Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Chris Gathman Public Works Engineer representative, Mike McRoberts Health Department representative, Lauren Light The following business was transacted: E I hereby certify that pursuant to a notice dated April 4, 2019, and duly published April 10, 2019, in the Greeley Tribune, a public hearing was conducted on May 22, 2019, to consider the request of Leeward Renewable Energy Development, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0014, for a 1041 Major Facility of a Public Utility (a wind energy facility for up to 380 megawatts (MW), along with one (1) 230 kilovolt (kV) transmission line approximately eleven (11) miles in length and one (1) 115 kV transmission line approximately fifteen (15) miles in length, two (2) electrical substations, two (2) temporary laydown yards and two (2) concrete batch plants along with up to seven (7) temporary construction trailers to be utilized during the construction of the facilities and six (6) meteorological towers) in the A (Agricultural) Zone District, at which time the matter was continued to June 10, 2019, to allow adequate time for proper notice and public testimony. Bob Choate, Assistant County Attorney, made this a matter of record. John Wycherley, Renewable Energy, represented the applicant and, in response to Chair Kirkmeyer, stated he had no questions or concerns with the Conditions of Approval (COA) or Development Standards (DS). In response to Chair Kirkmeyer, Chris Gathman, Department of Planning Services, explained the necessary changes that need to be made to the COA or DS. Ce:PLlct; lrP1 , Phi(wiwO �F�ILcJ Ot4 I I ID 12oi 2019-1880 PL2672 HEARING CERTIFICATION - LEEWARD RENEWABLE ENERGY DEVELOPMENT, LLC (USR19-0014) PAGE 2 la No public testimony was offered concerning this matter. a Mr. Gathman explained COA #1 (vicinity map) and requested to add COA #3.1 (detail map), a new COA #2.L (Decommissioning Plan), COA #3 (Prior to the release of Building Permits) and COA #3.A (setback standards), and the Board agreed. Per the request of the Department of Public Works, and Mr. Choate, the Board further refined the language for COA #3. Mr. Choate noted in DS #7 the word °acquire" should be "require". Chair Kirkmeyer suggested adding screening language to DS #20 (portable toilets), adding a new DS #9 (Decommissioning Plan), and in response to Chair Kirkmeyer, Mr. Gathman clarified the reasoning for DS #27 (survey to minimize and/or avoid impacts to cultural resources). IR No public testimony was offered with regard to changes to the Conditions of Approval and Development Standards. B In response to Chair Kirkmeyer, Mr. Wycherley indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. Commissioner Conway moved to approve the request of Leeward Renewable Energy Development, LLC, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0014, for a 1041 Major Facility of a Public Utility (a wind energy facility for up to 380 megawatts (MW), along with one (1) 230 kilovolt (kV) transmission line approximately eleven (11) miles in length and one (1) 115 kV transmission line approximately fifteen (15) miles in length, two (2) electrical substations, two (2) temporary laydown yards and two (2) concrete batch plants along with up to seven (7) temporary construction trailers to be utilized during the construction of the facilities and six (6) meteorological towers) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Freeman, and it carried unanimously.
