To Weld County Planning Board: We were disappointed to hear that you ruled against our opposition to the proposed truck repair/hauling facility by Front Range Landfill. However, we saw that the vote was 4 to 3, which shows that you are torn about the value of this proposal to our community. We would like to take this opportunity to reiterate our previous justifications for our concerns and add another material concern (#5 below). 1 We are opposed to the Front Range Landfill's prooposal for a Garbage Truck Repair facility to be located in Weld County off of WCR 7, north of WCR 4. We purchased our home on WCR 4 from our grandparents, Horst Willie Mueller and Donna Ruth Marie Mueller who homesteaded this property since 1967. Willie and Donna were instrumental in the original negotiations for the landfill to be allowed to be put in. During these negotiations, there was no concession for further development for the landfill as far as repair facilities. Furthermore, we have concerns with a repair facility being proposed so close to our property: 1. Contamination to our irrigation water, which we use for our crops and garden. Need for full containment at the facility. This proposal is for a truck repair facility, which includes oil changes and other repairs that utilize hazardous materials. This will require runoff mitigation to address rain washing hazardous materials from property to irrigation canals. 2. Excessive overweight traffic, which is not supported on WCR 7 currently (per the original negotiations and structure of the road). WCR 7 would have to be reconstructed to support additional weight. This will also affect our local pedestrian and cyclist traffic so if it were to go through, we would need to address the need for sidewalks and bike paths. We have a four year old who recently learned to ride his bike and a 3 month old, and we fear the increased heavy traffic on WCR 7 will cause significant safety issues for them in their residential community. 3. The foul smell. We are downwind from the proposed site. My husband has 10 years experience working as a diesel mechanic, and has worked specifically on trash trucks. This would be a nuisance to our residence. 4. Increased need for and cost of street sweepers, which will cause increased traffic congestion. The trash trucks will carry dirt and mud onto WCR 7, which will need to be addressed for road safety. This will also cause increased traffic congestion, as WCR 7 often is taken as an alternate route to I-25. 5. Lack of trust for Front Range Landfill to follow through with negotiated terms. Per #2 above, WCR 7 would need to be reconstructed to support additional weight and accommodate additional community pedestrian traffic. We have no faith that Front Range Landfill would adhere to negotiated terms. As part of the original negotiations when the landfill was initially put in, Front Range Landfill was supposed to maintain Sheridan. We have personally witnessed trash trucks damaging the road and we have seen no effort by Front Range Landfill to repair said road. Please see below photo taken on Friday, July 19, 2019 at approximately 8:45am on the southeast corner of Sheridan and Hwy 7. While we realize that this damage may fall outside of Weld county's jurisdiction, we want to point out that there is demonstrated negligence and lack of follow through by Front Range Landfill to maintain the integrity of our infrastructure to accommodate their needs. My husband's grandparents fought for years to oppose the landfill going in, but conceded once their terms were met and there was an understanding that this would be the end of the landfill's encroachment into established surrounding residences. We hope that the original agreement will be honored and this will be the end of the Front Range Landfill encroaching on Ranch Eggs Estates. Again, please deny Front Range Landfill's proposal for the truck repair at this site. To Whom It May Concern - This is my letter stating that I do not think it is a good idea to have this new facility in our neighborhood. There is a residential rural neighborhood just across the street that has been here for over 50 years. This is not compatible with the lifestyle out here. To think that there would be traffic 22 hours a day in a residential neighborhood is absolutely a nightmare. Please imagine you yourself living across from this site with this kind of traffic. I know from my personal experience living on CR 6 -just adjacent to CR 7. We get oil traffic 24 hours a day/7 days a week and it is a nightmare. It wakes me up all throughout the night EVERY night. The heavy traffic shakes our homes and is causing problems with foundations and the road etc.. We all get extremely worked up about this and have to constantly call in for complaints about speed etc. There already is so much traffic going on on CR 7 as it is, I can't imagine even more. PLEASE, do not let this pass, please have them consider other land that is NOT next to a rural residential neighbor. Again, think if this was your home and that this was possibly going to happen to you. Would you want this? Thank you for your time and listening to our very real concerns. Karen Lovewell 3693 CR 6 Erie, Co 1 USR 19-0032 Front Range Landfill Garbage Truck Repair WCR 7 Peggy Cline 1895 