IMPROVEMENTS PROJECT (AUGUST CYCLE -TIER II) AND AUTHORIZE
ELECTRONIC SUBMITTAL
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application for Energy and Mineral
Impact Assistance Program Grant for County Roads 54 and 17 Intersection Safety Improvements
Project (August Cycle -Tier II) from the County of Weld, State of Colorado, by and through the
Board of County Commissioners of Weld County, on behalf of the Department of Public Works,
to the Colorado Department of Local Affairs, commencing upon full execution, with further terms
and conditions being as stated in said application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Application for Energy and Mineral Impact Assistance Program Grant
for County Roads 54 and 17 Intersection Safety Improvements Project (August Cycle -Tier II) from
the County of Weld, State of Colorado, by and through the Board of County Commissioners of
Weld County, on behalf of the Department of Public Works, to the Colorado Department of Local
Affairs, be, and hereby is, approved.

SUBJECT: DOLA Application — 2019 August Cycle
In accordance with the work session held on July 2, 2019, Public Works is requesting the
Commissioners submit two energy and mineral impact grants to the Department of Local
Affairs (DOLA) on August 1, 2019.
The first grant request is for a Tier 1-$200,000 application for funding to contract design
and floodplain analysis for the WCR 66 and WCR 41 intersection improvement project.
This project is necessary as traffic use will increase as a result of the closure of WCR 64
CO' Street) at US 85 at the Union Pacific railroad crossing. This railroad crossing closure,
which will occur in the next 1-2 years, will require all traffic traveling along US 85 to use
WCR 66 east to access the many businesses located east of US 85. Many trucks will be
turning at the intersection of WCR 66 and WCR 41, which will require widening of the
intersection. In addition, the future connection of 'O' Street to US 85 will occur at WCR 66
which will add more traffic to the intersection.
The second grant request is for a Tier 2 -$1,000,000 application for funding for contract
construction for intersection safety improvements at WCR 54 and WCR 17. Both WCR
54 and WCR 17 are classified as arterial roads which are important connections to US 34,
1-25, the WCR 54 Corridor which will be a main route to 1-25 upon the completion of the
SH 402 interchange construction. Weld County will contract for construction of a
roundabout at the intersection.
Staff recommends authorization of signature on the DOLA applications. I am available at
your convenience to further discuss this matter.

The Department of Local Affairs' (DOLA) Energy and Mineral Impact Assistance Fund (EIAF)
program was created to assist political subdivisions that are socially and/or economically
impacted by the development, processing, or energy conversion of minerals and mineral fuels.
Funds come from the state severance tax on energy and mineral production and from a portion of
the state's share of royalties paid to the federal government for mining and drilling of minerals
and mineral fuels on federally -owned land. The creation of the fund is outlined in C.R.S. 34-63-102
(Federal Mineral Lease) and C.R.S. 39-29-110 (Severance). Grant dollars are to be awarded for the
planning, design, construction, and maintenance of public facilities and for the provision of
services by political subdivisions.

Weld County is requesting funding to assist with intersection safety improvements at WCR 54
and WCR 17. Both WCR 54 and WCR 17 are classified as arterial roads which are important
connections to US 34, I-25, the WCR 54 Corridor which will be a main route to 1-25 at the
completion of the SH 402 interchange construction. As of December 8, 2017, Weld County has
23,708 active wells out of the State's 55,062 active well count.
e. Describe the problem, opportunity or challenge that resulted in the request.
This intersection has been a site for multiple accidents and is currently a safety concern. There is
heavy traffic during commuting hours on weekdays, which will increase once the l-25/SH 402
interchange construction is complete. WCR 54 is designated as a key east -west arterial corridor
connecting I-25 on the west to the Town of Kersey on the east, running approximately one to two
miles south of and parallel to US -34. It is known as the Freedom Parkway and traverses through
or near several local jurisdictions, including Loveland, Johnstown, Milliken, Greeley, Evans,
Kersey, and unincorporated Larimer and Weld Counties. Freedom Parkway Access Control Plan
was adopted in 2018 and ensures protection of future county investments along this
multijurisdictional corridor. The plan is governed by multiple Intergovernmental Agreements with
the government entities in the vicinity of the corridor. Traffic volumes are anticipated to increase
on this corridor as development continues and ensuring safety and mobility at intersections is
paramount.

