RE: GRANT CHANGE OF ZONE FROM A-AGRICULTURAL ZONE DISTRICT TO
H-HIGH DENSITY ZONE DISTRICT FOR SEARS AND COMPANY, 1221
EIGHTH AVENUE, GREELEY, COLORADO 80631
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
O Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, a public hearing was held on the 7th day of November,

1979 at 2 : 00 o 'clock p.m. for the purpose of hearing the petition
of Sears and Company, 1221 3th Avenue, Greeley, Colorado 80631 ,
requesting a change of zone from A-Agricultural Zone District to
H-High Density Zone District for the following described parcel of

WHEREAS, Section 8 . 2 and 8 . 3 of the Weld County Zoning Resolu-
tion authorizes the Board of County Commissioners to grant a change
of zone upon the showing by the petitioner of certain facts , and
WHEREAS, the Board of County Commissioners heard all of the
testimony and statements of those present, has studied the request
of the petitioner and the recommendations of the Weld County Plan-
ning Commission, and having been fully informed, is satisfied
that the request for re-zoning complies with the Weld County Com-
prehensive Plan and the conditions set out in Section 8 . 2 and 8 . 3
of the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of -Weld County, Colorado that the petition of Sears
and Company for a change of zone from A-Agricultural Zone District
to H-High Density Zone District be, and hereby is, granted subject
to the development standards as recommended by the Weld County
Planning Commission.
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Planning Commission recommendations
dated September 1-8, 1979 be, and hereby are, adopted as the

findings of fact of the -Board of County Commissioners in this
matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 7th day of
November, A.D. , 1979 .

The following business was transacted:
I hereby certify that pursuant to notices dated October 1, 1979,
duly published October 4th and October 25th, 1979 in the_latteville.Ilerald,
a public hearing was held on the request of Sears and Company, Realtors
for a _Change of Zone from A (Agricultural District) to E (Estate District) ,
a Change of Zone from A (Agricultural District) to H (High Density District) ,
and to consider the preliminary plat of Allison Tarn subdivision. She Planning Staff
read the favorable recommenaations and development standards for the
Change of Zones into the record. The Planning Camlission's favorable
recommendation and conditions regarding the_Preliminary Plat for Allison
Farm were also read into the record. Mr. Doug Sears, representing the
applicant, presented the cases. John Hall commented _on the concerns of
the Health Department regarding the septic system. The applicant and
the Board discussed said concerns. Robert Bechtholflt, an adjacent
landowner, presented a petition signed by neighbors bordering the Allison
Farm Subdivision. Said petition protested the proposed RV parking area
in the ₹relief that such a parking area is not in keeping with the standards
already set by the surrounding area. Several adjacent landowners were
present and voiced their objections to these requests. (Tape change 79-142)
Doug Sears responded and answered the objections raised. After _deliberation,
Commissioner Steinmark made a notion to accept the recommendation of the
Planning Commission and approved the Change of Zone from A to E, based on
- the fact that said change would be compatible with the surrounding land
uses, that it appears that adequate water and sewer service can be made
avail-able, further that the development standards are accepted. Commissioner
Dunbar seconded the motion and it carried unanimously. Commissioner Dunbar
made a notion to grant the Change of Zone from A to H including the develognent
standards. Commissioner Steinmark seconded the notion and it carried
unanimously. Commissioner Roe made a notion to approve the Preliminary
Plat for Allison Farm, amended condition #1 to read as follows: 1. Septic
systems may be allowed in the -first filing of Allison Tarm Subdivision.
At such time as the City of Greeley sewer service is available the issuance
of septic system permits will cease ; and under #2 include d) She designs
for mains and laterals be shown on the final plat and construction costs be
included in the improvements agreement. Commissioner Steinmark seconded
the notion and it carried unanimously.

Dear Mr. Carlson;
Reference DOCKET NO. 79-88 and DOCKET NO. 79-89 applicable
to the request by Sears and Company, Realtors to rezone
the Allison Farm from Agricultural to Estate and High Density.
This matter is scheduled for hearing by your beard at 2:00
P.M. on November 7, 1979.
The preliminary plans for this rezoning have been approved
by the City Planning Commission and Weld County Planning
Commission over certain objections by surrounding residents
of Highland Hills and Westridge. In their decision process
they also ignored the objections and recommendations made by
the Weld County Health Department. Due to the high water level
and solid sandstone formations underlying the proposed develop-
ment the Health Department dyes not approve the use of septic
tanks. The Health Department feels the only safe and sanitary
way fnr disposal of the waste water and sewage is through the
use of the normal Greeley city sewer disposal system. This
centralized sewer system should be available for hookup by this
proposed subdivision within the next few months. The Health
Department is also against locating the R.V. Storage Area next
to the gas pumping station currently located on the property.
The Health Department study and recommendations have been made
a part of the Allison Farm rezoning package for your review in
making your final decision.
We have personally contacted a majority of the property owners
who presently live in the western portion of Highland Hills and
without exception they have expressed their -epnosition to locat-
ing an R.V. storage lot (eventually resulting as a sore eye)
along the west side of 59th Avenue not only because of the
reasons put forth by the Health Department but also due to the
depreciating effect this would have on nearby residential
property. With the current high-type development (Aims College,
Family Sports Center, Skating Rink) in the vicinity of West 20th
Street and 59th Avenue along with the increased traffic antics-