Carol Dr. Erie, CO 80516 Dear Weld County Planning: I am opposed to USR 19-0032 Front Range Landfill Garbage Truck Repair application. Is there something about the term "Rural Residential" that suggests any vacant land needs to be developed? I drove close to the proposed site yesterday, and was really disheartened. I've walked the irrigation ditch path east of there. It's such a beautiful, peaceful piece of land with animal activity. This proposal, if it is granted, will e nsure that it will never exist again. With so much development going on around us, I feel like Chief Joseph of the Nez Perce tribe who quoted before going onto the reservation, "My heart is sick and sad. From where the sun now stands, I will fight no more forever." However, my neighbors and I will continue to protest and fight to keep some of the peace we have retained by our constant vigilance and our battles. Though I protest this application, I must commend the Landfill and Baseline Engineering for their meticulous study of water flow, drainage and coefficients o f absorption. Some questions, comments and oversights I noticed: 1. Doesn't the "Blue Jungle" on County Line Road e xist for the same reason as this proposal? Is there a problem of functionality of that site? 2. The best laid plans can often fall apart with heavier rains than expected. There seems to be overconfidence in these containments for waste water. 3. The truck wash area seems too close to the FRICO ditch. 4. The water issue with pumping water from the well at the Landfill is that it's not nearly enough in case of fire. Even with the proposed storage tank, it doesn't qualify for the 2,500 gal/min without fire sprinklers, nor the 1,500 with sprinklers. Left Hand Water's requirement is that a property has to be included within a boundary of Northern Water Conservancy, which this property is not. Even if it were," service availability is limited to one single family equivalency without Waste Connections doing significant off site mainline and pumping capacity improvements." At Front Range's well at 7.5 gal/min, there's a huge deficiency. What determines the allowable release of the detention ponds? Can it be certain that since it's in the u pper limits of a major drainage basin that it will flow northeast? Written approval from the affected irrigation company (Farmers' Reservoir and Irrigation Co.) or other property owners wasn't received at the time of my writing. "The flows will not affect the adjacent property owners" was the landfill's reasoning With the truck wash water captured in a vault and pumped for disposal when needed.... when is it n eeded? Since an on -site wastewater treatment system is recommended, how /where will that be accommodated? When will groundwater information be available? Are 2 detention ponds enough? When will there be a lighting plan to shield rays from adjacent properties? Will fencing disguise the facility? What will be the material of the secondary containment? A disturbing comment was that "It will serve as a support hauling facility for the landfill " Isn't it just for maintenance and repair? The garbage truck traffic needs to be limited They need to continue to follow the designated garbage truck route as per agreement, not shift it from 5 to 7 Where is Erie's water transmission line on WCR 6? I had some comic relief from Erie's play to have the landfill share the cost of the signal project on WCR 7 and Erie Parkway They have demanded that from at least 3 entities that we know of, in order to grant permission to develop At least they are marking it down 5090' I was disappointed in the response from the Colorado Parks and Wildlife I realize this is a small site, but they recommend, not require, that the company looks for burrowing owls without giving them direction how or where to do this They recommend relocating or humanely killing the prairie dogs without giving them information They merely recommend that space is set aside for habitat and migration corridors, they don't require I ask you to reject this proposal for the safety, comfort and life's enjoyment of the neighborhoods which are adjacent and affected Thank you Sincerely, Pet& are It)Weaver Consultants A Group Mr. Josh Olhava, AICP Principal Planner City and County of Broomfield One DesCombes Drive Broomfield, CO 80020 Re: Broomfield Referral Comments Case No.: USR19-0032 Dear Mr. Olhava: Project No. 0601-60641-41 July 25, 2019 On behalf of Waste Connections of Colorado, Inc., please find below responses to your comments in your email dated July 24, 2019. This response letter contains each item identified in your email (in bold) and a response to each item in the same order listed. A response to each of the comments follows. 