HomeMy WebLinkAbout20193586.tiffRESOLUTION RE: APPROVE AMENDMENT TO COURT SECURITY GRANT APPLICATION AND AUTHORIZE CHAIR TO SIGN ELECTRONICALLY WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Amendment to the 2019 Court Security Grant Application to the Colorado Court Security Commissioner, State Court Administrator's Office, commencing upon full execution, with further terms and conditions being as states in said grant application, for the approval and signature by the Board of County Commissioners of Weld County, pursuant to the provisions of Section 13-1-205 (1)., C.R.S., which requires that for the Court Security Commission to consider a grant application, "the application shall be signed by the administrative authority of each entity that is represented on the local security team," and WHEREAS, after review, the Board deems it advisable to approve said amendment, a copy of which is attached hereto and incorporated herein by reference, with the condition that the resulting application amendment must be presented to the Board before being agreed to by staff, to allow the Board to complete the necessary actions. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Amendment to the 2019 Court Security Grant Application to the Colorado Courts Security Commissioner, State Court Administrator's Office, be, and hereby is, approved, with the condition that the resulting amendment must be presented to the Board before being agreed to by staff, to allow the Board to complete the necessary actions. However, the grant did not fully fund these requested items. It is comprised of members representing the Nineteenth Judicial District Courts and Probation, District Attorney's Office, Weld County Government and Weld County Sheriff's Office. The LST collaboration continues to develop and prioritize responses and requests to address legitimate security needs. The District has been allocated three additional judicial officers, each will be assigned to one of the three court buildings. Due to the increase in numbers and docket time, the security screening process is extremely important. Our primary objective is to continue to enhance and sustain security efforts in the courts and probation five -building complex. 1 The following are our anticipated results. All enhancements would be purchased as soon as the funds were made available. Fully fund the purchase of two walk-through metal detectors. Presently all of the units are out of warranty. There are seven ('7) units within the court complex, including Probation, and all are out of warranty. The request for two will assist in remedying the warranty issue and help ensure the security screening process is efficient and without delay. The Polycom systems that support the remote video court proceedings are aging out. They will be reaching the end of sustainable life soon and will have a large impact on security operations if replacements are not worked. Remands: 128 Felony; 110 Misdemeanor; 6 firearm/ammunition contraband; 242 sharps (knife/cutting devices); 100 other contrabands Drug: Three reports ® Medical: Five reports. (1) Juror with heart attack symptoms, transported to hospital (2) Senior judge fell, EMS assessed and he returned to work (3) Division 7 had female with seizure who fell and hit head, was transported (4) another seizure symptoms who was assessed and declined transport (5) Defendant appears in custody of bondsman having seizure symptoms, was assessed and then taken into custody — perhaps this may have been a way of trying to get out of being arrested. Five panic alarms: one drill for deputies and others false alarms ® Two Direct Contact issues. (1) verbal threat to the clerk's office, deputies did come for a standby, but the defendant never showed (2) male who was recording at security stations and clerk's office, who proceeded to go to probation as well. There was a similar incident with someone recording yesterday, however he stopped as soon as requested. One suspicious package turned out to be the Greeley Rec summer pamphlets which were left outside the doors before hours. After speaking with them, these will no longer be delivered to the courts. Have high risk case in Division 17 from Larimer county — there are three additional hearing set before the trial which is scheduled in September. Inquiry from a few people regarding if people can record on site or if there are signs advising them that they cannot. Per Judge Hartmann this is part of a 2012 Administrative order that does not allow recording inside the buildings, right now that order does not extend to probation but may be included soon. The Administrative Order will most likely be updated to include general disruptive behavior, which includes these recording incidents. Right now, there are no signs, but will be working on that. Probation update Joe Murphy: Regarding recordings, the one man is from Wyoming and has posted the videos which total about an hour. He also has video from other courts, law enforcement agencies, etc. on the sight as well, which is a bit disturbing. Otherwise, things have been quiet. They have key card access now and have not received any negative feedback. Probation has a safety team who recently did training on home visit scenarios. They discussed policy on how many officers should go on these and it was decided two probation officers. ® Received a grant and some new vests for staff; at this time, they have enough vests for all officers in the field. 