RE: APPROVE VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-1224 - BARTON
LAND AND CATTLE, INC., C/O BRIAN AND DENISE BARTON
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution dated May 26, 1999, the Board approved Use by Special
Review Permit, USR-1224, for a Commercial Recreational Facility (roping arena) in the
A (Agricultural) Zone District, for Roy and Jacqueline Nelson, on the following described real
estate, to -wit:
Lot B of Recorded Exemption, RE -1670; being a part
of the N1/2 NE1/4 of Section 8, Township 4 North,
Range 64 West of the 6th P.M., Weld County,
Colorado
WHEREAS, the Department of Planning Services administratively approved a Recorded
Exemption, RECX13-0078, on October 28, 2013, and approved an Amended Recorded
Exemption, 1AMRECX19-13-0078, on June 18, 2019, which included the following condition of
approval:
2.A. There is a Use by Special Review Permit, USR-1224, Reception #4054272, for a
Roping Arena in the A (Agricultural) Zone District. This USR encompasses portions
of existing and proposed Lot B. The applicant shall address the continued
operation of USR-1224 and which lot(s) it is to be associated with. If USR-1224
will continue operation on the expanded Lot B, a major amendment to USR-1224
shall be recorded prior to recording the Recorded Exemption plat. If the applicant
wants to remove USR-1224 a complete vacation should be done prior to recording
the Recorded Exemption plat.
WHEREAS, the Board has received a request from Barton Land and Cattle, Inc., do Brian
and Denise Barton, 27995 County Road 46, Kersey, Colorado 80644, to vacate said Use by
Special Review Permit, USR-1224, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit, USR-1224, be, and hereby is, vacated.

NARRATIVE: The applicants have been administratively approved on June 18, 2019 for a lot line adjustment
permitted by Amended Recorded Exemption 1AMRECX19-13-0078 located on Lot A and Lot B
of Recorded Exemption RECX13-0078. 1AMRECX19-13-0078 included the following Condition
of Approval:
2.A. " There is a Use by Special Review Permit USR-1224 Reception # 4054272, for a Roping Arena in the
A (Agricultural) Zone District. This USR encompasses portions of existing and proposed Lot B. The
applicant shall address the continued operation of USR-1224 and which lot(s) it is to be associated with.
If USR-1224 will continue operation on the expanded Lot B, a major amendment to USR-1224 shall be
recorded prior to recording the Recorded Exemption plat. If the applicant wants to remove USR-1224 a
complete vacation should be done prior to recording the Recorded Exemption plat."
Brian and Denise Barton proceeded to request a complete vacation of USR-1224 on Lot B of Recorded
Exemption RECX13-0078. The vacation request letter, dated and submitted on August 6, 2019 is attached to
the memorandum.
The Department of Planning Services staff has reviewed this request and recommends that this
request be approved.
If approved, the BOCC Resolution will satisfy condition 2.A of the 1AMRECX19-13-0078 administrative review
and the 1AMRECX19-13-0078 plat may proceed with recording.
