Michael and Lena Pyne brought, M° Pyne Custom Hauling here in September 2013, at the request of Dairy Farmers of America, to haul milk from the local dairies. We came with two trucks and trailers and have grown from there. M Pyne Custom Hauling is a family run business, picking up and delivering milk locally, M Pyne now manages the milk haul for 6 dairies 24/1/363. 0►wniing 6 trucks and trailers with hope to eventually have 7 trucks. M Pyne is the milk hauler into Noosa in Bellevue, CO., when they order milk to supplement what they produce. As of May 1st there are 3 people who five in the house Michael, Lena and Kent, Kevin and Danielle now have their own place. The morning routes start at 4am the drivers stock their supplies and check the trucks and trailers, There are 6 drivers who live off site and 2 on site. Drivers then go to the dairies to load the milk, and take it to the assigned receiving facility either for yoghurt or cheese or milk. Dairies sometimes have two loads or three depending on the dairy size. The trucks that normally leave at 4am, arrive back at fpm to 3pm,. There are two afternoon routes, those trucks will leave again fpm or 3pm to do those night routes. Arriving back by 3arn, for the morning shift. There are no loaded trailers brought to the site. Trailers are washed and sanitized at those milk receiving plants delivered to. M Pyne is able to wash the exterior of the trucks and trailers at one of those plant&. The drivers come in to the garage and in to the office on the lower level, The home is a split-level. Drivers bring in their paperwork. If they need to use the facility, there is a restroom down on this level that is available. Trucks and trailers are parked in the center but north of the tree line. 2. Our intention on keeping with the Weld County Code, Chapter 22 of the Comprehensive Plan Sec. 22- 240. Agriculture, Plan E. In keeping with the intent of the preamble of the Weld County Charter "to provide uncomplicated, unburden some government, responsive to the people," development in rural areas provides opportunities for land divisions that are exempt from subdivision regulations and allows land use by small agricultural operations and home businesses. These lots retain the agricultural zoning designation and support a high -quality rural character, while maintaining freedom from cumbersome regulations. We are hoping to run as a Home Business. M Pyne Custom Hauling manages 6 dairies on a daily 24/365 basis. Carrying that milk to receiving facilities in Bellevue, Greeley, Longmont, Denver and Englewood. Doing that entails equipment and maintenance, fuel, drivers, wages, taxes all going to the community in those avenues. . A.Goal 2. Continue the commitment to viable agriculture in Weld County through mitigated protection of established (and potentially expanding) agriculture uses from other proposed new uses that would hinder the operations of the agricultural enterprises. N4 Pyne has been a reliable hauler to the local Dairy Farmers of America Co-op, promoting food handing securement and quality consistent milk pick up, LA. Policy 23. Encourage development of agriculture and agriculturally related businesses and industries in underdeveloped' areas where existing resources can support a higher level of economic activity. Agricultural businesses and industries include those related toranching, confined animal production, farming, greenhouse industries, landscape production and agri-tanment or agri- tourism uses. Which we hope to be with our home business. Choosing to be small and efficient. A milk hau er working to do better for the farmer and the public, to care for the milk, the producersand all the requirements of food handling securement procedures. Keeping to a location that is truck ease of use, it has access to the highway, centrally located to the dairies we pick up and milk receiving plants we deliver to. Only 2 houses on the north and a feecllot to the east, A field to the west and a tank battery to the south. F. A;Goal : Provide mechanisms for the division of land in agricultural areas to support the continuation of agricultural production. Milk hauling is a specialized occupation, producers are better provided for if their hauler has their interests in sight as well. A careless hauler can damage a milk producer very quickly, with bad sampling and hauling practices. 2. A.Policyt6.2. Support opportunities, such as but not limited to hobby farming and home businesses, to supplement family income and reduce living expenses for farm families and others who prefer a rural lifestyle. This is our livelihood', just like a farmer, Our daily operations are a wave of ebb and flow making the work and equipment and man power mesh together. Having a place to keep the trucks and trailers close allows that flow with less expense. G. A.Goal 7. County land use regulations should protect the individual property owner's right to request a land use change. We do request a U g in order to park our trucks and trailers at this property and have a home business, 1. A.Policy 7.1. County land use regulations should support commercial and industrial uses that are directly related to, or dependent upon, agriculture, to locate within the agricultural areas, when the impact to surrounding properties, is minimal, or can be mitigated, and where adequate services are currently available or reasonably obtainable. We haul milk from local dairies to local receiving facilities. Our daily pick up dairies are within a 15 mile to 50 mile radius. 