1. The application notes that all truck traffic entering and leaving the site are coming from the north along CR7 and that no trucks will be allowed to go south or come from the south on CR7. However, in the Traffic Study on page 8, the summary states that "A stop sign and a right turn only sign will be placed at die site access for vehicles exiting the site." This will result in trucks heading south on CR7, thus creating impacts to the intersection of CR7 and State Highway 7. I believe this reference was a typo and it is intended the sign would say 'left turn only'. Can you please verify and have the applicant update the necessary documents? The site should also incorporate curbing to mitigate southbound turn movements. Response: The reference to a right turn only sign at the exit of the site is a typo and reference a left turn only sign as noted in your comment. We are in the process of updating the typo in the traffic study and will submit the revision to Weld County. Curbing can be incorporated into the design to mitigate southbound turn movements from the site. 2. The hours of operation are concerning since the application states the regular operations occur between 5am and 5pm, but that maintenance hours occur between 3pm and 3am. The use by special review application states that landscape screening/buffer area will be used on the east side of the site, along CR7. However, the landscaping described by the applicant only mentions native grass seed, which would not provide adequate screening. Dear Weld County Commissioners and Planner Chris Gathman, This email is to record my personal objections to the granting of USR19-0032. My objections are as follows: • This approach is being explored because Erie (residents and officials) doesn't want the facility close to them. If this is approved, it essentially makes Weld County the dumping ground ... almost literally. • While proponents of this request appear to focus on the landfill, gas drilling, and planned power station in the immediate area, that's a very small focus on the whole reality. There is no landfill access via WCR7. The gas drilling is short-term and about to complete is current operation. The planned power station, once it's built, will have so little traffic impact as to be not worth mentioning. This request puts undue hardship on the many residents in the area. • Rural Ranch Eggs' Neighborhood, as you should all be aware by now, has been inundated with MANY urban subdivisions on the three sides that Broomfield annexed from Weld County. The rural Weld County roads are simply not up to handling the additional traffic that already flows down them, and now TRASH TRUCKS are to be added!?! That won't be beneficial to Weld County or to any residents in the area, be they in Weld or Broomfield! • The Landfill's proposal is to insert a COMMERCIAL operation into an AGRICULTURAL area. Weld County's new codes alone forbid such an operation. • Adding COMMERCIAL NOISE LEVELS TWENTY-TWO HOURS A DAY is too, too much for what remains essentially a Rural Residential community. From 5AM beep -beeping of trash trucks backing up until 3AM commercial power tools changing tires and performing other repairs is more than any Weld County resident should have to tolerate. It's simply untenable! EXHIBIT T O&.n - ou a2 Once again, our community is in danger of another incroachment on our quiet neighborhood. Putting this facility in off County Road 7 something we are opposed to. Why do we have to suffer to make things easier and more convenient for the oil companies and the Landfill. Our area is being ruined by the companies. We must tollerate the trucks, noise the rattle of our homes, road dust, road kill, not to mention just trying to cross our street to pick up our mail. It offers no benefit to us. We have rights too. I live by a truck facility right now. It is off I-25 and the frontage road. The bright lights and noise make sleeping with a window open impossible! They work all night long. You can hear the truck engines droning, the backup beeps and bright lights shining in our windows. I have attached a video, but the light is much brighter and the sound is louder than what my phone picked up. We are an older small rural neighborhood. We don't have sidewalks, berms or anything else to protect us for additional traffic. Truck or otherwise. We live on a narrow two-lane county road. With a very small shoulder. There are barrow ditches on the sides of our road. It is difficult to to cross the street to get our mail or pull out of our driveways. We have school bus stops along our road will little room for the kids to stand while they wait. Increasing the traffic on our road will make biking, horseback riding or even walking dangerous. Our road is not constructed to hold up to the weight of trash trucks. Our road has deterioated will the oilfield traffic. Further stress on our roads will make them unsafe. Although they will be instructed to use Road 7 from the north, I fear they will use our road if it is more convenient for them. We see this all the time with trucks from trash truck companies using our road. We have called the landfill and the actual companies of the offenders. Why not have the trucks enter and exit on the west side? Sheridian and Road 5 are designed for the Landfill traffic. To us it makes sense to keep all Landfill traffic there. They have sidewalks, grassy knols and berms to sheild them from the trucks. We have none of that and barely a shoulder to walk on. I would like to close by saying why do we have to suffer? Why is it more important to make things convenient, easier and cheaper for these companies? They make money because we cater to them and us, as homeowners must pay the price! A prime example is the Coytoe Trails well site. We must listen to trucks going up and down our road 24 hours a