HomeMy WebLinkAbout760602.tiff RESOLUTION WHEREAS, it has been determined by the Board of County Commis- sioners, Weld County, Colorado, that a certain tract of land being the property of Elmer J. Kauffman, Keenesburg, Colorado, and Julius A. Pluss, Denver, Colorado, and more particularly described as follows: The North one-half of Section 30, Tovaiship 2 North, Range 63 West of the Sixth Prime Meridian being more particularly described as follows: Beginning at the Northwest corner of said Section 30 marked by an iron pin in the center of an east-west road and considering the West line of said Section 30 as bearing due South with all other bearings contained herein relative thereto; thence due South 2671. 8 feet to the center of an east-west road and the West Quarter corner of said Section 30; thence South 89°42' East 5414. 3 feet to an iron pin marking the East Quarter corner of said Section 30; thence North 0°33' East 2678. 0 feet to the center of a road intersection marking the Northeast corner of said Section 30; thence North 89°46' West 5439. 7 feet to the iron pin marking the Northwest corner of Section 30 and the point of beginning, containing in all 333. 23 acres, more or less, subject to a road easement 30 feet in width along the North, East and South sides and an easement for a rounded road at the Southeast corner of said North one-half of Section 30 by either of recorded description or by proscription by virtue of being used, all in all containing 322. 37 net acres, more or less, does not come within the purview of the definition of the terms "subdivision" and "subdivided lands" as set forth in 1973 C. R. S. 30-28-101 (10), as amended, and WHEREAS, the Board of County Commissioners of the County of Weld, State of Colorado, has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed, now desires to exempt this particular division of land pursuant to its authority under 1973 C. R. S. 30-28-101 (10) (d), as amended. NOW, THEREFORE, BE IT RESOLVED, that the hereinabove described tract of land owned by Elmer J. Kauffman and Julius A. Pluss, be exempted from the definition of the terms "subdivision" and "subdivided lands" as provided for in the new Weld County Subdivision Regulations at Section 2-1, A. , (3) adopted August 30, 1972. The above and foregoing Resolution was, on motion duly made and seconded, adopted by the following vote on the 26th day of May, A. D. , 1976.