2. A. Policy 7.2. Conversion of agricultural land to non -urban residentiar, commercial and industrial uses should be accommodated when the subject site is, in an area that can support such development and should attempt to be compatible with the region. We are at the end of the road so to speak, right beside the Highway 85 to the east of us. Highway 85 has turn lanes already in place for north and south travel, going in or out. We only pass 3 homes on CR 38 34, as we eave or enter the property, And when we do, we travel slow on such roads. 15mph is the M Pyne required mileage on CR 38 Yep When we travel to or from Highway 60 on to CR38 344 there already is a lane to use as an east turn lane if we come from the north. 3.A.Policy 7.3. Conversation of agricultural land to urbanresidential, commercial and industrial uses should! be considered when the subject site is located inside an Intergovernmental Agreement area, Urban Growth Boundary area, Regional Urbanization Area or Urban Development Nodes, or where adequate services are currently available or reasonably obtainable. A municipality's adopted comprehensive plan should be considered, but should not determine the appropriateness of such conversion. We hope to learn more about being an asset business to the community and county. H. A. Goal 8. The land use applicants should demonstrate that adequate sanitary sewage and water systems are available for the intensity of the development. We have a septic permit number SP-15OO271 of 15OO gallons. New installed 08/17/2015, it is good for a 4 bdrm house_ We are on well for water, tested 6,7 gals per minute and tested for chemicals also sample number 4 S1520113O5 that came back normal. See Attached 2rA.Policy 8.2, The land use applicants are responsible for contacting and determining the status of a water well through the State Division of Water Resources and should be aware that ownership of a parcel of land with a well does not guarantee use of the well. We have well Permit #22O773 See attached. A.Policy 8.3. The land use applicants should demonstrate that the roadway facilities associated with the proposed development are adequate in width,classification and structural capacity toserve the proposed land use change. I Here are turning lanes from Highway 85 from north and south.. We have reinforced the road access on the our property side with rip rap and road grade gravel at the entrance that the trucks access on to CR29, to keep it even with the road access. The access from CR29 is 40ft where you enter or exit our property, our property is not gated, allowing sufficient room to pull fully off the road when exiting CR29. The distance from the road to the first fence line is 6Oft, A.Policy 8.4. The land use applicants should demonstrate that drainage providing storm water management for the proposed land use change is adequate for the type and style of development and meets the requirements of the county. State and federal rules and regulations. At this time storm water flows to the east and south of the property naturally. The southern section is a triangle section that butts up to Highway 85 and CR 29. There is acement irrigation ditch along the west side of the property. 5A. Policy 8.5. The land use applicants should demonstrate that public service providers, such as but not limited to schools, emergency services and fire protection, are informed of the proposed development and given adequate opportunity to comment on the proposal. We are proposing to have a home office in the split-level home on the property, with the office in the bottom level. We are on S acres and, that we would like to park 7 commercial vehicles(trucks and trailers)on this property., 4. The surrounding properties are, On the north two homes within the distance of a mile road. To the east of us is a cattle feedlot, on the east side of highway 85. On the west and southwest, there: are fields.. This is property is zoned AG and currently, we have 6 trucks and hope to have 7. There are other types of businesses on the next mile up to the north that use trucks in their work, merely implying that there are many trucks on CR 29 each days: As well as CR 3814, has a fair amount of truck travel. When we do travel on CR 38 1/2, we only have 3 homes to pass. We normally only travel as far as our place on CR 29. 5., Picking up milk is a everyday job Sunday through Saturday.. First shift starts at 4:00 am to 1:00 pm or. 3:00 pm. Second shift is 1:00pm or 3:00pm to 1: am 6. There are 5 off site full time drivers, 1 part —time driver off site, 2 drivers live on site 1, First shift; morning shift 4 drivers, Second shift afternoon 2 drivers. 8. As of May 1st 2018, people living in the house total 3, 2 drivers are on site. Off -site drivers 9. Not applicable 10. The house is a split level with total 21000sf. A small storage shed is 64sf. The yard around the house is 21,624 sf. The grayed driveway and parking area is 29,854sf,. The remaining is pasture. 