RE: REGULATING, WARNING AND GUIDING TRAFFIC DURING THE TEMPORARY
CLOSURE OF COUNTY ROAD 53 BETWEEN COUNTY ROAD 60.5 AND
U.S. HIGHWAY 34 FOR APPROXIMATELY THIRTY-FIVE (35) DAYS, FOR COUNTY
ROAD 53 BRIDGE REPLACEMENT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, pursuant to C.R.S. §42-4-106(6)(a):
"...local authorities, with their respective jurisdiction may, for the
purpose of road construction and maintenance, temporarily close to
through traffic or to all vehicular traffic any highway or portion
thereof for a period not to exceed a specified number of work days
for project completion and shall, in conjunction with any such road
closure establish appropriate detours or provide for an alternative
routing of the traffic affected...", and
WHEREAS, the Board, pursuant to said statute and upon the basis of traffic and personal
investigations, has determined that conditions exist which make it necessary to temporarily close
said County Roads to through traffic and to regulate, warn and guide vehicular traffic by posting
signs thereon.
NOW, THEREFORE, BE IT RESOLVED that the Board of County Commissioners of Weld
County, Colorado, deems it necessary to regulate, warn and guide vehicular traffic on County
roads and any intersections thereof, and it hereby authorizes and orders the posting of such traffic
control devices as shall be reasonably necessary to regulate, warn and/or guide traffic thereon
for the safety of the general public and that said traffic control devices shall conform to the Federal
Manual on Uniform Traffic Control Devices.
BE IT FURTHER RESOLVED that the Board of County Commissioners of Weld County,
Colorado, does declare and establish that County Road 53, between County Road 60.5 and U.S.
Highway 34, be temporarily closed, with said closure being effective March 25, 2019, for
approximately thirty-five (35) days for County Road 53 Bridge Replacement, and further, that
standard official traffic control devices shall be erected at said closure giving notice of the
restrictions.

SUBJECT: BOCC Agenda Item
CR 53 between US 34 and CR 60.5 is scheduled to be closed to thru traffic from 3/25/2019 to
4/29/2019 for a bridge replacement. The pass around indicated closure dates from 3/18/19 to
4/22/19. However, towards the end of last week, the contractor notified Weld County project
management staff that the cold weather had prevented them from working last week and had
caused the schedule to slip by a week. The contractor has assured us that they cannot let the
closure slip again without impacting their completion date which is not an option.
The contractor is supposed to attend the hearing to answer any questions the BOCC may have
regarding the change in closure dates.

Brief description of the problem/issue:
This pass around is meant as an informational update. During the design of the CR 53 bridge replacement, the BOCC approved a
shutdown of CR 53 not to exceed 2 months. During the design process, it was determined that the time needed for a shutdown could
be shortened to 35 days. As a result, the contract was approved with a 35 -day shutdown for construction of the tie-ins to the old road.
The contractor has notified Weld County that the 35 -day shutdown period will start on March l8'' and will end on April 22"d. Work
to be completed during this timeframe includes the completion of embankment for the bridge abutments (toe of the new abutments
extends into the existing roadway), the tie-in of the new roadway to the old roadway, demolition of the existing bridge, placement of
the waterproofing membrane and asphalt paving on the new bridge, completion of a new box culvert, and final striping and signage.
Liquidated damages in the amount of $5,800/day will be assessed to the contract in the event they do not open the roadway by the end
of the work day on April 22, 2019.
The fire department and school district are aware of the upcoming closure. 2 weeks prior to the closure, the fire department, sheriff's
department, school district, and OEM will be contacted personally to remind them of the closure dates. A copy of the detour routes
will be provided to them. Public Works will also work with the Public Information Office to get the closure posted to social media.
Variable message boards will be placed on Hwy 34 and CR 60.5 notifying the public of the closure. The detour route will be to use
Hwy 34 or CR 60.5 to either CR 61 or the Parkway (depending on direction of travel).
What options exist for the Board? (include consequences, impacts, costs, etc. of options):
• Breach of contract by the County since current contract allows for a 35 -day closure.
• It will also result in a change order in which the contractor is likely to request a substantial amount of money and time to
finish the project.
• Any amount of time extension will put the CDOT flood recovery grant funding in jeopardy because CDOT and FHWA have
set a project closure date which would not then be met.
Recommendation:
To avoid a costly change order, time extension, and issues with the CDOT/FHWA grant, it is recommended that the BOCC approve
the 35 -day closure period as previously agreed upon. If this pass around is approved by the BOCC, the road closure will appear on the
BOCC agenda on either February 25, 2019 or March 4, 2019.
