Monday, November 24, 2025
The Board of County Commissioners of Weld County, Colorado, met in regular session
in full conformity with the laws of the State of Colorado at the regular place of meeting in
the Weld County Administration Building, Greeley, Colorado, November 24, 2025, at the
hour of 9:00 a.m.
Roll Call: The meeting was called to order by the Chair and on roll call the following
members were present, constituting a quorum of the members thereof:
Commissioner Perry L. Buck, Chair
Commissioner Scott K. James, Pro-Tem — Excused
Commissioner Jason S. Maxey
Commissioner Lynette Peppier — Excused
Commissioner Kevin D. Ross
Also present:
Acting Clerk to the Board, Houstan Aragon

Minutes: Commissioner Maxey moved to approve the below listed Minutes of the Board
of County Commissioners meeting, as printed. Commissioner Ross seconded the motion
and it carried unanimously.
1. Minutes from November 10, 2025
Read Ordinances by Audio: Commissioner Ross moved to read the below listed Code
Ordinance by audio. The motion was seconded by Commissioner Maxey and it carried
unanimously.
1. Code Ordinance #2025-16
Amendments to Agenda: There were no amendments to the Agenda.
Consent Agenda: Commissioner Maxey moved to approve the Consent Agenda, as
printed. Commissioner Ross seconded the motion and it carried unanimously.
Warrants:
1. General Warrants: Commissioner Ross moved to approve the General Warrants,
as printed. Commissioner Maxey seconded the motion and it carried unanimously.

Old Business:
1. Consider Updated List of Arbitrators for Property Valuation Appeals
(Continued from 11/19/2025): Esther Gesick, Clerk to the Board, stated the list
was in need of revision to remove individuals who were ineligible to serve, as well
as add new qualified individuals who meet the statutory requirements.
Commissioner Maxey moved to approve said Resolution. The motion was
seconded by Commissioner Ross and it carried unanimously.
New Business — General:
1. Consider Grant Award Letter and Intergovernmental Agreement for 2026
Victims of Crime Act (VOCA) Crime Victim Services (CVS) Funds for Victim
Witness Assistance Unit, and Authorize Chair and 19th Judicial District
Attorney's Office to Sign: Michael Rourke, 19th Judicial District Attorney,
alongside Ermalinda Archibeque and Karol Patch, stated the county has been
awarded $280,000.00. Commissioner Ross moved to approve said agreement and
authorize the Chair and 19th Judicial District Attorney's Office to sign. The motion
was seconded by Commissioner Maxey and it carried unanimously.
2. Consider Grant Award Letter and Intergovernmental Agreement for 2026
Victims of Crime Act (VOCA) Crime Victim Compensation (CVC) Funds for
Federal Crime Victim Compensation, and Authorize Chair and 19th Judicial
District Attorney's Office to Sign: Mr. Rourke stated the county has been
awarded $350,000.00 to be used for victims of crime in Weld County.
Commissioner Maxey moved to approve said agreement and authorize the Chair
and 19th Judicial District Attorney's Office to sign. The motion was seconded by
Commissioner Ross and it carried unanimously.
3. Consider Quote for Purchase of Equipment Pursuant to Cooperative
Agreement Terms and Conditions, and Extension #1, between Sourcewell
and Caterpillar, Inc., and Authorize Controller to Sign any Necessary
Documents — Wagner Power Systems: Toby Taylor, Purchasing Department,
stated the Department of Fleet Services desires to purchase one (1) new 910kW
generator to replace two (2) outdated generators from Caterpillar, Inc., through
Wagner Power Systems as an authorized dealer, on behalf of the Department of
Public Works. He explained, pursuant to Sections 5-4-80 and 5-4-100 of the Weld
County Code, the County may utilize cooperative agreements to purchase goods
and services; therefore, Mr. Taylor stated staff requests the purchase of said
equipment, pursuant to Sourcewell Contract #092222-CAT, for the amount of
$699,176.11. Commissioner Ross moved to approve said sales quote. The motion
was seconded by Commissioner Maxey and it carried unanimously.