2 New Business: • 2019 Courthouse Security Grant - Marci Hoffman o Review of the grant request and what was granted. They are now open to accepting amended requests as there are some additional funds available. There is also some used equipment available, and Marci will pick it up if wanted. Per Toby does not want to take the old equipment but would like to do an amended request to see if the original full request would be funded. Per Marci, will speak with the sergeants to help with the verbiage on the security equipment for the amended request. • LST Roundtable Discussion o Digital Signatures — Aleksei — IT is working on a request to supplement video arraignments process. There are approximately 315 documents per month that were needing signatures, so they are recommending funding for a project request next year that would fund four digital pads at the jail for signatures. He is also working on getting in contact with Chad Cornelius regarding the plan and research for a future meeting, this would be a 2020 project. Per Judge Hartmann there is new legislation passed requiring weekend bond hearings statewide — right now Weld is one of the only counties that does weekend bond hearings. This may prompt a need for remote signatures. He has been talking with other chief judges already as this takes effect November 1. Judge Hartmann recommends that we wait to see what state does, that way we can ensure compatible systems in the event that this starts being used for more than just bond hearings. Supreme Court committee assists with what can be done via video, while adhering to due process — but upgrades with technology could expand the types of hearings we are able to do via video. Aleksei requests this to be added to next meeting — Marci will help facilitate communication with Chad Cornelius. o Sgt. Wayman: regarding the metal detectors, all four in the courthouse have been out of warranty since 2012. Request for two additional units put in with sheriff's office request, but there has not been a final budget meeting yet to determine if that will be granted. There are currently three units in probation, and they are unsure where all of them came from. Per Toby — there are currently six units in use — two at probation, one in Centennial, one in courthouse 1st floor, one in courthouse 2nd floor and one in Plaza West. Per Sgt. Elbe, we need to account for who is responsible for each unit (budgeting for maintenance, warranty and new machines). Per Toby, the six machines were purchased through grants over the last 10 years. There are others that were handed down to probation from other departments — for the ones handed down, the agency using them is responsible for all maintenance agreements. Per Sgt. Wayman they are working on keeping a cycle that will keep everything under warranty and allow them to only have to replace a few machines at a time. Toby will get with the sheriff's office for purchasing history. o Judge Hartmann: Weekend bond hearings were already previously addressed. Division B and 9 will be switching effective Monday — so defendants will no longer have to be transported to Div. B under the breezeway. There have been questions regarding the second security post in Centennial. The main issue is to have a single point of entry, or if multiple entry points to ensure that everyone coming to the clerk's office has passed through security. 3 o Marci Hoffman: Thank you to sheriff's office for being so proactive over the disgruntled party that called. o Matt Elbe: appreciates the courts being ahead of the weekend bond hearings, and the good communication that has allowed them to make needed requests. There will be six additional deputies assigned to the courts unit. They are almost done with the waiting room remodel at the north jail complex. o Matt Turner: with all the 15t amended recording issues we have been having, suggests that we look at signs to help communicate the no recording policy. Judge Hartmann indicates there was a sign previously that said recording was prohibited, but unsure where it is. Recording has become more of an issue with cell phones. There have been discussions with judicial officers who don't want to ban phones because parties keep their calendars on them. Will look back into some signs. Per Sgt. Wayman will also be looking at putting together some talking point scripts to assist with questions on this policy. o Michelle Raimer: working on B&G for proxy access and cards. Agreement has been that DHS can bypass security if their badge is horizontal but not if it is vertical picture — so working on this piece for the cards. o Toby Taylor: Courtroom, coroner and justice services contract to be awarded 07/08/19. o Aleksei: Would like to be told when we know the new judges are starting and what will happen courtroom wise at that time. Per Judge Hartmann the new District Court Criminal judge will be starting after July 1 and will be in Division 17. The part-time Magistrate will be working out of Division A and Division D — Division D already has needed video equipment. The additional district court judge will start after Jan. 1, 2020 and will be handling a civil and domestic docket in Division 10. So, at this time no additional video equipment will be needed. There will also be two new courtrooms built in the bridge to Centennial building, so they will need to look at video for those courtrooms in the future. Per Toby, this would most likely end up being a 2021 budget request.
