Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS GENERAL PROJECT INFORMATION/LOCATION Project description: A Site Specific Development Plan and Use by Special Review Permit for a Use Permitted as a Use by Right, an Accessory Use, or a Use by Special Review in the Commercial or Industrial Zone Districts (commercial CDL driving school) provided that the property is not a lot in an approved or recorded subdivision plat or lots part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. This project is south of CR 12 (Grand View Blvd) and is west of and adjacent to CR 13. Parcel number 146712100031 & 146712100032. Access is from CR 13. ACCESS Weld County Public Works has reviewed the application materials related to access. In this location, the west ROW of County Road 13 has been annexed by the City of Dacono. Contact the City of Dacono to determine their access requirements. ROADS AND RIGHTS -OF -WAY County Road 13 is under the jurisdiction of the City of Dacono. The municipality has jurisdiction over access to the road. Please contact the municipality to verify the right-of-way requirements, access permit or for any additional requirements that may be needed to obtain or upgrade the permit. The existing and future (140') right-of-way shall be shown on the USR map. TRAFFIC The traffic information submitted with the application materials indicated that there will be approximately 56 passenger vehicle weekly roundtrips, 15 semi -truck weekly round trips. half of the traffic will be going to the north and half of the traffic will be going to the south on County Road 13. DRAINAGE REQUIREMENTS This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas. Detention pond waived and a simple drainage narrative: The applicant has submitted a drainage narrative stating that the site meets drainage exception 23-12- 30.F.1.a.13 for a parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in size being allowed a onetime exception for a new 1,000 square foot building or equivalent imperviousness (2250 square feet of recycled asphalt pavement or gravel material) and 23-12-30.F.1.a.14 for a parcel greater than 5 gross acres in size being allowed a onetime exception for a new 2,000 square foot building or equivalent imperviousness (4500 square feet of recycled asphalt pavement or gravel material). Some recycled asphalt pavement has been added to areas of the property but the applicant has indicated that this is less than 2250 square feet for the smaller parcel and 4500 square feet for the larger parcel. Historic Flows: The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from the property. GRADING PERMIT A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant, Public Works and Planning Department have reviewed the referral and surrounding property owner comments. The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Public Works for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575. CONDITIONS OF APPROVAL A. The plan shall be amended to delineate the following: 1. County Road 13 is a gravel road and is designated on the Weld County Functional Classification Map as an arterial road which requires 140 feet of right-of-way at full buildout. The applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with the documents creating the existing right-of-way) and the physical location of the road. All setbacks shall be measured from the edge of right-of-way. (Department of Public Works) 2. The western half of County Road 13 is under the jurisdiction of the City of Dacono. Please contact the municipality to verify the right-of-way on their half. Show and label the right-of-way. Show the approved access(es) on the site plan and label with the approved access permit number if applicable. (Department of Public Works) 3. Central Weld Water District provides water and an onsite wastewater treatment system (OWTS) permitted for 2 bedrooms (G19840173) provides sewer to the existing residence. An engineer's letter dated March 26, 2019 was provided which indicates the OWTS is adequately sized for 10 visitors every other Monday and up to 4 full time office employees. The application indicates no washing of vehicles, maintenance or fuel storage will occur on site. Noise will be restricted to the Residential level. We recommend that the following requirements be incorporated into the permit as development standards: 1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for final disposal in a manner that protects against surface and groundwater contamination. 2. No permanent disposal of wastes shall be permitted at this site. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust, fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The facility shall operate in accordance with Chapter 14, Article 1 of the Weld County Code. 4. Fugitive dust should attempt to be confined on the property. Uses on the property should comply with the Colorado Air Quality Commission's air quality regulations. 5. In the event the system is found to be inadequate, the system must be brought into compliance with current Weld County On -site Wastewater Treatment System Regulations. 8. A permanent, adequate water supply shall be provided for drinking and sanitary purposes. 