D. DEMONSTRATION OF NEED
The statutory purpose of the Energy and Mineral Impact Assistance program is to provide financial
assistance to "political subdivisions socially or economically impacted by the development, processing or
energy conversion of minerals and mineral fuels."
a. Demonstration of need
Why is the project needed at this time?
This intersection has had 22 accidents over the last 7 years (per the CIP Hot Spot Analysis
report -2018) ranking it as one of the ten most unsafe intersections in the county. WCR 17 from
WCR 52 to WCR 56 is ranked in the top 20 most unsafe road segments with 26 crashes in the
same time period.
b. Project implementation
How does the implementation of this project address the need?
This intersection is currently a four-way stop and, due to high traffic volume, creates a back-
log of vehicles during busy rush hour time slots. Weld county contracted a traffic study be
done regarding this intersection and the data shows that a roundabout would be the safest
improvement and keep traffic flowing more consistently with fewer back -logs.
c. Does this project address the stated need
Does this project, as identified in this application, completely address the stated need? If not, please
describe additional work or phases and the estimated time frame. Do you anticipate requesting Energy
and Mineral Impact Assistance funds for future phases?
Yes, the intersection improvements completely address the safety need at this time for the
intersection. Weld County will not be requesting additional funding.

Weld County hired a consultant to analyze different intersection options and make a
recommendation. One of the options the firm reviewed included a traffic light, but concluded
the roundabout would be a better, safer option. Overall, Weld County is trying to be proactive
regarding safety improvements to this intersection by utilizing a significant amount of oil and
gas property taxes and direct distribution severance funds for county -wide roadway
improvements. This funding assists Public Works road improvement efforts which have
significantly increased.

If funding is not awarded, severe crashes may continue to occur at this location.

C. MEASURABLE OUTCOMES

How will the project enhance the livability* of your region, county, city, town or community (e.g.
constructing a new water plant will eliminate an unsafe drinking water system and provide safe and
reliable drinking water; the construction of a new community center will provide expanded community
services, or projects achieving goals regarding energy conservation, community heritage, economic
development/diversification, traffic congestion, etc.)? *(Livability means increasing the value and/or
benefit in the areas that are commonly linked in community development such as jobs, housing,
transportation, education, emergency mitigation, health and environment)
We expect to see a reduced crash rate with these intersection improvements. Weld County
has seen increased traffic and land use development along this corridor. The improvements
will make the area safer for all motorists and add years of life to the existing roadway by using
innovative technology at the subgrade level, which will help with truck traffic deterioration.
The intersection improvement will enhance the increased traffic traveling from 1-25 through
Larimer & Weld Counties, nearby municipalities and those accessing the Weld County
Highway to 1-76, US 34 east and US 85 north and south.

Yes, Public Works will mill and recycle the asphalt materials and will reduce emissions as
traffic at this intersection will flow and move through more quickly, which was not the case
previously. The project will be constructed in concrete, which will significantly increase the
maintenance life -cycle in comparison to asphalt. Since this is currently a 4 -way stop, traffic is
sitting idle for several minutes in all directions prior to advancing through the intersection. Our
study showed a roundabout reduces emissions more than a 4 -way stop or traffic signal.
d. Resiliency framework
Will the project increase the community's long-term resilience and ability to anticipate, withstand, and/or
rebound from a natural or manmade hazard event? For example, will the project factor in natural design
concepts and will construction utilize sustainable materials? If yes, please describe.
Yes, utilizing the knowledge of the 2013 floods will help us design a more resilient intersection
to protect the infrastructure investment from any future flood events.
H. LOCAL EFFORT

Yes, this project has been identified in the Public Works general fund budget.
b. Why can't this project be funded locally?
Weld County needs all the funding assistance it can have since we are the most impacted oil
and gas county in Colorado. With 3,000 miles of road to maintain, Weld County cannot fund
improvements to all impacted roads and appreciates strategic funding assistance.
c. Has this project been deferred because of lack of local funding? If so, how long?
Yes, this project has been deferred for a number of years.

