Final Plat
would be in the best interest of the County, and
WHEREAS, the Board of County Commissioners finds that
the Final Plat conforms in all major respects to the Preliminary
Plat as previously reviewed and approved by the Planning
Commission and the Board of County Commissioners, and
WHEREAS, the Board of County Commissioners further finds
that the applicant has complied with the Final Plat submission
requirements as set forth in the Weld County Subdivison Reg-
ulations, and
WHEREAS, on September 16, 1976, the Weld County Utility
Advisory Board recommended approval of the utility plan for the
Final Plat which approval was a condition precedent to approval
of the Final Plat by the Board of County Commissioners.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the Final Plat
for Geisert Industrial Subdivision located on Part of Lot 6
and Part of Lot 5 of the Southeast Quarter (SE4) of the North-
east Quarter (NE4) of Section 5, and Lot 3 of the Southwest
Quarter (SW4) of the Northwest Quarter (NW4) of Section 4,

County, Colorado, according to the Union Colony Subdivision,
Weld County, Colorado, being more particularly described as follows:
Beginning at the Northwest Corner of said
Lot 3 and considering the North line of

with all bearings contained herein being rel-
ative thereto;

1 . A letter of credit guaranteeing performance by the
developer must be formally accepted by the Board of County
Commissioners prior to recordation of the Final Plat.
2 . The payment in lieu of dedicated lands provided for
by Section 8-15 of the Weld County Subdivision Regulations ,
shall be calculated on a basis of 5% of the subdivision acreage.
The above and foregoing Resolution was, on motion duly
made and seconded, adopted by the following vote on the 4th

Development Standards
1 . Permitted Uses:
All those uses as listed in the Weld County Zoning Regulations,
Sections 3.9 and 3.10 in effect at the date of approval of this P.U.D.
by the Board of County Commissioners. All uses must be consistent
with the City of Greeley Light Industrial Zoning Codes and Require-
ments. The use shall be reviewed for compliance at the time of the
final site plan review.
2. Signs:
Signs must comply with applicable requirements of Weld County Zoning
Resolution. Applicable permits shall be obtained.
3. Access:
Access shall be resticted onto the frontage road as designated on the
plat as follows:
(a) One access for lot 1 onto the frontage road;
(b) One access for East 4th Street Road as shown hereon.
Driveway permits from the State Department of Highways shall be obtained
for each of the above accesses onto the frontage road.
Lots 2 through 9 shall be limited to access on East 4th Street Road;
access for these lots shall not be permitted from the frontage road.
More that one access per lot for lots 2 through 9 onto East 4th
Street Road may be allowed subject to approval in the final site plan
review.

4. Parking:
All parking will be on site, furnsihed by the individual lot owners.
Such parking facilities must comply with the Weld County Zoning Reso-
lution requirements and applicable requirements of the City of Greeley
which may be in force at the time of construction upon the site.
5. Interim Land Use:
Until such time as a lot is sold said lot shall not be used for other
than its present use. The owner shall be responsible for maintaining
the premises so as to eliminate weed growth in excess of 12 inches
in height.
6. Landscaping:
(a) No more than 85% of the area of any lot shall be covered by
buildings, asphalt, or gravel .
(b) A minimum of 15% of each lot shall be maintained as landscaped
area.
(c) A minimum of 10' adjacent to the public right of way shall be
landscaped.
7. Drainage:
Each individual lot owner will be responsible for surface water runoff.
A drainage study will be submitted and subject to approval in the final
site plan review prior to issuance of building permits for each lot.
No runoff will be allowed beyond limits as illustrated on the final plat.

