HomeMy WebLinkAbout20190137.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 7, 2019 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 7, 2019, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Barbara Kirkmeyer, Chair Commissioner Mike Freeman, Pro-Tem Commissioner Sean P. Conway Commissioner Scott K. James Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly ▪ MINUTES: Commissioner Moreno moved to approve the minutes of the Board of County Commissioners meeting of January 2, 2019, as printed. Commissioner Conway seconded the motion, and it carried unanimously. AMENDMENTS TO AGENDA: There were no amendments to the agenda. el CONSENT AGENDA: Commissioner Freeman moved to approve the Consent Agenda as printed. Commissioner James seconded the motion, and it carried unanimously. • PUBLIC INPUT: Bill Gillard, resident of Greeley, apologized for previously exceeding the three (3) minute time allotment allowed for each speaker during public input. BIDS: • 1) APPROVE BID #B1800156, RFQ - ON -CALL ENGINEERING SERVICES - DEPARTMENT OF PUBLIC WORKS: Rob Turf, Department of Purchasing, recommended continuing this matter to allow staff additional time to conduct interviews with the vendors. Commissioner Freeman moved to continue said matter to January 14, 2019. The motion was seconded by Commissioner Moreno, and it carried unanimously. 2) PRESENT BID #61800154, WEB APPLICATION FOR PROPERTY SALES SEARCH — DEPARTMENT OF INFORMATION TECHNOLOGY: Jacob Mundt, Department of Information Technology, presented the sole bid and stated staff will bring back a recommendation on January 21, O1/31 Minutes, January 7, 2019 Page 1 2019-0137 BC0016 2019. In response to Commissioner Conway, Mr. Mundt stated this is a specialty area and the Assessor's Office completed extensive research hoping to attract more bids. NEW BUSINESS: 1) CONSIDER TEMPORARY CLOSURE OF CR 29 BETWEEN STATE HIGHWAY 14 AND CR 84: Amy Mutchie, Department of Public Works, presented the terms of the temporary closure beginning January 7, 2019, through January 11, 2019, for the replacement of a drainage culvert. Commissioner Moreno moved to approve said temporary closure. The motion was seconded by Commissioner James, and it carried unanimously. U. 2) CONSIDER TEMPORARY CLOSURE OF CR 15 BETWEEN CRS 2 AND 4: Ms. Mutchie reviewed the terms of the closure beginning January 7, 2019, through January 11, 2019, for a drainage culvert replacement. Commissioner Freeman moved to approve said temporary closure. Seconded by Commissioner James, the motion carried unanimously. 3) CONSIDER TEMPORARY CLOSURE OF CR 29 BETWEEN CRS 88 AND 90: Ms. Mutchie presented the terms of the closure beginning January 14, 2019, through January 18, 2019, for an irrigation culvert replacement and stated water will be used for dust abatement. Commissioner Freeman moved to approve said temporary closure. The motion was seconded by Commissioner Moreno, and it carried unanimously. 4) CONSIDER TEMPORARY CLOSURE OF CR 380 BETWEEN CRS 61 AND 63: Ms. Mutchie presented the temporary closure beginning January 14, 2019, through January 18, 2019, to replace a drainage culvert. She stated water will be used for dust abatement as needed. Commissioner Conway moved to approve said temporary closure. The motion, which was seconded by Commissioner Moreno, carried unanimously. NEW BUSINESS (HEALTH): 1) CONSIDER SUSPENSION OF COLORADO RETAIL FOOD ESTABLISHMENT LICENSE - ALMANZA'S MEXICAN FOOD: Gabri Vergara, Department of Public Health and Environment, presented a brief summary of the restaurant's violations encountered during ten (10) inspections. Dan Joseph, Department of Public Health and Environment, explained the purpose of restaurant inspections by the Health Department is to ensure the restaurant is complying to prevent illnesses. He reported staff has been working with the operator of Almanza since April 2018, and conducted Targeted Education and a Compliance Review. He stated, since 2016, the restaurant has not received an above marginal score and failed the last two (2) recent inspections. He explained Almanza's Mexican Food has had 66 violations, 80 percent are critical and there hasn't been much improvement during the follow-up inspections. Mr. Joseph described the violations that occurred during the recent inspections and recommended Mr. Joseph recommends the Board suspend Almanza's Colorado Retail Food Establishment License. During the suspension, Mr. Joseph recommended allowing the $1,000.00 civil penalty to defray the cost of hiring a food safety consultant, and have the consultant perform an inspection while the facility is in operation, allow the $1,000.00 civil penalty to defray the cost of hiring, having management become food safety certified, and the Health Department performing two (2) regular inspections. He requested to bring the matter back in front of the Board, for further enforcement, if the restaurant doesn't stay in compliance. In response to Commissioner Moreno, Mr. Joseph stated the letters sent to the operator don't always require a response; but are more of a reminder to notify them about the outcome of the inspections. He noted Almanza's Mexican Food restaurant scored three (3) times the number of violations for inspections. Tomas Alamillal Lopez, restaurant owner, stated he is working on the suggestions from the Health Department and introduced the managers who will help train the employees. Jorge Torres, representative Minutes, January 7, 2019 Page 2 2019-0137 BC0016 of Cisco, explained he will assist in the Serve Safe training for the employees and advised Mr. Alamillal to use fresh beef rather than frozen. He began working with Mr. Alamillal around December 15, 2018, and has worked in the restaurant industry for over 27 years. In response to Commissioner Conway, Mr. Joseph suggested hiring a consultant who will have more experience with the inspections and the Serve Safe training. Mr. Torres confirmed they do offer both trainings. Mr. Alamillal stated his manager has been employed there for three (3) years and would like to keep the restaurant open while working to achieve and stay in compliance. Commissioner Freeman stated the restaurant needs to be closed for a couple days to get employees trained and make sure the restaurant passes the Health Department's inspection. In response to Commissioner Conway, Mr. Joseph confirmed he provided a list of Food Safety consultants. Mr. Alamillal reported the current manager has been in her position for about a year. Chair Kirkmeyer stated, because Mr. Alamillal has not complied, the suspension of Retail Food Establishment License is important to ensure Mr. Alamillal trains his employees in safe food handling. Mr. Alamillal stated he has high turnover which makes it hard to train his employees. Commissioner Moreno stated the goal is to help businesses be successful while ensuring the public's safety. Commissioner James stated having the restaurant closed will allow Mr. Alamillal time to provide training in food safety handling to all his employees and ensure the safety of Weld County citizens. Mr. Joseph stated he will need to verify Mr. Torres is qualified to provide training as a consultant. a In response to Chair Kirkmeyer, Mr. Alamillal replied he understands the requirements as presented by Health Department staff. Mr. Joseph clarified that once a consultant is hired the training can be completed within a few days. Ms. Vergara stated a qualified consultant will need to provide more hands- on training. Mr. Joseph stated there will need to be a follow-up inspection to verify the plumbing has been repaired. IR Commissioner Moreno moved to suspend Almanza's Mexican Food's Colorado Retail Food Establishment License with the stipulations as recommended by staff, which was seconded by Commissioner Freeman. The motion carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved. Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted by the Clerk to the Board.