day, 7 days a week because it is more convenient for them. It makes it so we can't enjoy our yards and being outdoors. For what? To make it easier and less expensive for an industry who makes billions each year. Why? Why don't we count? Let the Landfill keep it facility where it is. There are no homes there and they have the light at County Line and State Highway 7 to get out. You're not supposed to create blight! The property in question is zoned agricultural, so why would you give permission for a gigantic dump to o perate there in the first place? It was built without proper notification of the adjacent landowners! It's already an illegal installation. It should not be allowed to continue, and certainly not to become more official with the addition of permanent structures. You, the Planning Services, in collusion with Erie and the landfill owners, totally ruined my property values, my view, my lifestyle, my sense of community, and my peace and quiet to allow this monstrosity in the first place and now you want to give them permission to add an office building and shed, a container shop and truck wash! They should not be there at all! No one gave me a chance to say no, or to be heard at all. Somehow you people in Greeley thought it was fine to build a mountain of trash directly across from my house! It was n ot right! And it is not right to allow them to continue creating blight! That landfill already operates day and night and we are subjected to the sounds of big machinery rumbling and clanking, asleep or awake. It already blocks my view of anything but a mountain of garbage. It has isolated my home from town and eliminated the rural expanse that used to extend to Boulder and the foothills, to the Rocky Mountains. Now I see a mountain of dirt -covered garbage and n othing else! And you want to let them make it even worse? NO!! Please no more! Good Afternoon Chris, The City and County of Broomfield has a couple outstanding comments/concerns that were not addressed between the applicant's recorded exemption (RECX18-0160) and the current use by special review (USR19-0032). Please see the following: • The application notes that all truck traffic entering and leaving the site are coming from the north along CR7 and that no trucks will be allowed to go south or come from the south on CR7. However, in the Traffic Study on page 8, the summary states that "A stop sign and a right turn only sign will be placed at the site access for vehicles exiting the site."This will result in trucks heading south on CR7, thus creating impacts to the intersection of CR7 and State Highway 7. I believe this reference was a typo and it is intended the sign would say 'left turn only'. Can you please verify and have the applicant update the necessary documents? The site should also incorporate curbing to mitigate southbound turn movements. • The hours of operation are concerning since the application states the regular operations occur between 5am and 5pm, but that maintenance hours occur between 3pm and 3am. Given the proximity to existing Weld County residents, noise mitigation and hours of operation should be closely reviewed and taken into consideration by the County. • On the recorded exemption we raised concerns with screening the site from adjacent properties. The use by special review application states that landscape screening/buffer area will be used on the east side of the site, along CR7. I'm writing to encourage rejection of the USR application submitted by Front Range Landfill LLC to move their Waste Connections trash hauling facility from its present location on County Line Road in Erie to the proposed location on County Road 7 just north of my Ranch Eggs neighborhood. As a concession to opening this landfill some 25 years ago, the then-owners/operators assured Ranch Eggs neighborhood in a signed agreement that they would never use County Road 7 for their trash hauling operations. Apparently they tricked us, as their lawyer now claims that their promise only applies to their customers not using County Road 7 and not their employees! The now -owners of the landfill attended a recent Ranch Eggs neighborhood board meeting stating that yes, they had agreed not to use Road 7 in the original agreement made 25 years ago, but "25 years is a long time and things change!" It was made clear that they represent a big, powerful Texas company whereas we're just a small, Weld County rural neighborhood association. Erie gets the financial benefits from the landfill, so why not share in some of the pain as well? The town of Erie has always been the prime benefactor of the landfill. When they courted the landfill, its location was adjacent to Ranch Eggs neighborhood and a convenient five miles from the town of Erie. In the 25 years since, Erie has grown and now they too are experiencing the down sides of having a landfill. So they want the landfill to move their facility further away from Erie, and once again Weld County and Ranch Eggs Neighborhood is targeted. Broomfield County's new, massive Palisades residential development will be impacted as well. Dear weld County Commissioners, This proposal for Waste Connections to move their central garbage truck facility to the east side of the landfill site (USR19-0032) is very undesirable