9. The operation shall comply with all applicable rules and regulations of State and Federal agencies and the Weld County Code. MEMORANDUM To: Angela Snyder, Planner April 4, 2019 From: Bethany Pascoe, Zoning Compliance Officer Subject: USR19-0028 Referral Upon review of my case files and computer, an active Zoning Violation (ZCV19-00009) was noted. This violation was initiated due to the operation of a truck driving school without the required land use permits. This case has NOT been forwarded to the County Attorney's Office; therefore, an investigation fee is not required. Due to records release laws, staff no longer tracks complainant information, but please be aware it is staff's policy to no longer accept staff -initiated complaints. Approval of this application by the Board of County Commissioners would correct the remaining violations. If this application is denied, staff asks that this case be forwarded to the County Attorney's Office for legal action, but to delay legal action for 30 days to all them time to remove the commercial truck driving school, associated commercial storage and potentially the single wide mobile home that has been converted into an office. The City of Dacono supports the Planning and Zoning recommendation for denial of USR 19-0028. We appreciate the Planning and Zoning Commission's responsiveness to the concerns of the City and adjacent property owners in their deliberation of this application. We respectfully request the Weld County Board of Commissioners deny case number USR 19-0028. Our most compelling reasons are: 1. County Code Section 23-2-220.A.4 -- The uses which will be permitted will be compatible with future development of the surrounding area as permitted by the existing zoning and with the future development as projected by Chapter 22 of the Weld County Code and any other applicable code provisions or ordinances in effect, or the adopted Master Plans of affected municipalities. The proposed use is incompatible with the adopted Comprehensive Plan. The 2017 City of Dacono Comprehensive Plan designates this area as the Multi -Generational Living District. This District is intended to support neighborhoods that accommodate a wide range of age groups and product types, allowing younger residents to stay in the community and older residents to "age in place." Homes of varying sizes and densities will be co -located so that extended families can live independently, yet in the same neighborhood community. Supporting uses may include small commercial spaces with local serving retailers and service providers; and / or accessory units to primary residences, support entrepreneurial employment endeavors and encore careers or dwelling units for related family members. Industrial uses, such as CDL driving schools and testing facility locations, do not support the long-term growth and development as a residential area. 2. County Code Section 23-2-220.A.3 -- The uses which will be permitted will not be compatible with the existing surrounding land uses. The character of the area proposed for the CDL school is not suitable for the CDL driving school use and is not compatible with surrounding zoning districts and current land uses. To the south of the proposed site, adjacent land is zoned PUD and approved for residential use. While there are currently oil and gas facilities under construction, the zoning remains PUD. To the west of the site land is zoned R-2 Residential. Furthermore, the City of Dacono has two approved Annexation Agreements with the property owners to the east (Parcel: 146907100005 and Parcel: 146907400008). In both Annexation Agreements future zoning upon annexation is R-2 Residential. Finally, the adjacent homes located within unincorporated Weld County are currently occupied for residential purposes. 3. County Code Section 23-2-220.A.3 -- The uses which will be permitted will not be compatible with the existing surrounding land uses. The Land Use Application Summary Sheet dated July 16, 2019, indicates that the CDL school includes two full-time and three part-time employees and also referenced a visual observation of eight (8) commercial vehicles. The number of commercial vehicles on site and number of employees further demonstrates that the CDL school is a significant trucking operation that is not appropriate for this residential location. Furthermore, the rear of the site includes a CDL skills lot and testing pad that comes within one - hundred feet of three neighboring residences. The location is just not being used for classroom purposes, but also onsite practice driving and testing. 4. Based upon the number of trucks and employees, there are additional concerns about the commercial vehicle traffic on Colorado Boulevard and the appropriateness of the existing access width and surface to Colorado Boulevard. The City of Dacono, which owns and maintains the right-of-way, did not grant industrial access to Colorado Boulevard for this type of an operation. 5. County Code Section 23-2-220.A.5 -- The application does not comply with Chapter 23, Articles V and XI, of the Weld County Code. The City of Dacono previously requested annexation as the USR application is not only within the municipal urban growth area but adjacent to land currently within the municipal limits of the City. We strongly believe that the conversion of agricultural land to industrial uses should be consistent with the with the long-term growth and development of the community as detailed in the adopted Comprehensive Plan for the City of Dacono. For the reasons stated above, the City of Dacono requests the Weld County Commission deny USR 19- 0028. Thank you for consideration of our concerns regarding this application.
