HomeMy WebLinkAbout20194570.tiffHEARING CERTIFICATION DOCKET NO. 2019-122.C RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR19-0036, FOR A HOME BUSINESS THAT FABRICATES VIA SANDBLASTING AND CARVING STONE MONUMENTS AND HEADSTONES, AND FOR ONE (1) SINGLE FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE-FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT - RICHARD AND KATHI CROOKS A public hearing was conducted on November 6, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro -Tern Commissioner Sean P. Conway - EXCUSED Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Kim Ogle Public Works Department representative, Hayley Balzano Health Department representative, Lauren Light The following business was transacted: e I hereby certify that pursuant to a notice dated August 16, 2019, and duly published August 21, 2019, in the Greeley Tribune, a public hearing was conducted on September 18, 2019, to consider the request of Richard and Kathi Crooks, for a Site Specific Development Plan and Use by Special Review Permit, USR19-0036, for a Home Business that fabricates via sandblasting and carving stone monuments and headstones, and for one (1) Single -Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, at which time the Board deemed it advisable to continue the matter to October 30, 2019, due to a medical emergency. At said hearing on October 30, 2019, the matter was continued again to November 6, 2019, to allow Planning Staff adequate time to consult with the applicants about their availability. Bob Choate, Assistant County Attorney, made this a matter of record. Chair Kirkmeyer reviewed for the applicant and the public, the procedures to follow should this case result in a tie vote due to four (4) Commissioners being present and Commissioner Conway excused. IEI Kim Ogle, Department of Planning Services, presented a brief summary of the proposal, stated the site is within the three (3) mile referral areas of the Towns of Johnstown and Berthoud, as well as Larimer County, and indicated none of these agencies returned a referral response. He described adjacent properties and nearby residences, and confirmed no correspondence was received by the Department of Planning Services. He stated 12 referrals were sent out and two (2) c.c.PLC(50/TP), PwC Ng), EH(LL) is/03/19 2019-4570 PL2707 HEARING CERTIFICATION - RICHARD AND KATHI CROOKS (USR19-0036) PAGE 2 agencies responded, entered the favorable recommendation of the Planning Commission into the record as written, and displayed images of the site and surrounding views. • Hayley Balzano, Department of Public Works, provided a brief overview of the transportation plans and requirements and stated access to the site is on County Road (CR) 13, which is in the Town of Johnstown's jurisdiction. She explained the traffic associated with the business, and noted the site meets a drainage exception. ▪ Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions, stated water is provided by the Town of Johnstown and the septic system is permitted for two (2) bedrooms. She indicated the second residence would require a separate septic system, stated the applicant has a vacuum system to mitigate business -related dust, and mentioned Development Standards (DS) #7-15 address Environmental Health items. le Richard Crooks, applicant, stated he would like the USR to allow him to operate his business on his property. El No public testimony was offered concerning this matter. • In response to Commissioner Moreno, Mr. Crooks confirmed the business operation is in an enclosed area. Commissioner Moreno suggested deleting DS #3 (hours of operation), and Chair Kirkmeyer suggested changing the language in DS #17 (staff access onto the property to ensure compliance) to be specific to the business operation. In response to Chair Kirkmeyer, Mr. Crooks indicated he had reviewed, and agreed to abide by, the Conditions of Approval and Development Standards, as amended. E No public testimony was offered with regard to changes made to the Conditions of Approval and Development Standards. IR Commissioner Moreno moved to approve the request of Richard and Kathi Crooks for a Site Specific Development Plan and Use by Special Review Permit, USR19-0036, for a Home Business that fabricates via sandblasting and carving stone monuments and headstones, and for one (1) Single Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural). Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended. The motion was seconded by Commissioner Freeman, and it carried unanimously.