and a nasty concept to consider allowing so close to the neighborhoods located on WCR 7 and 6. There is also new development in the area that would be badly affected by the noise and the increased traffic to 100 garbage trucks per day (in and outbound), and the plan to store all of their equipment there too. The prospect of the noise from garbage truck maintenance going on until 3:00 in the morning is simply unconscionable. The homes along Road 7 across from the landfill have already been very badly abused by the landfill's operations, but this facility would add more insult to injury. Furthermore, there are 100's of new homes being constructed within easy earshot of the site, just to the east in Broomfield. If the facility were located much closer to the landfill operations base off of Road 5, the impact on local home owners would be much less, since there are only other landfills across the road to the west from there, and there is already handling in place along Road 5 for the garbage truck traffic. All of that operation is occasionally audible, but it is happening everyday, so to merge the garbage truck maintenance facility in that vicinity would be much more understandable than to place it right along the border with civilization on the east side. To Chris Gathman: I was disappointed to hear that the planning commission ruled against our opposition to the proposed truck repair/hauling facility by Front Range Landfill. However, we saw that the vote was 4 to 3, which shows that almost half the board recognizes and agrees with our opposition. I am writing again in hopes of convincing a necessary 4th member to oppose. I would like to take this opportunity to outline my justifications for my opposition. I am opposed to the Front Range Landfill's proposal Waste Connections to have a Garbage Truck Repair facility be located in Weld County off of WCR 7, north of WCR 4. We purchased our home on WCR 4 from my husband's grandparents, Horst Willie Mueller and Donna Ruth Marie Mueller who homesteaded this property since 1967. Willie and Donna were instrumental in the original negotiations for the landfill to be allowed to be put in. During these negotiations, there was no concession for further development for the landfill as far as repair facilities. Furthermore, we have concerns with a repair facility being proposed so close to our property: 1. Excessive Noise: The proposed hauling facility would have operations running 22 hours per day. This is incompatible with the surrounding residential areas. Furthermore, there are approved plans to develop the land just north of CR 4, which will have dense residential. I cannot reconcile the installation of a 22 hour operational truck hauling and repair facility to be compatible with the "bigger picture" of residential, which is what the surrounding areas support. The noise, hazardous materials, and increase in heavy equipment/truck traffic all pose risks to the safety of our residents and children and to our peaceful way of life. We have family friends who were in the waste management business for many years. They ran their trucks during the day and typically repair and work on them in the evening/night hours. This facility poses a direct nuisance to the residential communities that have been here for many years and the newly approved communities that are scheduled to be put in soon. 2. Contamination to our irrigation water, which we use for our crops and garden. Need for full containment at the facility. We purchased our home on WCR 4 from my grandparents, Horst Willie Mueller and Donna Ruth Marie Mueller who homesteaded this property since 1967. Willie and Donna were instrumental in the original negotiations for the landfill to be allowed to be put in. During these negotiations, there was no concession for further development for the landfill as far as repair facilities. Here is a list of the reasons I oppose this facility: 1. Excessive Noise: The proposed hauling facility would have operations running 22 hours per day. How can the installation of a 22 hour operational truck hauling and repair facility to be compatible with the "bigger picture" of residential, which is what the surrounding areas support? The noise, hazardous materials, and increase in heavy equipment/truck traffic all pose risks to the safety of our residents and children and to our peaceful way of life. This facility poses a direct nuisance to the residential communities that have been here for many years and the newly approved communities that are scheduled to be put in soon. 2. There is a surveyor hole or what ever they call them almost immediately in front of our house. Despite it being in the middle of a lane, most of these huge trucks hit it square on, which rocks our old house and are causing foundation problems. There is some kind of metal in it and when they hit it, which is often now since they are fracking a new well, it literally shakes the whole house as well as making a terrible noise. I have no clue who is responsible for the hole, but am assuming since it is on a county road, that Weld county must have authority over it. We are very close to the proposed location The operation would be 22 hours a day- this is incompatible to having a reasonable neighborhood. The area has residential. The