USE BY SPECIAL REVIEW (USR) QUESTIONNAIRE:
Planning Questions:
1. The main purpose for the use of the property is to board our horses but we would like to get a permit to
park 6-10 company vehicles.
2. This proposal is constant with the Weld County Code chapter 22 of the comprehensive plan under Section
22-2-20 G A Goal 7: County Land use regulation should protect the individual property owner's right to
request a land use change.
3. This proposal is consistent with the Weld County Code Chapter 23 zoning under Section 22-4-420.

4. Land uses surrounding the site it oil and gas and sand pits and small business. The proposed use is
consistent and compatible with surrounding land use due to the same types of vehicles we will use.
5. Hours & days of operation would be Monday - Friday 6am while employees arrive in their personal
vehicles and leave with the work trucks and return at 7pm and leave In their personal vehicles. Saturdays
leave at 6am & return between 2pm -5pm. (arrive In personal vehicles and leave in work trucks)

Four work trucks will be parked inside the building labeled "horse area" and 2 employee vehicles will be parked in the
100x50 area with the privacy fencing. See Attached.

Again sorry for the delay. I have been working on about six (6) cases at the same time to get to the point of setting them
up.
In regards to item #2 below — 1) demonstrate on the map which building the vehicles will be stored in. and 2) an
e-mail clarifying how many vehicles will be stored inside a building and how many outside.
If you can get this to me today or tomorrow. I will go ahead and run the credit card you have provided me and set up the
case.

Dirt road consists of compacted dirt with crushed rock
how will noise from trucks idling be addressed?
These are newer trucks that the engine is not loud in comparison to larger older model of
trucks with bigger engines like semis. ( I am comparing the noise level of our trucks to the
semi trucks that travel north and south on WCR 25 working the gravel mining pits across the
street from our property.)
Also I believe the privacy fence will help with any noise coming from trucks.

The Departments of Planning Services, Code Compliance, Public Works and Environmental Health
have reviewed your application. The application is incomplete. The following items need to be
addressed:
Per the Department of Environmental Health
Will there be washing of trucks? any maintenance done an the trucks? if so, how will waste
be disposed of. Any fuel storage on site? How will dust on site be controlled from trucks and
employee vehicles driving in and out? how will noise from trucks idling be addressed?

Per the Departments of Planning Services and Code Compliance:
You have not demonstrated that the application meets the requirements to be considered a Home
Business (definition below):
• HOME BUSINESS: An incidental USE to the principal permitted USE for gainful
employment of the FAMILY residing on the property, where:
a.
Such USE is conducted primarily within a DWELLING UNIT or ACCESSORY
STRUCTURE and principally carried on by the FAMILY resident therein.
b.
Such USE is clearly incidental and secondary to the principal permitted USE and shall not
change the character thereof.
1. You are indicating that the vehicles will be parked outside in a l00 x 50 foot area. You indicate
no fencing or screening is proposed. In order to be considered a home business — all (or the
majority of the vehicles) need to be parked inside of a building— the vehicles parked outside to
the building need to be completely screened by either a fence or vegetation. ALL
VEHICLES WILL BE SCREENED BY A PRIVACY FENCING.
You indicate between 6-10 vehicles in the application? WE WILL ONLY BE
PARKING 6 COMPANY VEHICLES. We need an exact number. Ten (l0)
commercial vehicles is a substantial number to be applying for a Home Business — How is the
number of vehicles and employees proposed consistent with the definition of a Home Business?
Staff strongly recommends reducing the number of vehicles and employees that will be
accessing the site to six (6) in order to be considered for compliance with the Home Business
definition. WE WILL BE COMPYING WITH THE HOME
BUSINESS DEFINITION, AND ONLY BE PARKING 6
COMMERCIAL VEHICLES AND REDUCING THE NUMBER
OF EMPLOYEES ACCESSING THE SITE. BY REDUCING
EMPLOYEES ACCESSING THE SITE, THIS WILL BE DONE
BY HAVING THE ADDITIONAL EMPLOYEES MEETING AT
A JOB SITE.
2. The application does not address what type of commercial vehicles will be parked on site (when
not in operation or at another job site). THE COMMERCIAL VEHICLES
THAT WILL BE PARKED ON SITE ARE CONSISTING OF 3
2014 DODGE RAM 3500, AND 3 2015 GMC PICKUPS.
3. The property owner needs to live on the same property as the business. You have not
demonstrated that you have satisfied this condition. (WHAT KIND OF
DOCUMENTATION IS NEEDED FOR TO COMPLY WITH THIS
REQUEST?)
4. Response #16 — you need to include the name of the Fire District (Fort Lupton Fire
District). FORT LUPTON FIRE DISTRICT
5. The site map shall be revised to reflect the comments under item #1 above. (WILL BE
SUBMITTED THIS EVENING)
6. Fort Lupton IGA — in follow up to the 6/25 e-mail you provided? Have you had a discussion
with Todd Hodges regarding annexation? —If so — what date did this occur?

County. The City has annexed CR 25 adjacent to the your property and we are interested in discussing the option of
annexation of the property instead of going through the County process,

NEIGHBORHOOD MEERTING MINUTES
• The meeting started at 10:00 am with only Mr. Robert R. Feis present.
• We explained to Mr. Robert R. Feis, who is the CPA in charge of the Trust for the property at
8825 WCR 25, our intentions of applying for a USR permit at 8804 County Road 25.
• After explaining our proposal Mr. Feis had no objections and had only positive feedback and was
not concerned in touring the property.
• Meeting adjourned at 10:20 am as no other neighbors showed up.