11. Parking near the house in front of the west side of the shed for 6 drivers and 3 personal. Parking for 7 trucks and trailers in the center of the property just north of the grown trees. We could put handicapped driver parking in driveway in front of house. Home office does not have public visitors. All employees are drivers and able to climb ladders and drive trucks as is required, 12. Landscaping is hedge surrounding the house, with a few large trees* New trees and starter trees on west side and in north pasture, on west and north side. Transplanted some lilacs on north side of pasture, planning to plant Quaking Aspen trees on, east side and far northeast side, South of house and truck and trailer parking is a line of large grown cottonwood trees. 11. Current fencing barbedwire on partial west, fully on north side and east side, Plan to put up white vinyl ranch style, 14, We have planted trees the last two years and are planting trees this year as wen. Along the fence line, to the east and north, also the road side on the west. We have only placed road base gravel for parking and driving on, it would be scraped up and removed. 16. Fire Protection is from Platteville Gilerest Fire Department 17. Turn lanes aiready exist in place on Highway 85 and Highway 60. The currently existing access entrance shared with Noble Energy is 40 ft at the CR 29 meeting point. It is 60ft between the road and our next fence line. in the next months if this permit is granted more road base will be applied to the parking area. Trees have been planted in the preceding 2 years and this year we purchased 90 more from the Weld County Conservation District. These have also been planted Engineering Questions: 1. 6 round trips are made each day with trucks, 4 morning routes starting at 4:00a to 2:00pm. I afternoon route at 2:00pm to 12:00am. Another afternoon route at 3:00p rr to :O0arn. Trips made with cars are, 4 mornings off site drivers' personal cars, 1 afternoon off site driver, and 3 person& vehicles running random errands all day. 2, Travel route for trucks are south out of truck driveway on to CR 29 about 1/801 mile on to Hwy 85 north or south. Or, west on County Road 38 1/2 to Hwy 60 north or south. Passenger cars go similar routes or north on CR 2' 3. 5% fromnorth CR 29, 40% from Hwy 85 South bound, 40% from CR 38 1/2 Easy; bound, 15% from Hwy 85 North bound. 4. At this time we have 5 trucks working. Our highest traffic hours are from 3:00am to 4:30am. 4 trucks go out early on a 4:00 am shift and return back varying from 1:00pm to 3:00pm. 1 truck goes out in the afternoon at 1:00pm and returns at 1:00am. The second afternoon truck heaves at :00prn and returns at 3:00am 5. There is currently an access entry on the southwest end of the property on a Noble Energy access road into their tank batten/ and well heads. Entry for the trucks to come in is at that access point and' onto our property from that. There is also a driveway in front of the house. It was a horseshoe driveway but it did not meet the correct width in between the two entrances. We have already closed the more northern opening with a log and planted grass. 6, On the west along the length of the property, between CR 29 and the property is a cement irrigation ditchi Which would allow any water from CR 29, to flow away fromthe road, and any water from our property to not flood CR 29. This entire property is triangular so along the eastern length of the property it has a marshy area next to the irrigation ditch along Hwy 85. This is a big ditch that separates us from Hwy 85. In 2015 we contacted Noble Energy and had asked for an agreement for use of the south access point. Brian Amsberry came back to us with the information that they did not need anything formal in writing and we all agreed to use this access. As of May 16, 2018 we spoke of this USR application and the need to file for an access permit. Brian Arnsberry stated that they don't have an issue with our applying for an Access Permit over this access paint as they are shutting down this well head and tank battery site. Also about the access driveway on the southwest end of the property was going to need to have an access permit also applied for to keep it open. We also talked about we closed the north driveway that was not allowed. By planting grass and putting down logs. At the end of the day there was no attempt to contact Michael or Lena by phone or Email that was given in the invitation. The subject property is located at the intersection of CR 29 and Highway 85 and is within the Gilcrest Urban Growth Boundary and IGA boundary. The Notice of Inquiry form was presented to the Gilcrest Town Board on May 1, 2018. Below is a summary of Town staff's preliminary analysis andTown Board comments to be addressed in the USR formal submittal: Comprehensive Plan: The 2017 Comprehensive Plan designates the subject property for Employment which includes sites that provide locations for a variety of workplaces. The proposed business complies with the Comprehensive Plan's land use framework and would further community goals to by promoting an increase and diversification of the employment base. Additionally, the property is