ORDINANCE NO. 312
AN ORDINANCE DISCONNECTING LAND PREVIUOSLY ANNEXED TO THE TOWN OF
NUNN
WHEREAS, on or about December 6, 2014, the Board of Trustees ("Board") of the Town of
Nunn ("Town") annexed to the Town certain real property referred to as the "Younell Annexation;"
WHEREAS, a portion of the Younell Annexation was subsequently subdivided by way of the
Dudley's Minor Subdivision, which was recorded in the real property records of the County of Weld,
State of Colorado, at reception number 4431136 on September 14, 2018 ("Dudley's Minor Subdivision");
WHEREAS, Lot 1 in the Dudley's Minor Subdivision ("Lot 1") is also referred to as parcel
number 045528401001 in the real property records of the County of Weld, State of Colorado;
WHEREAS, the current owner of Lot 1 ("Owner") discovered that the cost of providing water to
Lot 1 in the Town of Nunn is unaffordable and the cost in the county is affordable and for that reason
desires to disconnect Lot 1 from the Town;
WHEREAS, the Town has received from the Owner an application to disconnect Lot 1 from the
Town of Nunn; and
WHEREAS, the Board has reviewed the application to disconnect Lot 1 from the Town and has
determined after giving due consideration to the application to disconnect that Lot 1 is adjacent to the
boundary of the Town and that the best interests of the Town will not be prejudiced by the disconnection
of Lot 1;
NOW, THEREFORE, THE FOLLOWING IS ORDAINED BY THE BOARD OF TRUSTEES
FOR THE TOWN OF NUNN, COLORADO:
Section 1. Lot 1 of the Dudley's Minor Subdivision is disconnected from the Town of Nunn.
From and after the effective date of this Ordinance, Lot 1 of the Dudley's Minor Subdivision shall not be
within the corporate limits of the Town of Nunn for any purpose.
Section 2. The Town Clerk shall file this Ordinance for recording with the Clerk and Recorder of
the County of Weld, State of Colorado, in accordance with applicable statutes, including without
limitation section 31-12-501(3) of the Colorado Revised Statutes.
Section 3. This disconnection shall become effective in accordance with applicable statutes,
including without limitation section 31-12-501(4) of the Colorado Revised Statutes.

A RESOLUTION APPROVING THE REPLAT OF LOT B OF YOUNELL'S
ANNEXATION
DUDLEY MINOR SUBDIVISION
PART OF THE SOUTHEAST QUARTER OF SECTION 28, TOWNSHIP 9 NORTH, RANGE 66
WEST OF THE 6TH PRINCIPAL MERIDIAN
TOWN OF NUNN,
COUNTY OF WELD, STATE OF COLORADO
WHEREAS, The Town Board of Trustees has completed the review for the REPLAT of LOT B
OF YOUNELL'S ANNEXATION, creating DUDLEY'S MINOR SUBDIVISION, which is
compliant with the following Procedures for REPLAT. (Chapter 16.42, Code 2002)
1. The created 2 lots will not result with less than the minimum requirements for the area or
dimensions as established by subdivision regulations, the zoning ordinance, or applicable
regulations. Zoning will remain Residential for both lots.
2. Drainage and utility easements have been reviewed by Town Public Works with all data
supporting the change.
3. Street locations and streets right of way shall not change, although northerly access
within the development has been reviewed and approved.
4. No perimeter boundary of a recorded subdivision plat is affected
5. The REPLAT submitted does not adversely affect the character of the existing plat filed.
6. This REPLAT does not create more than 5 lots.
The applicant for this REPLAT has provided all fees required and will provide the 24" x 36"
Mylar for recording with Weld County. This REPLAT is approved this 21st day of January,
2017 by the Town of Nunn Board of Trustees.
