The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT,
FOR A HOME BUSINESS THAT FABRICATES VIA SANDBLASTING AND CARVING STONE
MONUMENTS AND HEADSTONES, AND FOR ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT
OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE FAMILY
DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT
This project is north of State Highway 60 and is west of and adjacent to CR 13.
Parcel number 106101000024.
Access is from CR 13.
ACCESS
Weld County Public Works has reviewed the application materials related to access. County Road 13 is
annexed by the Town of Johnstown in this location. Contact Johnstown to determine any access
requirements.
Per Chapter 12, Article 5, Section 12-5-30, an Access Permit is required for access to Weld County
maintained roadways. We strongly encourage you to discuss your access with Public Works prior to laying
out your site plan to ensure the approved accesses are compatible with your layout. Per Chapter 12, Article
V, Section 12-5-30. F, when feasible, there shall be no net increase in the number of accesses to a public
road. Minimum access spacing widths are shown in Weld County Code Appendix Table 12A-2. Please refer
to Chapter 12 of the Weld County Code for more information regarding access.
ROADS AND RIGHTS -OF -WAY
This portion of County Road 13 is under the jurisdiction of the Town of Johsnstown. The municipality has
jurisdiction over access to the road. Please contact the municipality to verify the right-of-way requirements,
access permit or for any additional requirements that may be needed to obtain or upgrade the permit.
Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 13 counted 2539 vpd with 18% trucks. The 85th percentile speed is 51 mph.
The traffic information submitted with the application materials indicated that there will be approximately 1-
2 car and pickup daily roundtrips.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
Detention pond waived and a simple drainage narrative:
The applicant has submitted a drainage narrative stating that the site meets drainage exception 23-12-
30.F.1.a.8 for sites where development of the site does not increase the imperviousness of the site. It does
not appear that the applicant is proposing any changes to the site.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. The plan shall be amended to delineate the following:
1. This portion of County Road 13 is under the jurisdiction of the Town of Johnstown. Please contact
the municipality to verify the right-of-way. Show and label the right-of-way. Show the approved
access(es) on the site plan and label with the approved access permit number if applicable.

2. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled
surface be less than 35 feet. (Department of Public Works)
3. Show and label the drainage flow arrows. (Department of Public Works)
4. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

Prior to Construction:
A. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Public

3. Weld County is not responsible for the maintenance of onsite drainage related features. (Department

Environmental Health Services has reviewed this proposal for a Site -Specific
Development Plan and Use by Special Review Permit for a home business that
fabricates via sandblasting and carving stone monuments and headstones, and a
Second Single -Family Dwelling unit per lot other than those permitted under Section 23-
3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District.
Both homes and the business are/or will be served by the Town of Johnstown for water.
The On -site Waste Water Treatment System (OWTS) for the existing residence is
permitted for 2 bedrooms (G1899026). The second residence shall be served by a
separate OWTS.
Dust is created by the business process however the application indicates a vacuum
system contains the dust.
We recommend that the following requirements be incorporated into the permit;
Prior to the issuance of the Certificate of Occupancy:
A. An on -site waste water treatment system is required for the proposed
residence and shall be installed according to the Weld County On -site
Waste Water Treatment System Regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites
and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.

2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the definition
of a solid waste in the Solid Wastes Disposal Sites and Facilities Act,
30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that
controls fugitive dust, fugitive particulate emissions, blowing debris, and
other potential nuisance conditions. The facility shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on the
property should comply with the Colorado Air Quality Commission's air
quality regulations.
5. Adequate drinking, hand washing, and toilet facilities shall be provided for
employees and patrons, at all times. Any On -site Wastewater Treatment
system located on the property must comply with all provisions of the
Weld County Code, pertaining to Systems.
6. A permanent, adequate water supply shall be provided for drinking and
sanitary purposes.
7. Any additional hydraulic load to the existing septic system (G1899026) will
require an Evaluation from a Colorado Registered Professional Engineer.
The engineer's evaluation shall be submitted to the Weld County
Environmental Health Department. In the event the system is found to be
inadequate, the system must be brought into compliance with current
Weld County On -site Wastewater Treatment System Regulations.
8. All chemicals must be handled in a safe manner in accordance with
product labeling and in a manner, that minimizes the release of hazardous
air pollutants (HAPs) and volatile organic compounds (VOCs). All
chemicals must be stored securely, on an impervious surface, and in
accordance with manufacturers' recommendations.
9. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

These comments pertain to an application for a site -specific development plan and use by special
review permit for a home -based business that fabricates via sandblasting and carving, stone
monuments and headstones. The project is not proposed to include the construction of any new
commercial buildings. Weld County Assessor Property Portal indicates the parcel is zoned
Residential. The application materials appear to comply with Weld County Planning requirements.
The property is within the Front Range Fire Rescue (FRFR) Fire Protection District. Weld County
has approved the amended 2018 International Fire Code (IFC) for enforcement within the FRFR
response area.
COMMENTS/CONDITIONS
7 -Day Letter, page 3 - USR Question #5, Item G: The Applicant has indicated that fire protection
and ambulance services are provided by, "Johnstown-Gilcrest Fire." No such entity exists. The
property is served by Front Range Fire Rescue. This information is reflected correctly in the
Updated Questionnaire document provided for review.
FIRE DISTRICT APPROVAL
Based on information provided, FRFR has no objection to granting the USR request for the
operation of the business at this location.
The adopted 2018 IFC requires all commercial businesses to comply with FRFR requests for a fire
safety inspection prior to opening for business, and compliance with subsequent annual inspections
to confirm appropriate fire and life safety measures remain in place.