The project will be funded out of Public Works 2020 General Fund.

All motorists utilizing these roads recognize the value of this safety project especially in the
Towns of Milliken and Johnstown. Weld County's population is increasing rapidly in this area
and this project will improve the long-term livability of current and future residents.
Eventually, the county anticipates reconstructing sections of the Freedom Parkway to further
improve travel and this project is the first step in that plan.

Yes, impacted roadways are discussed at Weld County's Oil and Gas Working Group regular
meetings. The Oil & Gas Working Group consists of industry partners discussing impacts
affecting everyone and problem solves how we can all work together to minimize or mitigate
these problems. Improvements to the Freedom Parkway were also discussed during the
Access Control Plan process and signing of IGAs.

J. ENERGY & MINERAL RELATIONSHIP
a. Community energy or mineral impact
Describe how the applicant is, has been, or will be impacted by the development, production, or
conversion of
energy and mineral resources
Weld County accounts for more than fifty percent of all oil and gas activity for the entire state
and therefore is extremely impacted. As of December 2017, Weld County has 23,708 active
wells, which emphasizes why the energy and mineral impacts to Weld County are primarily
related to oil and gas truck traffic activities.
b. Use data
Cite actual use data that documents direct impact as it relates to the need for the project. For example,
"heavy truck traffic directly related to energy development activities is impacting County Road X. a traffic
count done in May 2015 showed energy related truck traffic increased from 100 trips per day to 300."
WCR 17 is an arterial with average annual daily traffic at WCR 54 averages 6,132 with 10%
truck traffic. WCR 54 is an arterial road with annual daily traffic at WCR 17 has an average of
5,828 vehicles per day with 14% truck traffic.
K. MANAGEMENT CAPACITY

How will you separate and track expenditures, maintain funds and reserves for the capital expenditures
and improvements as described in this project?
Weld County's Accounting Department is recognized as a Tier 3 local government by the State
and can manage all invoicing information through Banner Accounting System. In addition,
Public Works will use the project management software PubWorks to assist in administering
the project and grant.
b. Project sustainability
Describe the funding plan in place to address the new operating and maintenance expenses generated
from the
project?
Weld County will continue to utilize the Highway Users Tax Fund (HUTF) for maintenance
expenses.
c. Expertise
Describe the technical and professional experience/expertise of the person(s) and/or professional firms
responsible to manage this project.
Weld County Public Works has several engineers on staff and proven expertise in roadway
improvement projects. Barbara Connolly is the point of contact for this grant and Elizabeth
Relford will be responsible for managing the construction project.
d. Duplication of services
Does the project duplicate service capacity already established? Is the service inadequate? Has
consolidation
of services with another provider been considered?
This is a safety project and does not duplicate service capacity but enhances it. Current
service is dangerous, inadequate, and inefficient to meet existing traffic demands.
L. HIGH PERFORMANCE CERTIFICATION (HPCP) PROGRAM COMPLIANCE
Colorado Revised Statutes (C.R.S. 24-30-1305.5) require all new facilities, additions, and renovation
projects that
meet the following criteria to conform with the High Performance Certification Program (HPCP) policy
adopted by
the Office of the State Architect (OSA) if:
• The project receives 25% or more of state funds; and
• The new facility, addition, or renovation project contains 5,000 or more building gross square feet; and
• The building includes an HVAC system; and
• In the case of a renovation project, the cost of the renovation exceeds 25% of the current value of the
property.
The HPCP requires projects that meet the criteria above to achieve third party verification with the target
goal of
LEED Gold or Green Globes -Three Globes. Projects are strongly encouraged to meet the Office of the
State
Architect's (OSA) Sustainable Priorities in addition to the LEED prerequisites. Projects funded through
DOLA that
meet the above applicability criteria are required to complete the DOLA registration and tracking process.

In instances where achievement of LEED Gold or Green Globe -Three Globes certification is not
achievable, an
applicant may request a modification of the HPCP policy or a waiver if certain conditions exist. DOLA staff
will work