pated, requiring subsequent upgrading of these traffic routes,
we feel any R.V. storage 1st approved for construction should
be located en the back side of the development, or at least
net along side of a main traffic artery like 59th Avenue.

DEVELOPMENT STANDARDS
Land Use
1 . H-UD area may include all uses permitted in the "H" High Density
Residential District of the Weld County Zoning Resolution.
2 . Interim use until such time as a lot is sold shall not be for
other than its present use. The owner shall be responsible for
maintaining the premisis to eliminate weed growth in excess of
twelve (12) inches in height where said premisis is not utilized
for agricultural production.
3. Open spaces, identified as "Finger Lakes" (Outlot F) shall be
developed for the use and benefit of the Allison Farm Subdivision.
Ownership and maintenance of the Outlot F area shall be defined in
the Planned Unit Devleopment documents filed with the Final
Subdivision plat .
4. Sewage disposal shall be by City of Greeley municipal sewer or
an equivalant package treatment. Any such package treatment system
must first be approved by applicable local, state and federal
agencies having jurisdiction on the site .
Density
1 . No more than one (1) dwelling unit 'shall be allowed on the individually
platted lots within the H-UD area. The area described as Outlot A
shall have a maximum density not to exceed a total of sixty (60)

ALLISON FARM
Re-zoning and Subdivision Application Statements
It is our feeling that while the policies of the Weld County Com-
prehensive Planning do not contemplate the type use proposed in our sub-
division, the changing conditions of the area clearly demonstrate both a
-demand on the part of the public as well as a need for Allison Farm as
herein proposed. Since the time of adoption of both the Greeley Com-
prehensive Planning and the Weld County Comprehensive Planning, there
has been re-zoning and/or substantial new construction within the im-
mediate area of Allison Farm, i .e. , Westridge Subdivision, Bird Sub-
division, Knaus Subdivision, Hiland Knolls. Several of these consist
of one (1) acre tracts served by septic systems designed for single
family residential use. Allison Farm contemplates that each property
owner shall construct and maintain his/her own sewage-septic system;
however, the layout of utility easements lends itself to these property
owners being able to connect with central Greeley sewer services, at
such time in the future that such services are available should the pro-
perty owners so desire. This is especially true in the requested multi-
family zone where it is proposed that a package septic system shall be
constructed and maintained to handle the affluent discharged from this
Area, said system to be constructed in a logical and accessible location
thereby minimizing the expense should it be deemed necessary to tie in
to central sewage services. It should be pointed out here that at this
time, the City of Greeley does not intend to serve this area with pub-
lic sewage services until 1984 at the earliest. It would seem to us
that the changing factors of this area would dictate growth and devel -
opment before 1984.
The aforementioned subdivisions are presently served by the City
of Greeley water or Central Weld Water. Allison Farm can and will be
served by City of Greeley water services. Also, all said subdivisions
do not have or intend to construct curb, gutters and sidewalks. The
-economics of the development of 20,000 square foot lots, or greater, does
not lend itself to providing these improvements and the size of said lots
Allows retention of run-off water to be kept on individual lots. The
construction of paved streets in Allison Farm will be in total compliance
with County specifications.
In view of all the factors mentioned herein, we feel that Allison
Farm is both timely and well suited for the location.
The fact that there are two (2) subdivisions with the same basic
concept as Allison Farm, contiguous to this property, would suggest that
the proposed 20,000 square foot lots, or greater, are compatible with
the surrounding areas. The proposed multi-family area located on the
west portion of Allison Farm has been designed and coordinated to blend
in with the larger lots in the subdivision.
As Greeley continues to grow to the West, (with the present Greeley
City limits being little more than one (1) mile east of this site at the
time of this application) more and more multi -family/higher density areas
will be requested. Highland Hills presently has approximately fifty
multi-family residences within one mile of this site. 0Ur application
represents a natural trend and demand toward this type of use. Further,
it should be pointed out that the land uses in the immediate area are
becoming more varied as our community' s growing population expands to
the west. ARIS, Greeley Family Sports Center, Geriatrics, Alms Community
College, and the proposed skating rink support this trend of changing land
use.
In summary, we feel that Allison Farm is an exciting, compatible, and
well planned development.
ALLISON FARM P.U.D.
DEVELOPMENT ST-ANDARDS
1 . Permitted uses:
All those uses as listed in the Weld County Zoning Regulations , Section
6.6 in effect at the date of approval of this P.U.D. by the Board of county
Commissioners. All uses must be consistent with the City of Greeley Zoning
Code and Requirements. The use shall be reviewed for compliance at the time
of the final site plan review.
2. Si-gns:
Signs must comply with applicable requirements of Weld County Zoning
Resolution. Applicable permits shall be obtained.
3. Access:
Access shall be restricted onto the site as designated on the plat.
4. Parking:
All parking will be on site, furnished by the individual lot owners. Such
parking facilities must comply with the Weld County Zoning Resolution
requirements and applicable requirements of the City of Greeley which
may be in force at the time of construction upon the site.
5. Interim Land Use:
Until such time as a lot is sold said lot shall not be used for other
-than its present use. The owner shall be responsible for maintaining the
premises so as to eliminate weed growth in excess of 12 inches in height.
6. Landscaping:
(a) A minimum of 20% of each lot shall be maintained as landscaped area.
(b) A minimum of 15% adjacent to the public right-of-way shall be landscaped.
7. Drainage:
A drainage study will be submitted and subject to approval in the final
site plan review prior to issuance of building permits for each lot. No
runoff will be allowed beyond limits as illustrated on the final plat.

