A public hearing was conducted on April 17, 2019, at 10:00 a.m., with the following present:

The following business was transacted:
I hereby certify that pursuant to a notice dated February 8, 2019, and duly published
February 13, 2019, in the Greeley Tribune, a public hearing was conducted to consider the
request of Box M Ranch, LLC, for a Site Specific Development Plan and Use by Special Review
Permit, USR18-0110, for Mineral Resource Development Facilities including Oil and Gas Support
and Service (outdoor storage of pipes, equipment, and other materials used by oil and gas) in the
A (Agricultural) Zone District. Bob Choate, Assistant County Attorney, made this a matter of
record.
Chair Pro-Tem Freeman reviewed for the applicant and the public, the procedures to follow
should this case result in a tie vote due to four (4) Commissioners being present and Chair
Kirkmeyer excused.
Angela Snyder, Department of Planning Services, presented a brief summary of the
proposal, stated the site is not within the three (3) mile referral area of any municipalities, and
indicated ten (10) referrals were sent out with three (3) responses. She provided the hours of
operations and mentioned the site will be used for the outdoor storage of pipes, have an office
trailer, and no screening or landscaping is proposed. She stated there was one (1) letter of
objection from a surrounding property owner (SPO) citing road damage, unsightly junk, and
decreased property value as concerns. She described surrounding uses, displayed images of

site, and entered the favorable recommendation of the Planning Commission into the record as
written. In response to Commissioner Conway, Ms. Snyder clarified the content of the SPO letter.
Hayley Balzano, Department of Public Works, provided a brief overview of the transportation
plans and requirements and stated the site will use an existing access on County Road (CR) 40.
She provided daily roundtrip counts associated with the site and mentioned the site will have an
improved gravel surface for the laydown yard and parking. She stated an Improvements
Agreement (IA) will be required for road maintenance and future improvement triggers and
presented the drainage and grading requirements.
• Ben Frissell, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated the site will have two (2) full-time employees, and bottled water and portable
toilets are acceptable. He noted there will be no fuel storage, washing of vehicles or floor drains
onsite, and Development Standards (DS) #15-21 address Environmental Health (EH) items.
• Tim Naylor, AGPROfessionals, represented the applicant and presented a PowerPoint
presentation (Exhibit D) with images of the site, surrounding properties, and proposed site plan.
He described the site operations, compatibility with surrounding uses, and the traffic and access
associated with the proposed use.
No public testimony was offered concerning this matter.
Mr. Naylor expressed concern with the tracking control requirements. To address this,
Ms. Balzano suggested deleting the second sentence of COA #4.A (tracking control specifics),
and the Board agreed. After discussion about DS #12 (annual review of the IA), the Board agreed
to change "shall" to "may". At Chair Pro -Tern Freeman's suggestion, the Board agreed to delete
DS #5 (hours of operation), and DS #19 (noise standard).
No public testimony was offered with regard to the changes made to the Conditions of
Approval and Development Standards.
In response to Chair Pro -Tern Freeman, Mr. Naylor indicated he reviewed, and on behalf of
the applicant agreed to abide by, the Conditions of Approval and Development Standards, as
amended.
• Commissioner Moreno moved to approve the request of Box M Ranch, LLC, for a Site
Specific Development Plan and Use by Special Review Permit, USR18-0110, for Mineral
Resource Development Facilities including Oil and Gas Support and Service (outdoor storage of
pipes, equipment, and other materials used by oil and gas) in the A (Agricultural) Zone District,
based on the recommendations of Planning staff and the Planning Commission, with the
Conditions of Approval and Development Standards, as amended. The motion was seconded by
Commissioner Conway, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:49 a.m.
