HomeMy WebLinkAbout20194858.tiffRESOLUTION RE: APPROVE ISSUANCE OF BUILDING PERMIT ON AN ILLEGAL PARCEL OF LAND - RONALD WALTER WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Ronald Walter has applied for a Building Permit on a parcel of land which has been divided in an illegal manner, said parcel being located on the following described real estate: Part of the E1/2 SW1/4, Section 21, Township 4 North, Range 67 West of the 6th P.M., Weld County, Colorado WHEREAS, Section 24-10-30.C of the Weld County Code provides standards for review of said request for a Building Permit on land divided in an illegal manner, and WHEREAS, the Board of County Commissioners heard all of the testimony and statements of those present, studied the request of the applicant and the recommendation of the Weld County Department of Planning Services and all of the exhibits and evidence presented in this matter and, having been fully informed, finds that this request shall be approved for the following reasons: 1. The parcel shall be accessible from an existing public road. The Department of Planning Services sent the existing access permit to the Department of Public Works for review and comment in an email dated October 24, 2019. The Department of Public Works provided a response stating no concerns and that there is an approved access under AP19-00291. 2. The parcel will have access to an adequate water supply. The applicant provided a copy of a water bill that demonstrates that water is available to the site. The property can be served by the Little Thompson Water District; however, the County will require that the owner provide a will -serve letter from the District prior to issuance a building permit. 3. The parcel will have access to an adequate means for the disposal of sewage. The applicant has applied for a septic system under SP16-00131 which can serve a three -bedroom home. The septic permit will need to be reissued. 4. The issuance of the building permit will not change the essential character of the neighborhood. The procedure defined in this Section is not being utilized for the purpose of evading the requirements and intent of this Chapter. This section of the Code is not being used for the purpose of evading the requirements and intent of this Chapter. The applicant was unaware of the full development plans when the property was annexed. There was an additional 14.45 acres that was annexed under the Willow Creek Annexation that Mr. Walter conveyed (Parcel No. 105921300001) in order to make the deal with Johnstown work. He didn't realize that conveying this portion of land created a legal but non -buildable lot. 6. The owner does not own a parcel of land adjacent to the subject parcel. The applicant does not own property adjacent to the parcel in question; however, he does retain mineral interests in a nearby parcel but that does not disqualify him under the described criteria. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the application of Ronald Walter for a building permit on a parcel of land which has been divided in an illegal manner, said parcel of land being described above be, and hereby is, granted. PARCEL NUMBER: 105921300002 PARCEL SIZE: 65.4 +1- Acres ZONE DISTRICT: A (Agricultural) NARRATIVE: The attached materials are related to a request from Mr. Walter to obtain a building permit on a parcel of land subdivided in an illegal manner. The parcel of land on which this request is being made is described as part of the East half of the Southwest quarter; Section 21, Township 4North, Range 67 West. The property is located east near CR 17 and North of CR 42. Mr. Walter emailed the County on October 16, 2019 requesting relief and an opportunity to go before the Board of County Commissioners. Copy of the email is attached. Below is a timeline of events and the criteria the Board must consider in this matter. Background Information: December 20, 2004: Willow Creek West Annexation (Town of Johnstown) January 2, 2006: Mr. Walter's conveys Parcel No.105921300030 to WEDCO, LLC 2019-4858 Walter Building Permit Page 1 of 3 PL0073 July 1, 2015: April 22, 2019: July 30, 2019: Mr. Walter's conveys via warranty deed a property described under Parcel No. 105921300001 to WEDCO, LLC. Mr. Walter applied for a building permit under RSN19-0068 and was informed that the property was a legal parcel, but non - buildable. Mr. Walter was advised of his options. Option No.1 was to annex the balance of the property into Johnstown. Mr. Walter did not want to pursue this option because the town will not provide services like water and sewer. Option No.2 was to utilize an obscure section of the County Code that allows the County Commissioners to issue a building permit on a parcel of land that was subdivided in an illegal manner. The subdivision occurred when the Town of Johnstown annexed only a portion of the property. This process was described in an email to Mr. Walter from Billie Moore. Section 24-10-30.C- Violations and penalties. C. Building permits for construction on land divided in an illegal manner subsequent to the adoption of the initial ordinance codified herein shall not be issued unless reviewed and approved by the Board. No building permit shall be approved by the Board unless all of the following can be shown: 1. The parcel shall be accessible from an existing public road. 2. The parcel will have access to an adequate water supply. 3. The parcel will have access to an adequate means for the disposal of sewage. 4. The issuance of the building permit will not change the essential character of the neighborhood. 5. The procedure defined in this Section is not being utilized for the purpose of evading the requirements and intent of this Chapter. 6. The owner does not own a parcel of land adjacent to the subject parcel. The Planning Director has reviewed this request and recommends that this request be approved for the following reasons. Mr. Walter meets all six (6) criteria outlined above. Please see Mr. Walter's responses to the six (6) items in a letter dated October 16, 2019. • The Department of Planning Services sent the existing access permit to the Department of Public Works for review and comment in an email dated October 24, 2019. The Department of Public Works provided a response stating no concerns and that there is an approved access under AP19-00291. • There is adequate water. The Colorado Legislature passed SB 35 in 1972 that set the minimum lot size for Counties at 35 acres. However, the minimum lot size for Weld is 80 acres. In the eyes of the State the parcel is legal, but in the eyes of the County it's legal but non -buildable. It's assumed that the County Commissioners recognized this problem and amended the code in 1982 to add subsection C. The last time that this section of the code was utilized was on May 30, 1984 at which time the Board of County Commissioners issued a building permit on a parcel of land that was subdivided in an illegal manner. Staff recommends that the Commissioner's approve the issuance of a building permit to Mr. Walters. Any subdivider, or agent of a subdivider, who transfers, sells, agrees to sell or offers to sell any subdivided land before a final plat for such subdivided land has been approved by the Board and recorded or filed in the office of the County Clerk and Recorder shall be guilty of a misdemeanor and shall be subject to a fine not to exceed five hundred dollars ($500.00) for each parcel or interest in subdivided land which is sold or offered for sale. All fines collected shall be credited to the general fund of the County. B. The Board shall have the power to bring an action to enjoin any subdivider from selling, agreeing to sell or offering to sell subdivided land before a final plat for such subdivided land has been approved by the Board.
