HomeMy WebLinkAbout760612.tiff RESOLUTION RE: EXEMPTION OF LAND TRANSFERRED TO WEBSTER FEED LOTS, INC. FROM DEFINITION OF "SUBDIVISION" AND "SUBDIVIDED LAND" . WHEREAS, the Board of County Commissioners of Weld County, Colorado, has reviewed the request of the Union Pacific Railroad Company, Weld County, Colorado, for an exemption of land to be transferred by it to Webster Feed Lots, Inc. from the definition of "subdivision" and "subdivided land" in Section 30-28-101 (10) C.R.S. 1973, as amended, and in Section 2-1 of the Weld County Subdivision Regulations , and WHEREAS, the Board finds that the contemplated transfer does not conflict with the intent of the Weld County Comprehensive Plan and will not have a adverse impact on the existing use of the land, and WHEREAS, the Board has considered the recommendation of the Department of Planning Services on this matter and has reviewed information submitted by the applicant; NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners, Weld County, Colorado, that the transfer of certain lands located in Section 18, Township 6 North, Range 64 West of the 6th P.M. , Weld County, Colorado, and being more particularly described as follows : A strip of land 200. 0 feet wide situate in the SW 1/4 of Section 18 , Township 6 North, Range 64 West of the Sixth Principal Meridian, in Weld County, Colorado, being 100 . 0 feet in width, measured at right angles , on each side of the centerline of the abandoned main track of the Pleasant Valley Branch of the Union Pacific Railroad Company, as formerly constructed and operated, said strip extending northeasterly from the west line of said Section 18 to the east-west centerline of said section. Said centerline crosses said west line of Section 18 at a point 907 feet north from the southwest corner of said section, and extends N. 24°52 ' E. to a point on the north line of said section that is 1991 feet east from the northwest corner. thereof. Weld County, Colorado containing 8.55 acres. The aquisition will be made from UPRR on property that is abandoned for railroad purposes. Webster Feed Lots, Inc. intent is to use the property for fill replacement in our feed lots. The area will be left in a manner so as to be compatible and level with contiguous land. This effort will make the property farmable and able to be utilized by contiguous farm landowners. It is the intent of Webster Feed Lots, Inc. to have the leveling completed by the end of 1976 barring unforseen problems or delays by inclement weather. We have no intent to develop the property in any manner other than leveling to existing grade. There will be no need for water or sewer service to the property. Access will be directly off of County Road 49 to the 8.55 acres, approxiamtely 1000 feet north of State Highway 392. Upon completion of the leveling project, Webster Feed Lot, Inc. , will offer to sell the property to contiguous landowners. We feel that this request is within the intent of the rules and regulations of Weld County and is in the interest of furthering agriculture in the county. The property adjoining our right of way on either side is owned by Mr. Stanley Furrow. We have contacted Mr. Furrow and have been unable to obtain an offer to purchase from him. Mr. Webster has indicated his desire to purchase this portion of right of way for the sole purpose of borrow earth. The area will be leveled and the earth will be moved and used in one of Mr. Webster ' s feedlots . Mr. Webster has no intention of locating a building upon the subject property and is aware of the fact that the County will not grant a building permit in the future. I solicit your approval for the Railroad Company to convey to Mr. Webster the property above mentioned and assume an exemption will be granted.