9. Sewage Disposal :
Individual on-lot disposal systems whall be allowed on each lot
subject to County and State Health Regulations. The proposed dis-
posal systems shall be reviewed for compliance and approval at the
time of final site plan review. Upon availability of City of Greeley
sewer service to the subject property, known as Geisert Industrial
P.U.D. , the owner or owners of the lots shall be required to connect
onto the City sewer system and be responsible for extending the sewer
lines to the outer boundaries of the property known as Geisert In-
dustrial P.U.D. upon request by the City of Greeley. All construction
of sewer lines shall meet the specifications and requirements of the
City of Greeley. If City of Greeley sewer service is abailable adjacent
to the Geisert Industrial P.U.D. property at the time when a lot
owner submits a final site plan for review, then it shall be required
that the lot owner connect onto the City sewer system at that time
and an individual on-lot sewage disposal system shall not be allowed.
10. Lot Standards:
(a) 30 foot front setback
(b) 20 foot rear setback
(c) 60 foot maximum height

12. Building Standards:
All structures shall be constructed such that the lowest floor
to be occupied will be at an elevation known to be above the 100
year flood elevation; said elevations to be noted on the Final
Plat prior to recordation. Construction details to be reviewed
for compliance at the time of fianl site plan review.
13. Site Plan Review:
Prior to the issueance of any building permits for any individual lot
of the Geisert Industrial P.U:D. , a final site plan shall be re-
viewed by the Weld County Planning Commission for a recommendation
and the Board of County Commissioners for their approval . Any
change of use on a lot which has been approved in a final site plan
review shall be subject to review again for the new use. The final
site plan review shall include the following:
(a) Identification in detail of the proposed use;
(b) The number, type, and frequency of traffic of traffic generated;
(c) The number of employees;
(d) A drainage study for the lot;
(e) Indication of the number and location of the proposed accesses
and the internal traffic flow pattern;
(f) Information on measures to be utilized to prevent construction
below the 100 year floodplain level ;
(g) Indication of landscaping proposed;
(h) Information on what provisions shall be made for fire protection;
(i ) Indication of the water requirements and the proposed water system;
(j) Indication of the sewage requirements and details on the proposed
system;

(k) Identification of the number of parking spaces to be provided;
(1 ) Submittal of front, side and back elevations for the proposed
structure.
This required information shall be submitted in a combination of written
map form utilizing the Weld County P.U.D. guidelines.
14. All utilities shall be installed underground within the subject
property.

. Dear Mr. Neuschwanger:
Pursuant to Weld County Subdivision Regulations Section
6-2 (J) and Section 11 , we are in receipt of the Letter of
Credit hereinabove mentioned. Said Letter of Credit is in
relation to the Geisert Industrial Subdivision located in
part of Sections 5 and 4 , Township 5 North, Range 65 West,
Weld County, Colorado.
As stated in the Subdivision Regulations, a guarantee
• must be made to Weld County that the required improvements
will be made. In subject subdivision, improvements include
road construction, engineering fees for same, fire hydrants,
water mains, etc. Your clients have elected to submit the
Letter of Credit as their guarantee.
At the time of completion of the above improvements, a
release of the Letter of Credit will be made. However, if
there is noncompliance as evidenced by failure to complete
the improvements, a draft or drafts on said Letter of Credit
will be made for the purpose of hiring a contractor to complete
the necessary work.

SECTION 11 IMPROVEMENTS AGREEMENT
11 - 1 Contract
No Final Plat shall he approved by the Board until the
subdivider has submitted a Subdivision Improvement Agree-
ment or a contract approved by the Board agreeing to con-
struct the required improvements as shown in plans , plats
and supporting documents .
11 -2 Improvements Guarantee
Suitable collateral , in an amount stipulated in the sub-
division improvement agreement , shall accompany thE rinal
Plat submission to ensure the completion of the improve-
ments according to design and time specifications . If
the improvements are not constructed in accordance with
all of the specifications , the Board shall notify the
subdividers of the noncompliance and discuss with the
subdividers the reasons for the noncompliance and pro-
pose . schedules for correcting the noncompliance . If the
Board determines that the subdividers will not construct
any or all of the improvements in accordance with all of
the specifications , the Board shall have the power to
withdraw and employ from the deposit of collateral such
funds as may be necessary to construct the improvement
or improvements in accordance witt the specifications .
11 -3 Release of Guarantee
From time to time as the required improvements in a sub-
division are completed , the subdivider may apply in writ-
ing to the Board for a partial or full release of the
bond , credit deposit letter , certified check , or other
collateral . Upon receipt of such application in writing ,
the Board or its agent shall inspect that portion of the
improvement which has been completed . If the Board deter-
mines from such inspection that the improvements thus far
completed have been made in accordance with the Final Plat
and the requirements of these regulations , a portion of
the bond , credit deposit letter , certified check , or other
r collateral sufficient to cover the cost of the improve-
ments thus far completed shall be released .

