Home My WebLink About20193238.tiffRESOLUTION RE: APPROVE EMERGENCY BID #B1900110, COUNTY ROAD 39 EXTENSION PROJECT AND WAIVER OF TEN-DAY WAITING PERIOD FOR CONSIDERATION AND INVESTIGATION - DEPARTMENT OF PUBLIC WORKS WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Department of Purchasing has requested waiver of the ten-day waiting period for Emergency Bid Request #61900110, County Road 39 Extension Project, for the Department of Public Works, since this is a grant project, paving needs to occur before the end of year and needs to start on August 19, 2019, to meet the design and construction schedules, and WHEREAS, the Board of County Commissioners deems it advisable to waive the ten-day waiting period for said emergency bid. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the ten-day waiting period for Emergency Bid Request #B1900110, County Road 39 Extension Project, for the Department of Public Works, be, and hereby is, waived. BE IT FURTHER RESOLVED by the Board that the low bid from DeFlaco Construction Company, in the amount of $3,753,538.27, be, and hereby is, accepted on an emergency basis. Two (2) bids were received; one for $3,753,538.27 and another for $4,536,239.00 with the lowest bid submitted by DeFalco Construction Company. The total Engineer's Estimate for this work was $2,847,203.42. Most of the difference from the Engineer's Estimate to the lowest bid is driven by the construction schedule; the 74 -calendar day construction contract needs to be completed by October 31, 2019. A portion of the construction costs will be reimbursed to Weld County by the Town of LaSalle based on their DOLA grant and a match provided by Union Pacific Railroad totaling $1,530,000. The submitted bids have been reviewed for errors and completeness. Both bids were complete, and no errors were found. The bid tabulation has been attached for your information. The reason for requesting emergency award is that this is a grant project and paving needs to occur before the end of this year to ensure paving can be accomplished before cold weather. There is also a 2 -week .minimum time frame to receive the Union Pacific Railroad permit. This permit is required before construction can begin and the contractor needs the award to start this process. The design and construction schedules have been condensed as much as possible. Therefore, construction must begin as soon as possible. We have specified a 74 -calendar day contract beginning August 19, 2019 and ending on October 31, 2019. The only way to achieve a beginning date of August 19, 2019 is by utilizing the emergency award process. Staff recommends awarding the construction contract to DeFalco Construction Company for a total amount of $3,753,538.27.