entire area is being developed with single and multi family dwelling. The development and new location of the landfill is not congruent with the overall design and future plans for the area, either Broomfield County or Weld County. With the additional dwelling and development in the area county road 7 and 6 are increasing used for pedestrian and bicycle traffic. County road 7 and 6 are not designed for heavy truck traffic Currently there are excessive numbers of heavy equipment (18 wheeler tractor trailers) that service the oil and gas equipment in the area and this is a big impact to the landowners in the area. Yes, Waste Connections of Colorado's hauling facility contemplates using the Landfill's current access on County Road 5 for its haul trucks; however, employees and vendors would use County Road 7 when they arrive to work and depart. Essentially, the proposal takes the big trucks off County Road 7. We would suggest this be an interim plan. Once the main 4 -lane Sheridan Parkway is extended to 1-25, we would expect that all vehicles would then have the option to use the County Road 7 entrance. There would be no net change in traffic on County Road 5 were the Waste Connections of Colorado hauling operation (WC) to use the Landfill's entrance. Why? Typically, once the WC vehicle deposits its final load at the Landfill, it exits on County Road 5 and then travels back to the existing hauling facility in Erie. Under the proposed scenario, the WC vehicle would remain internal to the Section of Property after depositing the load, and just exit through the Landfill entrance on County Road 5 the following day assuming it has a route/load to pick up that day in Weld County or surrounding communities. Actually, this proposal reduces overall truck use of Town and County Roads. Hopefully, this is clear. There is no stipulation on hours of access at the landfill entrance and of course it has traffic 24/7. For instance, the Landfill has a Gas to Energy Plant that runs constantly and requires supervision. There are restrictions on disposal hours, but obviously this proposed use will not violate that Condition in the Erie/Landfill Development Standards. I would be pleased to visit with you and the Public Works Director to discuss this further. I am actually in the area on Thursday from mid -afternoon onwards, and if that does not work for you, we can perhaps handle this via a conference call. The water right owners have the right to water that is not being contaminated by unknown substance, which may include; prescription/illegal drug residue, bio-hazard material, and other chemical and biological contaminates. These irrigation ditches provide water necessary to grow the food for people and livestock, posing additional safety and welfare issues to us and the environment/ground in which we reside on. 7. The additional risk to the school age children who are getting on/off the bus. This not only includes physical safety but potential bio-hazard safety due to unknown potential substance residue in the trucks, and increased traffic. 8. The increased traffic this area has seen up to this point, has begun to take its toll on the wildlife that live here as well. We took advantage of your consideration and Commissioner Conway's recommendation and invited Mark Adams and Aaron Bradley, representatives from Waste Connections, to a RENA community meeting on August 8th to discuss our concerns with the proposed facility. Mr. Adams and Mr. Bradley advised us that Waste Connections has revised their site access plan for the trash hauling vehicles. According to the new plans, trash hauling vehicles will not be permitted to use the proposed entrance on Weld County Road 7, but will instead enter and leave the maintenance facility via the existing landfill entrance located on Weld County Road 5. Mr. Adams and Mr. Bradley also expressed Waste Connection's commitment to ongoing engagement with the community to address additional concerns if this USR is approved. While we greatly appreciate Waste Connections efforts to mitigate one of the most troublesome impacts that this industrial facility would have on our community — the traffic — the fact remains that there are additional impacts that make this industrial, trash hauling truck storage, service and repair facility incompatible with our existing neighborhood and with the future development of the surrounding area. Unfortunately, even with this change, Waste Connection's proposal remains inconsistent with protecting the health, safety, convenience and general welfare of the Weld County citizens who live in our community. We provided details of these concerns in our letter to you and to the Planning Board dated July 12, 2019. Most significantly, this facility proposes to operate 22 hours per day, seven days per week, at industrial noise levels, in our rural residential, agricultural neighborhood — one that was established long before the landfill was developed. The proposed site is located directly across WCR 7 from rural residential homes which were built in the 1960's, a planned residential community under construction in Broomfield, and a parcel of dedicated Broomfield Open Space. Erie also has plans under review for 1,200 homes to be built north of the proposed facility.
