RESOLUTION RE: ACTION OF BOARD AT PROBABLE CAUSE HEARING, PCSC19-0020, CONCERNING USE BY SPECIAL REVIEW PERMIT, USR-988 - COUNTY RV STORAGE, LLC WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, on the 25th day of November, 2019, a Probable Cause Hearing, PCSC19-0020, was held before the Board to consider setting a Show Cause Hearing to determine whether or not County RV Storage, LLC, 3230 47th Avenue, Greeley, Colorado 80634, was in compliance with certain Conditions of Approval and Development Standards contained in Use by Special Review Permit, USR-988, for a home business (recreational vehicle storage and daycare facility) in the A (Agricultural) Zone District, and WHEREAS, the alleged violations were said to be occurring on property described as part of the SW1/4 of Section 23, Township 5 North, Rage 66 West of the 6th P.M., Weld County, Colorado, and WHEREAS, after hearing testimony from the Department of Planning Services, the Board finds that pursuant to the procedure as set forth in Chapter 2, Administration, the Weld County Code there is sufficient probable cause to schedule a Show Cause Hearing to consider whether or not said Use by Special Review Permit should be revoked for failure to comply with certain Conditions of Approval and Development Standards, and WHEREAS, the Board shall hear evidence and testimony from all interested parties at said Show Cause Hearing. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that a Show Cause Hearing be scheduled to determine whether or not Use by Special Review Permit, USR-988, issued to County RV Storage, LLC, should be revoked. BE IT FURTHER RESOLVED by the board that the date for the Show Cause Hearing shall be January 20, 2020, at or about 9:00 a.m., in the Assembly Room of the Weld County Administration Building, 1150 O Street, Greeley, Colorado. BE IT FURTHER RESOLVED by the Board that the issue to be considered at said Show Cause Hearing is whether or not the permit holder is in compliance with the following Conditions of Approval and Development Standards: 1. The Site Specific Development Plan and Special Review Permit for a home business (recreational vehicle storage and daycare facility) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. 18. The property owner or operator shall be responsible for complying with the operational Standards of Section 24.6 of the Weld County Zoning Ordinance. Any other changes shall be filed in the office of the Department of Planning Services. 21. The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. The County RV Storage, LLC Facility, located at 3230 47th Avenue Greeley, CO, is not in compliance with USR- 988 for a Site Specific Development Plan and Special Review Permit for a home business (recreational vehicle storage and daycare facility) in the A (Agricultural) Zone District. The 6,912 square foot Pole Frame addition permitted in October of 2019 is being used as a baseball and softball training facility with pitching machines, full batting cages plus any other equipment you would need to train and is considered a commercial recreational facility. Baseball and softball teams/clubs practice at the facility along with camps and events held related to baseball and softball. Per Section 23-1-90 of the Weld County Code, Commercial Recreational Facility is defined as the following: Commercial Recreational Facility: Includes, but is not limited to, bowling alleys, health spas, swimming pools, tennis courts, miniature golf facilities or water skiing operated on a commercial basis by the paying public. Commercial Recreational Facilities do not include rodeos, roping arenas, racing facilities, or shooting ranges." Per Section 23-3-40.H. of the Weld County Code a Commercial Recreational Facility is a use permitted as a Use by Special Review in the A (Agricultural) Zone District and shall follow the criteria per Chapter 23 Division 4 Section 23-2-200 of the Weld County Code. The following review provides background to the Facility's non- compliance. July 8, 2019 A Commercial Building Permit Application (CMA19-0058) was submitted on July 8, 2019 to the Weld County Building Department for a 6,912 square foot Pole Frame addition to an existing commercial building built in 1980. The applicant had concerns with the building fees related to the Commercial Building Permit. According to the applicant, it was for "dry storage" only and is not associated with a commercial use or existing USR. Weld County Department of Planning and Building Inspection required a signed letter by the property owners stating the intended use of the proposed structure and a revised USR Map to represent the new structure in lieu of a planning permit process such as a major or minor USR amendment. PCSC19-0020 Memo ( County RV Storage LLC Page 1 I'/as ;o19-cr$59 pL.og9 July 11, 2019 A signed letter of intent from the home owners, Erik and Shawna Disparti was submitted and signed on July 11, 2019 stating the following: "The 72' x 96' proposed building at 3230 47th Ave, Greeley CO will be used for dry storage. We do not intend to store RV's, trailers, automobiles, or other recreational vehicles within the walls of the 72' x 96' building." October 9, 2019 A revised map of USR-988 was submitted to the Weld County Planning Department showing the location of the proposed 6,912 square foot structure. October 17, 2019 After review and approval of the signed letter of intent by the property owners and submittal of the revised USR- 988 Map, Weld County Department of Building Inspection created a new Accessory Structure Alteration Building Permit (ASA19-0071) which replaced the pending Commercial Building Permit (CMA19-0058). CMA19- 0058 was then voided. October 