HEARING CERTIFICATION DOCKET NO. 2019-125.A RE: CHANGE OF ZONE, COZ19-0002, FROM THE R-1 (LOW DENSITY RESIDENTIAL) ZONE DISTRICT TO THE C-3 (BUSINESS COMMERCIAL) ZONE DISTRICT — DANIEL AND JANNA MILLER A public hearing was conducted on October 9, 2019, at 10:00 a.m., with the following present: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: Acting Clerk to the Board, Jessica Reid Assistant County Attorney, Bob Choate Planning Services Department representative, Angela Snyder Public Works Department representative, Mike McRoberts Health Department representative, Lauren Light The following business was transacted: I hereby certify that pursuant to a notice dated August 30, 2019, and duly published September 4, 2019, in the Greeley Tribune, a public hearing was conducted to consider the request of Daniel and Janna Miller, for Change of Zone, COZ19-0002, from the R-1 (Low Density Residential) Zone District to the C-3 (Business Commercial) Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. • Angela Snyder, Department of Planning Services, suggested the case be continued until the plat for Resubdivision, RES19-0008, is recorded, and stated the outstanding Condition of Approval (COA) is a Final Drainage Report with detention design. • Kelsey Bruxvoort, AGPROfessionals, represented the applicant, and stated they submitted a Drainage Report in July, 2019, and received comments from the Department of Public Works (PW) on October 8, 2019. El Mike McRoberts, PW, clarified the timeline of the receipt of drainage related documents and referral comments provided by PW. He explained the content of his referral comments and described what was still needed from the applicant. • Ms. Bruxvoort explained her understanding of the situation and in response to Chair Kirkmeyer, she confirmed AGPROfessionals had not submitted any documents after August 14, 2019, and stated they submitted a certified, stamped, engineered Drainage Report on July 17, 2019. She indicated they will revise and resubmit the Drainage Report based on PW's referral comments. cc:et-co..s(TP), Pwcnnrn), H(t,L) 2019-4473 it 105/ 19 PL2709 HEARING CERTIFICATION - DANIEL AND JANNA MILLER (COZ19-0002) PAGE 2 Mr. McRoberts stated the document submitted on July 17, 2019, was a Drainage Narrative with the request for an exception, not a Drainage Report. He indicated his referral was prepared after the submittal of the second Drainage Narrative and stated the applicant needed to submit a Drainage Report that included runoff from Lot 2. le In response to Commissioner Conway, Mr. McRoberts explained the applicant submitted a Drainage Narrative from an engineer that did not address detention design. to Tim Naylor, AGPROfessionals, represented the applicant, stated they submitted a stamped, engineered, Drainage Report addressing what they thought was necessary, and indicated they will re-review and update a Drainage Report based on Mr. McRobert's referral comments. In response to Chair Kirkmeyer, he confirmed on July 17, 2019, they submitted an engineered report with a request for an exemption. There was discussion among the Board, staff and the applicant about the timeline of the referral response, and Mr. Naylor indicated they felt they had satisfied the Condition with the Drainage Report they submitted. Chair Kirkmeyer reiterated the requirements for the COA to be met and Mr. Naylor acknowledged said requirements. No public testimony was offered concerning this matter. E After discussion about the time needed for the applicant to complete the COA and for staff to review the Final Drainage Report, the Board and applicant agreed to continue the hearing to November 27, 2019, at 10:00 a.m. Commissioner Moreno moved to continue the request of Daniel and Janna Miller, for Change of Zone, COZ19-0002, from the R-1 (Low Density Residential) Zone District to the C-3 (Business Commercial) Zone District, to November 27, 2019 at 10:00 a.m., to allow the applicants adequate time to complete the Conditions of Approval, and record the plat for RES19-0008. The motion was seconded by Commissioner Freeman, and it carried unanimously.
