We still farm this ground. In 2006 we received Recorded Exemption 4296 which gave us three building sites. My wife I are both Eighty years old and have this property in a trust for our three daughters. With that information we hope you can see why it is very important for us to either maintain these as viable building sites or to be paid fair market value when the Tallgrass pipeline makes them less desirable. I asked tallgrass engineers what the "blast area would be for this 36M high pressure gas line. I was told that they did not call it a blast area but that the zone of influence would be 1,000 feet. This distance would more than engulf both of the east lots. The only response from Tallgrass was "we do not believe this will affect the value". Interestingly they removed Lots A and B from the next map they sent me. Even though we have had no meaningful or good faith negotiations, Tallgrass from the first letter h a s had veiled threats of condemnation and statements that we should not use previous pipelines as a basis for compensation. Tallgrass has been far worse to deal with than any of the other five pipeline companies with which I have come to an amicable agreement. It is probably not possible but it would be great to make sure Tallgrass is listening to landowners and making reasonable offers before a permit was granted. Testimony to the Weld County Planning Commission, re Tallgrass Cheyenne Connector Pipeline My name is Greg Cecil, I reside at 38561 CR 43, Eaton, CO. The Proposed Cheyenne Connector Project by Tallgrass is planning on crossing a Property owned by Cecil Farms at the NE corner of HWY 34 and CR 51 We started talking to the town of Kersey several years ago about annexing and turning the property (134 +- acres) into mixed use of commercial and light industrial. Once the Kersey/Keensburg road 49 was finished, we started the process and are now annexed into Kersey. We are working on a concept plan that takes into account the location, the nature and features of the land, and the market opportunities. The offers we have received for the 50' (exclusive) easement, and land/crop damages have been laughable. The offers fall way short of covering our potential damages. The latest appraisal done by a firm (Clayton and Company) hired by Tallgrass puts the value of the damages and easement, or what they called "Just Compensation" at a figure maybe 10% of what we anticipate our damages to be given the current design. I have asked several times to meet with Tallgrass engineers to discuss possible modifications to their plans that would mitigate our damages, no meeting has ever been scheduled. We have met several times with Susan Mitchell, Sr. Land Agent, Right of Way for Summit Resources Land, LLC/Representing Cheyenne Connector, Inc. She has always been available and timely in her responses, and I can only assume she has passed on our concerns to Tallgrass. A brief summary of my inquiries include: 1) I asked them to consider a slightly different route that would be less impactful on future development. I was told no. 2) I asked if it would be possible to have a heavier walled pipe put under our development, I have not received a response. 3) I asked if they would bury the pipe deeper (the current plan is to place the top of the 36" pipe at 4 feet, meaning I have to go 9 feet or more below the surface for any utilities to be installed, and any grading will be greatly affected), I have not received a response. In conclusion, as a mineral owners and Weld County residents, we understand the need for gas pipelines as infrastructure to support our regional Oil and Gas industry, and it would be hypocritical to oppose such infrastructure, even when it has a negative impact on us personally. What I am opposed to is the callous and non -flexible attitude this company has had from the very start of this project, and their unwillingness to communicate and negotiate in a reasonable manner. They do seem to be very willing to pay for lawyers and consultants to tell us what our damages are while eschewing negotiations. Greg Cecil on behalf of Cecil Farms EXHIBIT 1 5 V )8---003 Eminent Domain Law in Colorado A pipeline company is authorized to bring an eminent domain action in either state or federal court pursuant to Colorado Revised Statutes 38-1-101 et seq. and the United States Code 15 USC Section 717(h) once the company is issued a certificate of public convenience and necessity by the Federal Energy Regulatory Commission (FERC). Generally, whether the action is brought in federal or state court the legal proceedings are similar. Before a petition to condemn property may be filed, the pipeline company must make an attempt to reach agreement concerning compensation with the landowner. Where the landowner does not respond to a written offer within a reasonable time, or responds with a counter-offer that the pipeline reasonably deems unacceptable, inability to agree is deemed to have been established. Condemnation proceedings are filed by the pipeline company in either the federal court or the state district court of the county where the property is located. The pipeline company may seek immediate possession of the property to be condemned by making a deposit with, and in an amount determined by, the court. The landowner may request a jury trial, but if such a request is not made, the compensation to which the landowner is entitled will be determined by a board of commissioners appointed by the court. Each party has the opportunity to present witnesses or other evidence as to market value. The fundamental question to be decided is the compensation to be awarded for the taking of the property and any reduction in value of the remaining property. Fair market value is the criterion of compensation to be awarded to the landowner. ExHIBIT Q5R ticc-oesie-7- j Our journey wit Taligrass began midyear in 2017 when we began having discussions with one of their land persons, Nikki. In July of 2017 we allowed survey tee) to come unto our property on two different occasions to determine the proposed pipeline route and confirm property lines. A team was also granted access to do test bores to determine boring feasibility. Since that time we have allowed access on numerous occasions for surveys including, but not limited to, noxious weed surveys, ecological