WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Commissioners of Weld County, Colorado, at a public hearing held on the 6th day of March, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that the division into two parcels of a certain parcel of land, as shown on the plat known as Recorded Exemption No. 306, being the property of Arthur E. Stanley, described as Part of the Eh of Section 19, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, containing approximately 18. 23 acres , more or less, and being more particularly described as follows : All that part of the East Half (Eh) of Section 19, Township 6 North, Range 65 West of the 6th P.M. , Weld County, Colorado, lying East of the Right of way of the Union Pacific Railroad Company and South of the right of way of the New Cache La Poudre Irrigating Company. EXCEPT right of way as described in instrument recorded in Book 1365, Page 401, Weld County Records. does not come within the purview of the definition of the terms, "subdivision" and "subdivided land" , pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, the Board of County Commissioners of Weld County, Colorado, finds that this particular division of land is not within the purposes of the Weld County Subdivision Regulations and the Board desires to exempt this particular division of land 7 . 780809 from the definition of "subdivision" and "subdivided land" pur- suant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and Section 2-1A (3) of the Weld County Subdivision Regulations. Stanley for a Recorded Exemption. The parcel of land in question is described as Pt . of the Ei of Section 19 , T6N, R65W of the 6th p .m. , Weld County , Colorado. This property is located at the SW corner of State Highway 392 and County Road 39 at Lucerne . The subject property contains 18. 23 acres of Commercially zoned property . The request is to split the property into parcels of 0. 23 acres more or less and 18.0 acres more or less . It is Hr. Stanley ' s desire to designate through his estate planning this division of land to avoid any problems or confusion among his heirs . Each parcel contains an existing set of improvements . The 0. 23 acre parcel will be willed to Mr. Stanley' s wife and the 18. 0 acre parcel will be willed to his son and daughter. Based upon the information submitted and the adopted policies in the county, the Department of Planning Services staff recommends the request be approved for the following reasons : 1. The proposed split conforms with the intent clause of the recorded exemption procedure (Section 9-2 of the Weld County Subdivision Reg- ulations) , and the Weld County Comprehensive Plan in that each resulting parcel would have an existing set of improvements. The use would be compatible with surrounding land uses . 2. The City of Greeley Planning Commission has indicated that they have no objections to the granting of this request .
