Change of Zone/Rezoning Questionnaire
Questionnaire Responses
The following information addresses each section of the change of Zone/Rezoning
questionnaire and is separated into responses for each specific section.
1. How is the proposed rezoning consistent with the policies of the Weld County code,
chapter 22? If the proposed rezoning is not consistent with the Comprehensive Plan,
explain how the proposed rezoning will correct what the applicant perceives as faulty
zoning, or how the proposed rezoning will fit with what the applicant perceives as the
changing conditions in the area.
Per 22 -5 -BOA, a goal of the County is to conserve lands which contain commercial
mineral deposits for potential future use. This site contains a valuable commercial deposit
of sand and gravel located in the alluvium of the South Platte River which is available for
extraction.
22-5-80. . M. Policyl.3 indicates that the area should be zoned such that the property
may be mined with a Use by Special Review permit. Mining is not an allowable land use
when the zoning is Residential.
22-5-80 B CM.Goal 2 states "Promote the reasonable and orderly development of mineral
resources." There are other mines are within one -quarter mile or less of the site. This
indicates that the parcel proposed to be mined in this application is in a reasonable area
for sand and gravel extraction activities and the orderly development of the resource can
occur.
2. How will the uses allowed by the proposed rezoning be compatible with the
surrounding land uses? Include a description of existing land uses for all properties
adjacent to the subject property.
The surrounding land uses include uses allowed on properties with agricultural zoning.
The uses include irrigated agriculture land to the west, north, and east, residences
associated with the irrigated lands to the west, north, and east, a gravel mine to the west,
residences to the southwest, and vacant land, commercial/industrial businesses, a
residence, and a gravel mine to the south. The site is bounded by County Road 41 % I
Balsam Avenue on the west and County Road 62 / E C street to the North, and County
Road 43 to the east. The proposed rezoning will allow gravel mining of the property
through a Use by Special Review permit, which is consistent with uses permitted on
agricultural zoned properties.
Sand and gravel operations are located in areas similar to this along the Poudre River
corridor as evidenced by other mines being in close proximity to this site. The end use for
the site will be a lined water storage reservoir which is compatible with the agricultural
nature of the general area.
3. Will the property use a septic system or public sewer facilities?
The scale house for the proposed mining will use portable sanitary facilities. The existing
house on the property has a septic system, permit numbers G19940549 & G19949164.
The septic system permits are attached.

4. Who will provide adequate water, including fire protection, to the property?
Bottled water will be used for domestic use. There will be no irrigation on the property.
Water taken from the pit dewatering once ground water is exposed will be used for dust
suppression and washing if the operator chooses to wash the material. Prior to ground
water being exposed the operator will utilize City of Greeley potable water for dust
suppression. The operator will purchase potable water from the City of Greeley. The
operator plans to obtain a fire hydrant meter from the City of Greeley to use water from the
fire hydrant at the intersection of Hwy 263 and Balsam Avenue. This hydrant will also be
used for fire protection water by the Western Hills Fire Protection District, who provide fire
protection through a contract with the City of Greeley.
A well permit has been obtained for the use of groundwater at the mine. A copy of the
approved well permit is attached.
5. Does the property have soils with moderate or severe limitations for construction? If
yes, the applicant shall submit information which demonstrates that the limitations
can be overcome.
The soils do not have moderate or severe limitations for construction. In general, the site
consists of silts and clays overlying sand and gravel deposits. The silt/clay and sand and
gravel will be excavated and either sold or used to reclaim the mining slopes. Permanent
structures are not planned for the site. If a permanent structure is constructed on the site
in the future, an engineering design will be done for the structure to ensure that its
foundation is appropriate for the soils found where it is constructed. Soils reports from the
N RCS are attached.
6. Is the road and/or highway facility providing access to the property(ies) adequate to
meet the requirements of the proposed zone district? If not, the applicant shall supply
information demonstrating the willingness and financial capability to upgrade the
road and highway facilities.
The existing roadway that provides access to the property is adequate to meet the
requirements of the proposed change of zone. The property is part of the proposed
amendment/expansion of the Derr Pit gravel mine. The Derr Pit currently is operating with
an approved access permit for the mine. The traffic volume will not increase as a result of
the expansion of the mine.
7. Is the change of zone area located in a Flood Hazard Overlay District?
According to the Federal Emergency Management Agency Flood Insurance Rate Map
(FIRM) Community Panel No. 080266-0629C, revised September 28, 1982, the change of
zone area does not lie within a flood zone area.
8. Is the change of zone area located in a Geologic Hazard Overlay District?
According to the "Geologic Hazard Area Map of Potential Ground Subsidence Areas in
Weld County, Colorado", dated May 10th, 1978, the site is not in a geologic hazard area.

9. Is the change of zone area located in the AP (Airport) Overlay District?
Based on the Greeley -Weld County Airport "Airport Master Plan", Exhibit IV "Airport
Airspace (Far Part 77 Surface)", dated March V, 2004, the site is in the Weld County
Airport overlay district area. The permit applicant has obtained confirmation from the FAA
that there is a determination of no hazard to air navigation based on the Aeronautical
Study No. 2008-ANM-561-OE.