The following comments are in regards to a requested review of a zoning
change from Agriculture "A", to "E" Agricultural Zone District with Unit
Development for Sears and Company Realtors, located in a portion of the
NzNE3/4 and EzNW4 of Section 16, Twp. 5N, Range 66W, Weld County, Colorado.
The areas in question are made up of the following soil types:
Olney fine sandy loam, 1 to 3 percent slopes (21B-B) : This is a prime
farmland soil when under irrigation. This soil makes up approximately
ten percent of the area. This soil is not considered high potential if
not irrigated.
Otero sandy loam, 1 to 3 percent slopes (53-B) and Otero sandy loam, 3
to 5 percent slopes (53-C) : These are prime farmland soils when under
irrigation. When not under irrigation, they are not considered high
potential cropland. They make up approximately 75 percent of the des-
cribed area.
Nelson fine sandy loam, 3 to 9 percent slopes (53M-CD) : This is not prime
irrigated farmland nor high potential non-irrigated cropland. This soil
makes up about ten percent of the described area. It is a moderately deep
soil with sandstone within 20 to 40 inches of the surface.
Loup-Boel loamy sands, 0 to 3 percent slopes (49-AB) : This is a deep, poorly
drained soil found on stream bottoms and along drainageways. They typically
are found with water tables ranging from the soil surface to 24 to 36 inches
in depth. This soil is not prime irrigated farmland nor is it high potential
non-irrigated farmland. This soil, and the Aquolls and Aquents soil, make
up approximately five percent of the area.
Aquolls and Aquents, flooded (34-U) : These are nearly level soils on smooth
plains in depressions and along bottoms of natural drainageways. They are
deep, poorly drained soils that are usually subject to excessive runoff and
a water table at or near the surface in the spring and during the peak
irrigation season.

Soil Interpretation for Building Sites:
Slight to no problems: Olney fine sandy loam and Otero sandy loam, 1 through
5 percent slopes.
Dwellings without basements: Nelson fine sandy loam has a moderate limitation
due to potential shallow depth to sandstone.
Dwellings with basements: Nelson fine sandy loam has a severe limitation due
to possible depth of sandstone ranging from 20 to
40 inches.
Loup-Boel and Aquolls and Aquent soils are severely limited to building site
development due to wetness and possible flooding.
Septic tank absorption systems can be installed in Olney and Otero soils with
slight to no problems. Nelson, Loup-Boel and Aquolls and Aquents soils are
severely limited for this purpose due to shallow depth to consolidated rock,
or the presence of a water table and flooding, respectively.
I feel the zoning change should be considered with the previous comments in
mind. The developer should provide information as to how these problems can
be resolved or show that the concerns do not exist. Once this is done, I
would recommend the rezoning request be granted.

We have reviewed the _proposed zoning change, case numbers Z-324 :78 :8
and Z-323 :79:7. These applications indicate that sewage disposal
will be accomplished 'by individual on-lot systems for both the estate
and high density areas. Geologic conditions possibly could influence
the suitability of such a disposal method.
We feel that various methods of sewage disposal should be evaluated
for the development because of the large parcel size and the high
density of development. This evaluation should consider "hooking-up"
to an established sewage disposal district, construction of a central
sewage disposal facility, and the development of an operation and
maintenance program.
Until alternate methods of sewage disposal have been evaluated and
a system for sewage disposal formulated, we recommend that this land
not be rezoned.
