RE: GRANT OF CONDITIONAL USE PERMIT NO. 25 : 77 : 2 TO AMERICAN
PRODUCTS.
WHEREAS, the petition of American Products , 5891 Nolan Street,
Arvada, Colorado, for a Conditional Use Permit for a Labor Housing
Development on a tract of land located in the Southwest Quarter of
Section 2 , Township 1 North, Range 65 West of the 6th P.M. , more
particularly described as follows :
Considering the South line of the SWa of the said
Section 2 as bearing N. 90°00 ' East and with all
bearings contained herein relative thereto:
Commencing at the SW Corner of the said Section 2 ;

of Beginning.

came on for hearing at a public meeting held on February 23 , 1977 ,
in the Chambers of the Board of County Commissioners , Weld County,
Colorado, and
WHEREAS, the above described parcel of land is located in
an Agricultural Zone as set forth in the Weld County Zoning
Resolution, and
WHEREAS , the above described parcel of land is below the
minimum lot size of 80 acres required in an Agricultural Zone,
and
WHEREAS , Section 3. 3.D. 4.0 of the Weld County Zoning
Resolution authorizes such a use in the Agricultural District on
the grant of a Conditional Use Permit by the Board of County Com-
missioners , and
WHEREAS , the petitioner was present, and
WHEREAS , the Board of County Commissioners had considered
all the testimony and statements of those present, has studied
the request of the petitioner , and has studied the recom-
mendations of the Weld County Planning Commission, and having been
fully informed and satisfied that the requested use complies

with the Weld County Comprehensive Plan and the provisions of
the Weld County Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners, Weld County, Colorado, that the application of
American Products for a Conditional Use Permit be granted.
The above and foregoing Resolution was on motion duly made
and seconded, adopted by the following vote on the 23rd day of
February, A.D. , 1977.
The above and foregoing Resolution was read into the record
and signed on the 9th day of March, A.D. , 1977.

Resolution
of the neighborhood and existing agricultural uses, need
for the proposed use, its effect upon the immediate area,
its effect on future development of the area and the
health, safety, and welfare of the inhabitants of the area
and the County. "
This determination is based on the following:
A. The Town of Hudson Planning Commission has indicated the
Town has no objections to the proposed facility.
B. The Weld County Health Department has indicated the proposal
is in compliance with all applicable Weld County and State
Health Standards and Regulations.
C. The State Department of Highways has indicated the access off
State Highway 52 is adequate and they see no problems with
the proposal.
D. The Weld County Engineering Department has indicated they were
unable to identify any engineering problems with the request.
E. The Farmers Reservoir & Irrigation Company has indicated that
the concerns and interests of the ditch company have been
cooperatively met by American Products so that the proposed
facility will be compatible with the operation and maintenance
of the irrigation ditch.
COMMENTS :
1. No response has been received from the Hudson Fire Protection
District .
2. It should be pointed out that Wayne and Norma Arnold, who are
adjacent property owners submitted a letter NN in opposition
to this labor housing facility.

Mr. Heitman made a general statement to the Planning Commission
commending them for their sincere work on this case.

APPEARANCE : Greg Marrs
DISCUSSION: Mr. Marrs explained the they would like to locate
a family operated dairy farm on the above described parcel .
The facility would house approximately 120 milking cows, plus
dry cows and young stock. He also explained the water system
and waste disposal system. Mr . Marrs explained that housing
will be needed for himself but it will not be in this Special
Use Permit area.
Tom Hann read the comments recommending approval of this
application and also read the development standards .
MOTION: Be it therefore resolved to recommend to the County
Commissioners for approval subject to development standards .
Motion by Mr. Nix, Seconded by Ms. Kountz. A vote of "aye"
by Mr. Hiatt , Mr. Carlson, Ms. Yost , Mr. Heitman, Mr. Ashley, '

SUBJECT: Labor Housing
APPEARANCE: Joel Meyer
DISCUSSION : Mr. Meyer explained that they want to build a 20
unit migrant housing complex near Hudson. They will be for
the cucumber crop pickers that will come up from Texas .
He also explained the water and sewage and the transportation
method. He explained that they will provide transportation
for the workers back and forth from the fields, but that some
of them may have their own cars. He explained that there are
usually families of 3 to 5 in a family . They are required to
stay with them until the frost , or until tanks are filled.
The liability for these people were discussed but Mr. Meyer
did not have the answer . He did not know. He explained that
the crew leader was responsible for the people and he was
required to have insurance but as for the people themselves ,
he was not sure.

Mr . Meyer explained that he had contacted Mr. Arnold, who
had written a letter of opposition, and stated that Mr.
Arnold said he was sorry he had written the letter before
Mr. Meyer had gotten to talk to him.
Tom read the comments recommending approval and also read
the development standards. He also read Mr. Arnold ' s
letter since Mr . Arnold was not at the meeting.
Mr . Meyer presented map showing area.
MOTION: Be it therefore resolved to recommend to the County
Commissioners approval of this request subject to develop-
ment standards . Motion by Mr. Hiatt , seconded Mr. Ashley.
A vote of "aye" by Mr. Hiatt , Mr. Carlson, Ms. Yost , Mr.
Heitman, Ms . White, Mr. Ashley, Ms. Kountz, Mr. Nix. Motion
Carried.
Mr. Honn presented a case by the Town of Serverance for a
site approval . He explained that it would have to be a pre-
liminary approval subject to final approval of Special Use
Permit . He explained that the proposal was for an 80, 000
gallon a day lagoon system and would be 100% domestic use. It
would be located on Agriculturally zoned land. