We offer the following response to the Department of Planning Services' comments: PLANNING COMMENTS: 1. Please submit a copy of the Completeness Review form when you submit the revisions to your Land Use Application. Response: Please see the attached copy of the Completeness Review form. 2. Response: We have made several changes to the application items to clarify that we are requesting 12 MWs for the site: 1.) The Use by Special Review Application form has been modified under the "Proposed Use" section to reflect up to 12 MWs (DC) in three phases. 2.) I also wanted to let you know that Xcel will not be able to provide the inter -connection for the proposed project until the first quarter of 2020; thus, the push to have this facility built by the end of this year is no longer a concern. Explain in detail, the proposed use of the property. Response: The property will be used for up to 12 MWs (DC) photovoltaic (solar) power generation plant. The project will be developed in three phases. The power generation will be connected and transmitted to Xcel Energy through nearby power lines (substation is directly across WCR 46 from the subject property). The subject property contains 79.59 acres and this Use by Special Review will include phasing of two (2) additional 5 MW (DC) photovoltaic power generation facilities. At total build -out, this USR is intended to support 12 MWs of clean, renewable power. 2.) Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 22 of the Comprehensive Plan. Response: Chapter 22 of the Comprehensive Plan addresses "Alternative Energy Resources — Goals and Policies". The proposed use of the subject property as a solar power generation facility is consistent with the goals and policies of this section. Alternative Energy Goal No. 1 is to "Support and encourage research, development and use of alternative energy sources". This proposed use is for the development and use of alternative energy sources by the citizens and business of Weld County. This facility will provide a clean, renewable energy source for citizens and businesses who are served by Xcel Energy. Alternative Energy Policy 1.5. Calls for supporting and developing the use of solar energy. This proposed use is in keeping with this policy. Recommended Strategy AE.1.5.b. proposes "Creating incentives that encourage large-scale commercial solar collections". The proposed project, at full build out will ultimately provide 12 MWs of renewable solar energy and would be considered a Medium -Scale Solar. Weld County recently reviewed its regulations regarding solar power generation facilities. Strategy AE.1.6.a. of Chapter 22 addresses this and recommends reviewing County regulations to ensure support of all alternative energy resources for small and large-scale applications. 3.) Explain how this proposal is consistent with the intent of the Weld County Code, Chapter 23 (Zoning) and the zone district in which it is located. Response: The subject property is zoned Agricultural (A) and is in a Non - Urbanized Area. Medium -Scale Solar Facilities ore permitted as a Use by Special Review in the Agricultural zone district. The Use by Special Review process allows for adequate review by the Planning staff, Planning Commission, and the Board of County Commissioners, to ensure compatibility with surrounding land uses. Additionally, citizens are afforded adequate opportunities to express their concerns in the public hearing setting before any solar facility can be constructed on agriculturally zoned land. Solar facilities allow farmers and ranchers another use for their land and a viable stream of income beyond traditional farming and ranching uses. 4.) Describe what type of land uses surround the site. Explain how the proposed use is consistent and compatible with surrounding land uses. Response: North of the subject property is a PSCO Electrical Substation, oil/gas facility and tank battery, and agricultural uses. Northeast of the subject property is an oil/gas storage yard on 62 acres. East of the subject property is a 75 acre parcel owned by the owner of the proposed solar site which is agricultural in use with a farm house on the east side of the parcel. South of the subject property is an 83 acre parcel with agricultural uses. Southwest of the subject property is a 78 acre parcel with an oil/gas facility and tank battery and agricultural uses. The property is owned by Five Rivers Ranch Cattle Feeding, LLC. To the northwest of the subject property is a 486 acre cattle feed lot owned by Five Rivers Ranch Cattle Feeding LLC. The proposed use of a Medium -Scale Solar Facility on the subject property is compatible with the surrounding uses. Actually, the proposed solar facility is an ideal use for the property given the surrounding land uses. A solar facility is perhaps one of the very best uses for the subject property given the close proximity/adjacency to the existing PSCO substation and associated transmission lines, the existing oil and gas operations and associated uses and the large feedlot. The proposed solar facility is actually quite compatible with the surrounding uses. 5.) What are the hours and days of operation? (e.g. Monday thru Friday 8:00 a.m. to 5:00 p.m.) Response: Solar facilities are unmanned facilities that operate 24-7, but only produce power during the daylight hours. During the equipment delivery/construction phase, there will be a construction crew of approximately 20 full-time workers on the site. The site will be occupied Monday through Saturday, 2:00 A.M. to 5:00 P.M. during the construction phase. The first phase of the project, the 2 MW facility, will take approximately forty five (45) days to construct and interconnect. Once the construction phase is completed, the site will be visited quarterly for routine maintenance and as needed for emergency maintenance. In addition, mowing and noxious weed control crews will also be on the site as needed. There will be no exterior lighting associated with the facility. 6.) List the number of full time and/or part time employees proposed to work at this site. Response: During the equipment delivery/construction phase, there will be approximately 20 full-time workers on the site. After construction, a one or two person crew will visit the site quarterly for routine maintenance and as need for corrective maintenance. 7.) If shift work is proposed, include the number of employees per shift. Response: Not applicable. 8.) List the number of people who will use this site. include contractors, truck drivers, customers, volunteers, etc. Response: During the delivery/construction phase, approximately 20 people will be on site. In addition, there will be approximately 8-10 delivery trucks that will deliver equipment to the site during the equipment delivery/construction phase After construction, the site will be an unmanned facility. 9.) If this is a dairy, livestock confinement operation, kennel, etc., list the number and type of animals. Response: Not applicable. 10.) Describe the type of lot surface and the square footage of each type. (e.g. asphalt, gravel, landscaping, dirt, grass, buildings) Response: The access drive will be approximately 400 feet in length and 20 feet wide. It will be made of compacted crushed rock. The balance of the site will be dirt as it currently exists, No landscaping is being proposed for this facility although, native grasses will be restored. No buildings are proposed as part of this facility. An 8' X 40' conex storage unit will be placed on the site to store spare panels and other miscellaneous ports for the facility. 11.) How many parking spaces are proposed? How many handicapped (ADA) parking spaces are proposed? Response: There will be adequate parking for two passenger vehicles on the access drive outside of the fence between the gate and the County right-of-way. The access gate will be 50' from the County right-of-way. In addition, there will be an area inside the gate and off the access drive that will accommodate two more passenger vehicles. Since this is an unmanned facility, no ADA parking spaces are being proposed. 12.) Explain the existing and proposed landscaping for the site. Response: The entire site is now being cultivated for agricultural uses and is a dirt surface. No landscaping is being proposed for this proposed facility. 13.) Describe the type of fence proposed for the site (e.g. 6 foot chain link with earth tone slats). Response: To comply with the National Electric Code, there will be a 8' tall game fence installed around the entire perimeter of the site. The fence and gate will be constructed of 4" X 4" welded rod material with a barbless wire apron extended out at a 45 -degree angle for the top 1' of fencing. The fence will be painted with a color to blend with the existing site conditions. 14.) Describe the proposed screening for all parking and outdoor storage areas. Response: The two internal parking spaces will be partially screened by the perimeter fencing. There will be no outdoor storage associated with this proposed use. 15.) Explain any proposed reclamation procedures when termination of the Use by Special Review activity occurs. Response: Once the site is no longer used for the proposed solar facility, the panels, racking, cabling, inverters, and all associated equipment will be removed from the site and the site returned to its condition prior to the solar facility being constructed. 16.) Who will provide fire protection to the site? Response: Fire protection services are provided by LaSalle Fire Department. 17.) Response: During the equipment delivery/construction phase, there will be a maximum of 10-20 vehicle trips per day of conex container and delivery trucks (30,000 - 50,000 lbs). There will be 0-4 average vehicle trips per day of equipment hauling trucks (20,000 - 40,000 lbs) during the construction phase. There will be 10-24 vehicle trips per day for the construction crew, most being standard pick-up trucks. Once construction is completed, there will be quarterly maintenance visits to the site in a standard pick-up truck. 2.) Describe the expected travel route for site traffic. Response: The designated travel route includes: State Highway 85 north to WCR 46, then west to the proposed project access drive. 3.) Describe the travel distribution along the routes (e.g. 50% of the traffic will come from the north, 20% from the south, 30% from the east, etc.). Response: it is estimated that approximately 40% of the traffic will come from the south; 30% from the north, 20% from the west; and 10% from the east. 4.) Describe the time of day that you expect the highest traffic volumes from the above. Response: During the equipment delivery/construction phase, the majority of heavy truck traffic including the conex container delivery and equipment delivery and pick-up trucks will travel to and from the Project between 8:00 AM and noon and 1:00 PM and 4:30 PM. 5.) Describe where the access to the site is planned. Response: The access drive is being proposed off Weld County Road 46. 6.) Drainage Design: The solar facility likely meets the criteria for a drainage exception. Response: No storm water detention is required. 1. Which Exception is being applied for and include supporting documentation. Response: The proposed project is located in a Non -Urbanizing Area and the proposed discharge rate is less than the 10 cfs threshold. 2. Where the water originates if it flows onto the property from an offsite source. Response: Most of the offsite water flows from Weld County Road 46. 3. Where it flows to as it leaves the property. Response: The site is naturally sloped so that most of the drainage remains on the property. 4. The direction of flow across the property. Response: There will be no storage or stockpiling of wastes, chemicals, and/or petroleum on the site. Any fuel needed for equipment will be brought to the site on portable fuel trucks. 5. The intent of this Narrative is to provide traffic related information and identify potential Project impacts to affected roadways within Weld County and in and around the Town of Gilcrest. Components - The Project generally includes: an initial Project of 2 MW solar energy conversion system comprised of 5,400 solar modules mounted on a tracker structure on shallow driven steel i-beams; concrete pad mounted transformer and interconnect; inverters mounted at the end of array rows; an access drive with emergency turn around; and perimeter fence with gate. There are several phases planned for this Project, which will include another two (2) +/- 5 MW solar energy conversion systems. Construction Schedule - It's currently anticipated that the Use by Special Review Permit will be issued by Weld County on or before October 2019. Accordingly, a construction start/mobilization date of October 2019 has been estimated. The posted speed limit is 30 mph in the vicinity of the Project site. The road surface appears to be in only fair condition with significant cracks (transverse, alligator, etc.). The Project is expected to generate up to 24 vehicle trips per day during material and equipment delivery (anticipated to be one week at the beginning of the project and one week at the end of the project), 24 vehicle trips per day during solar facility installation (3-4 months) and 2 vehicle trips per month during solar facility operation. 2. Project installation is anticipated to begin in October 2019 (material and equipment delivery) and end in December 2019 (solar facility start-up and container and equipment container pick-up). The phase with the greatest amount of traffic (solar facility installation) is expected to occur over a 3 month period (October 2019 — December 2019). 3. Daily Project related truck traffic is not expected to impact AM and PM peak traffic periods. 4. As proposed, the solar facility installation (material/equipment delivery — approx.1 week, solar facility installation 3 months and solar facility operations - ongoing) is not anticipated to create adverse traffic related impacts on Weld County Roads.