located within Growth Priority Tier 2 that has existing infrastructure within one mile. Properties in Tier 2 would become eligible for annexation upon approval of an overall concept plan that addresses all issues associated with annexation. Annexation: As part of the review of the referral, a determination must be made to recommend the property remain in Weld County or request the application be processed in the Town of Gilcrest by annexing into the Town. The property may be able to meet the contiguity requirements for annexation into the Town as required by Colorado State Statutes via a flagpole and other serial annexations. The future plans to expand the business would most likely prove to be a benefit to the town; however, it may be pre- mature to encrouage annexation today. The Town recommends the business secure USR approval in the County with the requirement that the property owners enter into a pre -annexation agreement. Further, the Town is recommending that any intensified development (development that would NOT be classified as home based) be submitted as an annexation request to the Town, and subsequently be processed by the Town. General Comments: Traffic/Transportation. County Road 29 provides access to the site, and the town maintains this road north of CR 40. CR 38.5 is slated for closure pursuant to the Highway 85 Access Control Plan. Please provide detailed information on proposed truck routes, how many trips per day, and size of trucks in order to determine the appropriate traffic/transportation mitigative measures, if required. Considering the high visibility of the site from Highway 85 and adjacent residential uses, the following landscaping/screening requirement shall be incorporated into the USR documents (see Landscaping/Screening Gilcrest Municipal Code Requirements on pages 3 and 4 of this letter): 1. Parking lot setback areas shall be landscaped with trees, shrubs and ground covers or turf grasses. For nonresidential uses, trees should generally be provided in numbers equal to one (1) tree per twenty-five (25) lineal feet along a public street and one (1) tree per fifty (50) lineal feet along a side lot line parking setback area. Trees may be spaced irregularly in natural grouping rather than uniformly spaced. Parking setback landscaping along a street may be located in and should be incorporated with landscaping in the street right-of-way. 2. Parking areas with six (6) or more parking spaces must be screened from adjacent residential lots. Screening from residential uses must be by a visible barrier six (6) feet in height and of sufficient opacity to block at least seventy-five percent (75%) of the light from the motor vehicle headlights. This screening may also include a solid wall, wood fence, earthen berm or constructed planter. Again, the Town of Gilcrest would like to thank you for the opportunity to comment on the USR Violation. Existing mature healthy trees shall be preserved wherever possible. Existing trees and other plants in reasonably healthy condition may be removed only if the owner or developer has satisfactorily demonstrated that site design restrictions necessitate their removal. 2. All new plant material shall emphasize the use of native and drought -tolerant species that reflect the character of the native landscape. All plants shall meet the standards for measurement, grading, branching, quality, ball and burlapping as stated in the American Standard for Nursery Stock, 1990 Edition, American Association of Nurserymen (AAN-ASNS) for No. 1 grade, and Colorado Nursery Act of 1965 (CAN). Only trees which are balled and burlapped shall be planted. 3. The planting of Chinese and Siberian elms is prohibited. Such elms tend to be prone to disease, weak branches, suckering and the uncontrollable spread of seeds. American elms are excluded from the prohibition. Cotton -bearing cottonwoods (female Populus species), Russian olive and box elders are prohibited due to the uncontrollable spread of seeds. 4. The use of Xeriscape materials is encouraged. Plant size. At the time of planting, plants should be sized according to the following table (caliper measured six [6] inches above soil line): Type She Standard deciduous trees 1" to 2" caliper Small ornamental and flowering trees VA" to 1A" caliper Evergreen trees 5' to 6' in height Shrubs 5 gallon container Irrigation. 1. Underground automatic irrigation systems are required for landscaping which cannot survive on natural precipitation except for temporarily seeded areas. The use of drip, trickle, subterranean and other water -conserving irrigation methods is encouraged, as is the use of organic mulches and other water -conserving design features. The overall irrigation system design should emphasize efficient water use and conservation. 2. Developments with seeded areas shall provide an erosion control plan with irrigation provisions. All property owners/occupants of multiple -family residential, business and industrial property shall be responsible for the proper maintenance of the landscaping and the irrigation systems on their property and on that portion of the public right-of-way between the curb line and the adjoining property line in which landscaping has been placed.
