RESOLUTION RE: APPROVAL OF REPLAT OF LOTS 2 , 31, 32 , TO THE FIRST ADDITION TO HILLTOP SUBDIVISION IN WELD COUNTY, COLORADO, A SUB- DIVISION BEING A PART OF THE EAST HALF OF THE NORTHEAST QUARTER OF SECTION 10 IN TOWNSHIP 5 NORTH OF RANGE 66 WEST OF THE 6TH P.M. IN WELD COUNTY, COLROADO. WHEREAS, on the 24th day of January, 1977, a public hearing was held before the Board of County Commissioners of Weld County, Colorado, upon the application of Claud R. Evans, on his application for a replat of the above described Lots 2 , 31, and 32 all being in the first addition to the Hilltop Sub- division, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, and WHEREAS, the Board of County Commissioners has studied the request and studied the recommendations of the Weld County Planning Commission, as submitted, and having been fully in- formed and satisfied that the submitted application for a re- plat of the aforementioned Lots 2 , 31, and 32 , conforms in all respects with the requirements of the Weld County Subdivision Regulations, and that the approval of said replat of said Lots 2 , 31, and 32 to the first addition to Hilltop Subdivision would be in the best interest of Weld County. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the replat of Lots 2 , 31, and 32 to the first addition of Hilltop Subdivision of Weld County, Colorado, being a subdivision located in the East Half of the Northeast Quarter of Section 10 in Township 5 North of Range 66 West of the 6th P.M. in Weld County, Colorado, be and hereby is approved. The Weld County Board of Adjustment on 12-23-76 granted Mr. Evans a request for a variance to permit the reduction of the lot size of Motion seconded by Percy Hiatt Vote : For Passage Bette Kountz Against Passage Percy Hiatt Chuck Carlson John Weigand Marge Yost The Chairman declared the motion passed and ordered that a certified copy of this Resolution be forwarded with the file of this case to the Board ofCounty Commissioners for further proceedings . • ~ - . • Claud Evans S-127 : 76 : 13 January 13, 1977 Lot 2 to be 1450 square feet less than the required minimum lot area of 13,000 square feet in the Estate District. 6. It is the opinion of the Planning Commission that this re- plat will not adversely affect the character of the plat filed and recorded. 7. The Weld County Utilities Coordinating Advisory Committee on 1-6-77 recommended for approval of this replat indicating they could not identify any problems with the request to change a lot line and drop the designation of ingress/egress on one utility easement. 8. Several residents of the surrounding properties have signed a petition form in support of this replat request . Commissioners Services Building Greeley, Colo. 80631 Gentlemen: I am filing an application for the re-plat of Lots 32, 31 and 2 of the First Addition to Hilltop Subdivision, Weld Co . , Colorado for the following purposes: 1 . I have a purchase agreement on Lots 32 and 2 and for me to build a house on Lot 32 I need to set 27. 99 ft. of the West end of Lot 2 with Lot 32 to give me sufficient set-back from the cul-de-sac of 10th Street Road and the present East Lot line of No . 32. This distance is now 50 feet. It is desirable to place the house on the South end of Lot 32 to position it out from behind a large dwelling on adjacent Lot 33 to provide a better view, to get further away from Highway No. 34 noise and to avoid a possible conflict with additional set-back requirements as to Lot No . 1 . The Weld Co. Board of Adjustment has granted the reduction of Lot No. 2 from the required 13 ,000 sq. ft. to 11 ,550 sq. ft. as would be created by the change of 27.99 feet into Lot No . 32. This area is less than the required lot area in the Estate District by only 1 ,450 sq. ft. Because the property is serviced by municipal water and sewer there is no necessity for a large area for well and septic disposal requirements.
