RESOLUTION
WHEREAS, a public hearing was held on July 12, 1976, in the chambers
of the Board of County Commissioners of Weld County, Colorado, for the
purpose of hearing the petition of Howard W. Reid, Roggen, Colorado, request-
ing approval of site for the construction of a radio communication tower on the
following described property, to-wit:
That part of the Southeast Quarter (SEA'-) of Section 2, Township 1
North, Range 62 West of the Sixth Principal Meridian, Weld County,
Colorado described as:
Beginning at the Southeast corner (SE Cor) of said Section 2;
Thence South 89°57' West on an assumed bearing along the South
line of said Section 2 a distance of 406. 24 feet;
Thence North 00°03' West perpendicular to said South line a
distance of 40. 00 feet to a point on the North Right-of-Way of
Colorado State Highway No. 52, said point being the True Point
of Beginning;
Thence continuin& North 00°03' West a distance of 225. 00 feet;
Thence North 89 5T East parallel with said South line of Section
2 a distance of 376. 24 feet;
Thence South 00°03' East a distance of 225. 00 feet to a point on
the North Right-of-Way of said Highway No. 52;
Thence South 89°57' West along said Right-of-Way a distance of
376. 24 feet to the True Point of Beginning;
Contains 1. 94 acres, more or less, and
WHEREAS, the petitioner was present, and
WHEREAS, there was no opposition to the request of petitioner for
the location of a radio communication tower, and
WHEREAS, the said requested location for the radio communication
tower is located in an agricultural zone as set forth by the Weld County
Zoning Resolution, and
WHEREAS, according to Section 3. 3 (2) of the Zoning Resolution of
Weld County, said location for the radio communication tower may be
authorized on the approval of the Board of County Commissioners of Weld
County, and
WHEREAS, the Board of County Commissioners heard all the testi-
mony and statements of those present; has studied the request of the petitioner
and studied the recommendations of the Weld County Planning Commission,
and having been fully informed;
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners, that the application of Howard W. Reid, Roggen, Colorado,
to locate a radio communication tower on the premises indicated above be,
and it hereby is granted under the conditions following:
1. That any water and sanitation facilities to be installed shall be
approved by the State Health Department.
2. Subject to securing of the necessary building permits.
3. That petitioner shall restrict development to the plans submitted
for approval by the Board of County Commissioners.

4. That all applicable subdivision and zoning regulations shall be
followed and complied with in accordance with the Zoning Resolutions of
Weld County, Colorado.

B. All uses allowed in the Agricultural District as set forth in
Section 3.3 of the Weld County Zoning Regulations.

INTRODUCTION: Tom David, new County Attorney was introduced to the Planning
Commission.
The Weld County Planning Commission held a regularly scheduled meeting on
Tuesday, July 6, 1976 at 1 :30 P.M. in the County Commissioners Board Room,
first floor, Centennial Building, Greeley, Colorado.

APPEARANCE: Mr. Reid
DISCUSSION: Mr. Reid explained that he wishes to install a station
for the purpose of communicating between the various mobile units
of the farm and his home. The radio tower will be 180 feet in
height. Range is proposed to be 15 to 20 miles. Mr. Reid also
explained that this is slightly over the County line in Morgan
County and Adams County, as well as in Weld County.
Weld County Planning staff recommends approval for the following
reasons: 1 ) A radio tower facility at the proposed location would
appear to be compatible with the neighborhood and surrounding
area; and 2) The Soil Conservation Service has indicated that soils
in the area are stable enough to support the radio tower on a con-
crete pad. SUBJECT TO: 1 ) Acquiring a building permit from the
Weld County Building Inspection Division. COMMENTS: 1 ) A representa-
tive of the Federal Aviation Administration indicated that Mr. Reid
is not required to file for any permit with his agency; 2) A repre-
sentative of the Federal Communications Commission indicated his
agency is not involved in this matter and has no comments; and
3) The Weld County Engineering Department has no objections to
this proposal . Tom Honn explained that the Zoning Resolution does
not have any requirements for lighting on this type of facility. There
is a radio/TV tower adjacent to this property. There are no
water requirements involved with this request. Power service
will come from Morgan County REA. No one in the audience objected.
RESOLUTION: Be it therefore resolved to recommend to the Board of County
Commissioners, approval of this request for a radio tower, subject
to staff recommendations. Motion by Chuck Carlson. Seconded by
J. Ben Nix. A vote of "aye" by Hiatt, Elliott, Kountz, Ashley,
Heitman, Nix, Carlson, and Yost. Motion Carried.
APPLICANT: M.G. and Della Linson Tape 631 (#1671 - 2065)

SUBJECT: Single Family Residence
LOCATION: Pt. SWa Sec. 5 T3N R68W
APPEARANCE: Mr. Linson-and Terry Anderson, Century 21 - Longmont
DISCUSSION: When Mr. Linson purchased the property he did not intend
to sell it but was transferred to CSU. The piece is now planted
in alfalfa. It has ample water. Parcel #2 has a building permit
issued on it. Parcel #1 has an existing farm building on it.
There are approximately 31/2 acres of dryland and 31 acres of irrigated
land involved in Mr. Linson' s parcel . Mr. linson feels that the
appropriate place to locate a building (residence) would be on the
3'2 acres of dryland. Tom Honn explained that in May of 1972 Mr.
Linson and Mr. Luchsinger purchased the 170 acres together. In
1973 Bob Swenson quit claimed his interest to the other three
parties in ownership. In May 1973 Parcel #1 (through recorded ex-
emption) was deeded to Mr. Swenson. In October of 1973 a fifth
party sold parcel #2 to Mr. Hodgson. Parcel #2 is non-irrigated land.
Parcels #3, 4 and 5 were all divided in April of 1974. Weld

Re: Requirements for a Conditional Use
Permit for a Radio Tower
Dear Mr. Reid:
I had a chance to briefly discuss the requirements for a Conditional Ilse
Permit for a radio tower with our staff this morning. In addition to the
items we discussed last Wednesday, the following are required:
(1 ) A certified boundary survey by a registered land surveyor in
the State of Colorado is required of the property for which
the application is made. As we discussed, this survey need
only encompass the area surrounding the tower and not the
entire parcel on which the tower is located.
(2) A complete and accurate legal description of the property is
necessary. This should be the description of the above
required survey.
(3) Ten sets of plans are required. Said plans must include the
applicable items listed under the drawing requirements of the
Weld County Planned Unit Development Check List, a copy of
which has been enclosed. Said plans shall include:
A. Vicinity Map;
B. Conditional Use Permit Plan; and
C. Development Criteria.

RE: Request for a Conditional Use Permit for a radio tower on a parcel
of land located in the SE' of Section 2, T1N, R62W of the 6th P.M. ,
Weld County, Colorado.
Dear Mr. Reid:
Before our office can begin to process the above described request, we
need to have the following items:
1 . The application must be notarized.
2. A legal description of all contiguous property owned upon which
the Conditional Use Permit is proposed to be located must be put on
or attached to the application form.
3. A legal description of the Conditional Use Permit area must be put
on or attached to the application form. This legal description
must be the same as the survey shown on the plat which is being com-
pleted by Mr. DeVore.
4. Our office needs to be supplied with a list of property owners within
500 feet of the contiguous parcel of land on which the radio tower is
proposed to be located.
5. Additionally, it would be helpful for referral purposes if you could
identify who you dealt with at the Federal Aviation Administration
and at the Federal Communication Commission.