studies, environmental studies, cultural resource studies and an additional test bore. Access has been granted with no compensation and without exclusion on our part. Our intent was to negotiate in good faith. We received our first written communication from Tallgrass in March of 2018. The letter included brochures, a discussion about Cheyenne Connectors, landowner notification and a separate page entitled "Eminent Domain Law in Colorado." This seemed to set the tone for further negotiation...bullying rather than bargaining. Our first written offer was for the huge sum of $10 for a 1/4 mile 50' permanent easement and a 75' temporary easement. A followup offer allowed $500 for temporary access to an existing road only if needed should boring problems arise. Later we were offered a per linear foot figure (still minimal). We proposed a counter offer which was promptly rejected. We were then contacted by an appraiser from Tallgrass. We explained that we were well aware of the selling value of our property, however, our concern was devaluation of said property and loss of potential earning capacity. There are two operating gravel mines in a 2 mile radius of our farm and several water storage areas. The proposed pipeline intersects the majority of our pasture making future development for gravel mining and/or water storage difficult if not impossible. The appraiser told us that he would do further research and "get back to us in two or three days". We have yet to hear from him. Recently we received a request from Shawn, the current land man, for access to do an environmental survey for pumping water from the Platte River for hydrotesting the proposed pipeline. We have been told all along that the pipeline route will be bored under the river and continued in a bore EXHIBIT S2 l$-on1--9- under our property When asked why they were doing the survey on our side of the river, Shawn replied that there was a possibility of pumping water on the south side of the river and trucking the water to the bore opening on the north side We do not have a road that goes to the river and have no desire to have one constructed We did deny access for this study A letter dated August 10, 2018 stated "Tallgrass' commitment to negotiate in good faith" and "By now should have. 1 arrive at fair price for acquisition and damages 2. agree on mutually acceptable easement agreement 3. keep us informed about status of the project None of these have transpired. In summary: We have no plans or desires to sell our property It has been in our family for over 100 years Acquisition and damage loss based on an appraised selling value is not acceptable. We are concerned about the loss of future development and earning power from our land. The "lack of faith" in negotiating is huge We have tried to be open and accommodating, but seem to get nothing in return. Negotiation seems minimal at best. And last, but not least, we are concerned about an 36" pressurized, natural gas pipeline 100' from our home TESTIMONY OF DENNIS HOSHIKO BEFORE THE WELD COUNTY PLANNING COMMISSION NOVEMBER 6, 2018 Good afternoon. My name is Dennis Hoshiko and I reside at 1811 38th Avenue, Greeley. This project is another prime example of the problems myself and many other private property owners have been communicating to the Planning Commission and the Board of County Commissioners for a many years, sadly, to little or no avail. Pipeline companies like DCP Midstream, Saddle Butte Rockies, Blue Gramma Corporation, and now this applicant, Tallgrass Energy Partners, have all blatantly disregarded the property rights and well-being of many private land and irrigation ditch owners throughout Weld County. These companies have either already built, or plan to build their pipelines underneath historic irrigation ditches without even informing the ditch owners of the location or depth of those pipelines. These flagrant and illegal trespass violations are not only endangering the safety of those who routinely excavate those ditches, but also jeopardizing the ability of the ditches to transport vital irrigation water to the farms and crops that need it for their survival. Historic irrigation ditch easements are lawfully -established, legally -recognized, right-of-ways that convey court -decreed water rights to specific lands. I am the duly -Authorized Agent of the owners of the Irons Lateral Ditch, which was built in the late 1800s and has been in continuous use for 130 consecutive years. The ditch is approximately 4 miles long and transverses 4 Sections of land north and west of Kersey. It conveys water from the Lower Latham Ditch to several shareholders to irrigate over 600 acres of their farmland. Earlier this year, when I learned about the plans Tallgrass has to build their pipeline across the Irons Lateral Ditch, I immediately notified both the county Planning Department and the Federal Energy Regulatory Commission that Tallgrass needs to enter into a prior agreement with the ditch owners. Since then, I have not heard anything from Tallgrass regarding their intentions. Nevertheless, I am prepared to provide them with the same ditch crossing agreement four other pipeline companies recently agreed to before building their pipelines under our ditch easement. In addition, Tallgrass intends to build their pipeline beneath a number of other historic ditches that supply water to scores of other water right holders that irrigate many tens of thousands of acres of farmland throughout central Weld County. To date, Tallgrass has not obtained crossing agreements from any of those ditches either. Untold numbers of unauthorized oil and gas pipelines have already been buried beneath historic irrigation ditches throughout the county. Such pipelines were placed below these ditches without the agreement, or knowledge of 1 I EXHIBIT 1g sr the ditch owners It is critically important that ditch owners know this crucial information for their own personal safety In several mstances, local residents have been severely burned, and tragically, some have even been killed when they unintentionally encountered hidden natural gas pipelines For those of us who have to work around them, these unknown pipelines are comparable to buned, explosive, incendiary devices that are just hiding there, waiting for one of us to accidently dig mto them and blow ourselves up.
