A (AGRICULTURAL) ZONE DISTRICT - ROCKY MOUNTAIN MIDSTREAM, LLC
A public hearing was conducted on January 23, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated November 16, 2019, and duly published
November 21, 2019, in the Greeley Tribune, a public hearing was conducted to consider the
request of Rocky Mountain Midstream, LLC, for a Site Specific Development Plan and Use by
Special Review Permit, USR18-0093, for a greater than 12 -inch pipeline (24 -inch high pressure
natural gas pipeline) approximately 9.25 miles in length in the A (Agricultural) Zone District. Frank
Haug, Assistant County Attorney, made this a matter of record.
Kim Ogle, Department of Planning Services, presented a brief summary of the proposal and
stated Rocky Mountain Midstream, subsidiary of Williams Companies, LLC, is proposing a natural
gas pipeline to connect the Fort Lupton Gas Processing Plant with the Keenesberg Gas Plant. He
described the benefits of pipeline, the pre and post construction easement dimensions, and above
ground equipment. He stated the total land impacted will be 91 acres, and the permitted
right-of-way (ROW) is 55 acres. Mr. Ogle explained the pipeline is within the three (3) mile referral
areas of the Town of Keenesberg and Adams County. He reviewed the referral from Colorado
Parks and Wildlife (CPAW), who had concerns about wildlife and the landscape in the area and
gave procedural recommendations to address those concerns. He described the
History Colorado Office of Archeology and Historic Preservation response which said there are
three (3) recorded sites within the proposed project area. Mr. Ogle stated the pipeline will cross
under the Public Service of Colorado easement, and explained the safety of the pipeline,
emergency procedures, pipeline maintenance, and pipeline construction standards. Mr. Ogle
noted referrals were sent to 15 agencies and six (6) agencies responded with comments, and
further explained the Department of Planning Services received no letters or correspondence
regarding the application. He displayed images of the site and surrounding views and entered the

favorable recommendation of the Planning Commission into the record as written. In response to
Chair Kirkmeyer, he stated 100% of the easements are in place.
El Evan Pinkham, Public Works Engineer representative, provided a brief overview of the
transportation plans and requirements, and stated the pipeline crosses several
County roads (CR), State Highway 52, and Interstate 76. He explained a ROW permit will be
required for crossing under Weld County ROWs, pipelines are exempted from the requirements
of a drainage report and detention pond design, and there is a Road Maintenance Agreement
required which is included in the Conditions of Approval (COA).
la Lauren Light, Department of Public Health and Environment, stated portable toilets can be
used along the construction route, an Air Emissions Permit will be required if they disturb more
than 25 acres, and Development Standards (DS) #15-#21 address Environmental Health (EH)
items.
la Matt Norton, Williams Companies, LLC, represented the applicant and provided a summary
of his PowerPoint presentation. He gave a company overview, displayed the pipeline route on a
map, and discussed the safety culture of the company, including no violations. He explained
pipeline design, construction, and location, and talked about environmental stewardship, including
restoration and maintenance of the pipeline.
Oa No public testimony was offered concerning this matter.
El In response to Chair Kirkmeyer, Mr. Norton stated he had no concerns with the COA and
DS, and confirmed almost all crossing agreements are in place, with the exception of a few ditch
companies. In response to Commissioner Conway, Mr. Norton indicated he did not know which
ditch companies they are still working with, but noted they are in good faith negotiations, and he
does not anticipate a problem getting those crossing agreements finalized.
In response to Chair Kirkmeyer, Mr. Norton indicated he reviewed, and agrees to abide by,
the Conditions of Approval and Development Standards, as presented.
El Commissioner Conway moved to approve the request of Rocky Mountain Midstream, LLC,
for a Site Specific Development Plan and Use by Special Review Permit, USR18-0093, for a
greater than 12 -inch pipeline (24 -inch high pressure natural gas pipeline) approximately 9.25
miles in length in the A (Agricultural) Zone District, based on the recommendations of Planning
staff and the Planning Commission, with the Conditions of Approval and Development Standards
as entered into the record. The motion was seconded by Commissioner Moreno, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:25 a.m.