4. Consider Contract ID #10066 Single-Source Service Agreement for On-site
Technician for Security Electronics Controls Maintenance at Weld County
Jail and Authorize Chair to Sign — CML Security, LLC: Mr. Taylor stated the
vendor provides security video and recording at the Weld County Jail and to ensure
software compatibility, CML Security, LLC, has been deemed a single-source
vendor. He further stated the current contract expires December 31, 2025, and
indicated staff recommends approval for 2026, for the amount of $57,950.00. In
response to Commissioner Maxey, Michael Baranovic, Deputy Director of the
Facility Department, explained the increase costs to the contract include changing
visits from weekly to monthly, and to retain emergency funds in the event a
technician is called in for an urgent matter, but is likely to cost less than previous
years. Commissioner Maxey moved to approve said agreement and authorize the
Chair to sign. The motion was seconded by Commissioner Ross and it carried
unanimously.
5. Consider Noxious Weed Grant Program Final Report Form for
Reimbursement of 2025 Rush Skeletonweed Eradication and Authorize
Department of Public Works to Submit Electronically: Tina Booton,
Department of Public Works, requested to submit said form to reimburse costs
associated with the mandatory eradication of Rush Skeletonweed in 2025, for the
amount of $7,181.00. Commissioner Ross moved to approve said form and
authorize the Department of Public Works to submit electronically. The motion was
seconded by Commissioner Maxey and it carried unanimously.
6. Consider 2026 State Noxious Weed Program Grant Application for
Eradication of List A (Rush Skeletonweed) Throughout Weld County and
Authorize Department of Public Works to Submit Electronically: Ms. Booton
requested to submit said application for the eradication of Rush Skeletonweed
identified on List A for 2026, in the amount of $8,000.00, in addition to an in-kind
match provided by the County, in the amount of $10,500.00, to cover the cost of
the chemicals. Commissioner Maxey moved to approve said application and
authorize the Department of Public Works to submit electronically. The motion was
seconded by Commissioner Ross and it carried unanimously. (Clerk's Note: Title
of the document was changed post meeting to more accurately reflect the
application's intent.)
7. Consider Biennial Renewal Application for Hotel and Restaurant (County)
Liquor License with One (1) Optional Premises, and Authorize Chair to Sign —
ION, LLC, dba McCarty's Eaton: Matthew Conroy, Assistant County Attorney,
reviewed the history and location associated to the establishment, since 1968,
indicated there are no concerns from referral agencies, and stated staff
recommends approval. Commissioner Ross moved to approve said biennial
renewal application and authorize the Chair to sign. The motion was seconded by
Commissioner Maxey and it carried unanimously.

8. Consider Biennial Renewal Application for Vintner's Restaurant (County)
Liquor License and Authorize Chair to Sign — Salt and Acres, LLC,
dba Salt and Acres: Mr. Conroy reviewed the history and location associated to
the establishment, since 2017, indicated there are concerns regarding outdated
planning permits for outdoor firepits, but stated staff recommends approval and
allow staff to continue to sort out the permits. Commissioner Maxey moved to
approve said biennial renewal application and authorize the Chair to sign. The
motion was seconded by Commissioner Ross and it carried unanimously.
New Business — Ordinances:
1 . First Reading of Code Ordinance #2025-16, In the Matter of Repealing and
Reenacting, with Amendments, Chapter 23 Zoning of the Weld County Code
(EV Charging Stations): Jim Flesher, Department of Public Works, reviewed the
proposed changes to Chapter 23 regarding the zoning of electric vehicle (EV)
charging stations. He elaborated, this Ordinance has not yet been presented to the
Planning Commission, in order to have the final reading completed by
December 31, 2025, for compliance of House Bill 24-1173. No public testimony
was offered concerning this matter. Commissioner Ross moved to approve Code
Ordinance #2025-16 on First Reading. The motion was seconded by
Commissioner Maxey and it carried unanimously.
Public Comment: No public comment was offered.
Let the Minutes reflect that the above and foregoing actions were attested to and
respectfully submitted by the Clerk to the Board. There being no further business, this
meeting was adjourned at 9:16 a.m.
The Board of County Commissioners of Weld County, Colorado, approved the above
and foregoing Minutes, on motion duly made and seconded, by the following vote on the
