Explain, in detail, the proposed amendment to the property. The Applicant ("DCP") seeks a Use by Special Review permit to operate a business out of the existing building constructed on site to allow for office space, seed processing and light manufacturing, and the storage of SIP (Structural Insulated Panels) Panels, excavating equipment, and other oil and gas support equipment. 2. Explain how this proposal is consistent with the intent of the Comprehensive Plan pursuant to Chapter 22 of the Weld County Code. Pursuant to Section 23-3-20 of the Weld County Code, oil and gas support facilities are allowed as a matter of right in the agricultural zone district. In addition, Section 22-2-20 2.A Policy 7.2 allows for the conversion of agricultural land to non -urban residential, commercial and industrial uses when the subject site is in an area that can support such development. The proposed site is located near the Town of Hudson and adjacent to US. Highway 76. The proposed use will allow the Applicant to maintain most of the subject parcel in agricultural production while also permitting the Applicant to convert the existing building to commercial use. 3. Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Pursuant to Section 23-3-40 of the Weld County Code, any use permitted as a Use by Right in the Commercial or Industrial zone districts may be permitted as a Use by Special Review in the Agricultural Zone istrict. In addition, mineral resource development facilities may also be permitted as Use by Special Review in the Agricultural Zone District. The proposed use will allow the Applicant to maintain most of the subject parcel in agricultural production while also permitting the Applicant to convert the existing building to commercial use. 4. What type of uses surround the site (explain how the proposed use is consistent and compatible with surrounding land uses). This parcel is surrounded by agricultural land and land which has been converted to commercial uses. There are also several residences in the vicinity. The proposed use is compatible with surrounding uses due to the proximity of the parcel to U.S. Highway 76 and the fact that no additional structures will be constructed on site, which will allow the applicant to maintain most of the site in agricultural production. 5. What are the hours and days of operation? 7:00 a.m. to 6:00 p.m., Monday thru Friday, except in the case of emergency. 6. List the number of full time and/or part time proposed to work at thissite. The Applicant does not expect more than 10 employees on site at any given time. 7. If shift work is proposed include the number of employees per shift. No shift work is proposed. 8. List the number of people who will use this site. Include contractors, truck drivers, customers, volunteers, etc. In addition to the 10 employees identified in response to Question 6, the Parcel may also be used from time to time by up to 4 additional agricultural workers. 9. The site is currently cultivated (pumpkins were planted last year). 13. Describe the type of fence proposed for the site. The storage area will be enclosed by a six-foot chain link fence. 14. Describe the proposed screening for all parking and outdoor storage areas. Applicant proposes enclosing each building envelope with a chain link fence. For security reasons, Applicant does not propose screening those areas 15. Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. The building and storage yard will revert to an agricultural accessory use when the Use by Special Review activity terminates. 16. Who will provide fire protection to the site? Hudson Fire Protection District 17. List all proposed on -site and off -site improvements associated with the use and a timeline of when you will have each one of the improvements completed. The building has already been constructed. MRH anticipates constructing two additional buildings as set forth on the proposed site plan. Applicant anticipates all additional on -site improvements will be completed within two months after approval of the USR. There are no off -site improvements contemplated. ENGINEERING QUESTIONS 1. Describe how many roundtripsiday are expected for each vehicle type: Passenger Cars/Pickups, Tandem Trucks, Semi-Truck/Trailer/RV. An average of 5 semi -truck roundtrips is expected per day. An additional 20 passenger roundtrips are expected per day. 2. Describe the expected travel routes for site traffic. Traffic is anticipated to come from the north along CR 43 which connects State Highway 52 and CR 12. Some traffic may come from the south and the I-76 frontage road, although CDOT has plans to close off a portion of the frontage road. 3. Describe the travel distribution along the routes. It is anticipated that 75% of the traffic will come from the north along CR 43 and the remaining 25% of traffic will come from the south along CR 43. 4. Describe the time of day that you expect the highest traffic volumes from above. It is anticipated that the highest traffic volumes will be from 7-8 a.m. and 4-6 p.m. 5. Describe where the access to the site is planned. An access onto WCR 43 has been completed and approved by the Weld County Department of Public Works under Permit No. AP -17-00638. 6. The drainage design shall meet the requirements of the Weld County Code and commonly accepted engineering practices and methodologies. A detention pond design (or other stormwater mitigation design) is appropriate for projects which have a potential to adversely affect downstream neighbors and public rights -of -way from changes in stormwater runoff as a result of the development project. The design engineer's role is to ensure adjacent property owners are not adversely affected by stormwater runoff created by development of the applicant's property. At this time, does 0SI contribute to overtopping? I think maybe a phone call or a meeting would be beneficial to discuss the top paragraph of page 11. 2. Outlet Pipe - The outlet pipe appears to go onto the property to the south. An easement is required for this construction. How does the outlet pipe interact with the pipeline that it crosses? Section 23-12-90.A.5 states "The outlet pipe must contain a minimum of two concrete cutoff walls embedded a minimum of 18 inches into undisturbed earthen soil. The cutoff walls must be a minimum of 8 inches thick. The outlet pipe bedding material must consist of native earthen soil, not granular bedding material, to at least the first downstream manhole or daylight point." Show these anti - seep collars on the construction drawings. 3. Please provide digital copies of the Construction Drawings. The basin lines do not show up on the scanned copies and much of the font cannot be read. There may be additional comments on the construction drawings due to not being able to review the text. 4. Provide details for the 10' x 2' box culvert crossing. Provide details for the three 30" culvert and two 30" culvert crossings. Swales G -G and C -C do not appear to be deep enough to accommodate a 30" culvert and 12" of cover. This may be due to the minimum freeboard being shown. 5. What is the overtopping of the driveway in the 10 and 100 year storms? Can emergency equipment access the site if required during the 100 year storm? 6. How does $6 actually convey to swale F -F? (this may be clarified with digital drawings mentioned in #3) 7. Please clarify the flow path for Combo (S1, S3, S4, S5, 051, OS3) versus the flow path for Tributary to Pond (51, S3, 34, S5, $6, 37, 033). The Combo that flows to swale E -E has a time of concentration of 57 minutes and the Tributary to Pond group has a time of concentration of 32 minutes. Is this due to the time of concentration of OS1? 8. Per USDCM, the Froude Numbers for Swales A -A, D -D, and E -E required permanent erosion control. 9. Swale H -H - C5 shows 3" of freeboard and the report indicates that there will be 1' of freeboard. The report indicates that the swale will be riprap lined and the drawing appears to show concrete. Also, there are two Swale H -H details and no detail for Swale J -J. 10. How will headwater depth fit in Swales C -C and E -E? Swale C -C on C5 shows 2' 8" of depth minimum and report indicates HW of 2.8'. Swale E -E on C5 shows approx. 2' 5.5" depth and the report indicates HW of 2.1 ft. 1 foot freeboard is required. 11. C5 shows less than 1' of freeboard on swales E -E and G -G and I cannot read the freeboard on D -D. If less than 1 foot is proposed for D -D (less than 50 cfs) a variance request may be submitted per 23-12-70.B.2. E -E and G - G must have 1' of freeboard. 12. Once the revised design and drainage report have been submitted, the County may provide additional comments in addition to the ones listed above. Depending on the complexity of the changes made, a full 28 -day review period may be required. 13. Please provide a written response on how the above comments have been addressed when resubmitting the drainage report.