SUBDIVISION AGREEMENT
THIS AGREEMENT, made and entered into this 19th day of
January, 1972 by and between the County of Weld, Colorado, hereinafter
called "County", and Richard H. and Francis Geisert
hereinafter called "Subdivider".
WITNESSETH:
WHEREAS, Subdivider is the owner of the following described
property in the County of Weld, Colorado:

WHEREAS, a final plat of said property, known as
Geisert Industrial P.U.D.
has been submitted to the County for approval; and
WHEREAS, it is provided by resolution of the Board of County
Commissioners, County of Weld, that no final plat shall be approved
unless the subdivider shall have entered into a written agreement with
the County to install certain improvements;
NOW, THEREFORE, in co:rideration of the foregoing and the
acceptance and approval of said final plat, the parties hereto promise,
covenant, and agree as follows:
1. Engineering Services: Subdivider shall furnish, at its own
expense all enginerring services in connection with the design and
construction of the subdivision improvements described and detailed
on Exhibit "A", attached hereto and made a part hereof.
1. 1 Said engineering services shall be performed by a
Registered Professional Engineer and Land Surveyor in
the State of Colorado and shall conform to the standards
and criteria for public works as established by the County.
1. 2 Said engineering services shall consist of, but not
be limited to, surveys, designs, plans and profiles,
estimates, construction supervision, and furnishing
necessary material to the County.
1. 3 Subdivider shall furnish drawings and estimates to
the County for approval prior to the letting of any con-
struction contract. Before acceptance of the installed
improvements, Subdivider shall furnish one set of repro-
ducible "as-built" drawings and a final statement of
construction cost.to the County.

Gentlemen:
We hereby open our Irrevocable Letter of Credit in your favor in
the amount of Forty-two Thousand Dollars and NO/100 Cents $42,000.00
available by drafts at sight and subject to the following terms and conditions:
1. Drafts. All drafts must be drawn on Cache National Bank of
Greeley, must be negotiated or presented to Cache National Bank of Greeley
on or before September 30, 1977, and must bear the reference: "DRAWN ON
CACHE NATIONAL BANK OF GREELEY LETTER OF CREDIT NO. 142, DATED OCTOBER 1,
1976.
2. Notation. This is a notation letter of credit. Each draft
must be accompanied by this Letter of Credit for endorsement by Cache National
Bank of Greeley of the amount and date of each draft and the balance remaining.
This letter of Credit must be surrendered to Cache National Bank of Greeley
when exhausted.
3. Purpose. This Letter of Credit is issued for the account of
RICHARD H. GEISERT and FRANCIS M. GEISERT. Disbursements will be made under
this Letter of Credit to pay for:
water, sewer, road construction, engineering fees and etc.
This Letter of Credit relates to the following described real property:
Lot Five (5) and the South 2/3 of Lot Six (6) of the Southeast Quarter (SE}) of
the Northeast Quarter (NE}) of Section 5 and Lot Three (3) of the Southwest
Quarter (SW1) of the Northwest Quarter (NW}) of Section 4 all in Township 5 North,
Range 65 West of the 6th P. M. , according to the Union Colony Subdivision, lying
East of the U. S. By-pass, Weld County, Colorado.
4. Documents. All drafts must be accompanied by the following
documents:
Vouchers for water, sewer, road construction, engineering fees and etc.
5. Other Terms and Conditions. This Letter of Credit shall not be
transferable. It shall be governed by the laws of the State of Colorado,
including the Uniform Commercial Code as in effect in that State. This Letter
of Credit is NOT subject to the Uniform Customs and Practice for Documentary
Credits.
6. Obligation of Issuer. Cache National Bank of Greeley agrees with
the drawers, endorsers, and good faith holders of drafts drawn under and in
compliance with the terms and conditions of this Letter of Credit that Cache
National Bank of Greeley will duly honor such drafts upon presentation to
this office.