18, 2019 Weld County Department of Building Inspection further questioned if there would be electric service in the new 6,912 square foot building. Mr. Disparti further stated " No this is just dry storage" in an email dated October 18, 2019. ASA19-0071 was approved and released for the 6,912 square foot personal building without electricity or other utilities. October 22, 2019 Building inspections took place and the following inspection types were reviewed based on criteria for a Utility Pole Barn with no electric service: Setbacks, Final Building, Footing/Caisson, Rough Framing, and Final Approval. All inspection types passed and were approved by Building Inspection. November 6, 2019 Weld County Planning Department — Zoning Compliance received an anonymous complaint that detailed a commercial recreational facility is in operation on the property which was further substantiated by a recent Greeley Tribune article, an active Facebook page @TheYard2020; and, website www.gotheyard.com; all sources advertising the commercial recreational facility. November 12, 2019 Probable Cause letter dated November 8, 2019 was sent to the property owner via certified mail. November 13, 2019 Weld County Planning Staff performed a field check on November 13, 2019. A freestanding sign is on site specifying The Yard along with the County RV Storage Facility. There were further on -site directional signs detailing The Yard was located in the back of the property. The subject property has two access points onto 47th Avenue in the shape of a horseshoe. It appears that both access points are used for County RV Storage and The Yard. PCSC19-0020 Memo I County RV Storage LLC Page 2 Violation Based on the evidence obtained, the Department of Planning Services determined that the property is not in compliance with the current land use permit, USR-988. The Facility is in violation of Development Standards No. 1, 18, 20 and 21 which state: Development Standard # 1 of USR-988 states: The Site Specific Development Plan and Special Review Permit for a home business (recreational vehicle storage and daycare facility) in the A (Agricultural) Zone District as submitted in the application materials on file in the Department of Planning Services and subject to the Development Standards stated herein. Development Standard # 18 of USR-988 states: The property owner or operator shall be responsible for complying with the operational Standards of Section 24.6 of the Weld County Zoning Ordinance. Development Standard # 20 of USR-988 states: The Special Review area shall be limited to the plans shown herein and governed by the foregoing Standards and all applicable Weld County Regulations. Major changes from the plans or Development Standards as shown or stated shall require the approval of an amendment of the Permit by the Weld County Planning Commission and the Weld County Board of County Commissioners before such changes from the plans or Development Standards are permitted. Any other changes shall be filed in the office of the Department of Planning Services. Development Standard # 21 of USR-988 states: The property owner or operator shall be responsible for complying with all of the foregoing Development Standards. Noncompliance with any of the foregoing Development Standards may be reason for revocation of the Permit by the Board of County Commissioners. The Department of Planning Services requests the Board of County Commissioners review the operation of USR-988 and Development Standards #1, 18, 20 and 21. County RV Storage LLC was notified of the Probable Cause hearing in letter dated November 8, 2019. Staff contacted the property owner via telephone, to notify a Probable Cause letter was. Following the delivery of the Probable Cause letter, the property owners and staff met on November 15, 2019 to further discuss the Probable Cause Hearing. Per Section 2-4-40.D of the Weld County Code, "At the conclusion of the presentation of evidence, the Board of County Commissioners shall make an oral decision. The decision shall be to either dismiss the case, continue the case to a time specified in the future or to set the case for a formal show -cause or other type hearing at a time specified in the future." If the Board determines at the public hearing that there is probable cause that County RV Storage LLC is not in compliance with USR-988, Planning Staff requests the Board of County Commissioners scheduled a Show Cause hearing for December 18, 2019 or the earliest Show Cause public hearing to consider revocation of the USR or require a major amendment of Use by Special Review permit USR-988 be submitted in thirty (30) days. Well, maybe it should add "Get Better!" Once inside, all you have to be is a baseball and softball junkie to realize you've hit the mother lode. Batting cages, pitching machines, a pitching mound — and plenty of the best mixture of dirt, and clay you can buy. In layman's terms, it's a hill -sized infield. The Yard, 3230 47th Ave., is quickly becoming a hot spot for baseball and softball fanatics. "You can do any kind of baseball or softball activity you can think of. We even have Wiffle balls." For a fee of $85 per hour, the facility is open to the public. Eventually, the dirt and clay mixture was delivered. "It's the same material used at Tom Roche Field at University High," explained Erik Disparti, who coincidentally is an assistant baseball coach at U E -I . "It's a gem," said University High baseball coach Casey Miller, whose team has won back-to-back Class 3A state titles. Miller fielded inquires from Disparti as the facility was being built, and added, "I stepped foot in there earlier this week and it's something special, for sure.
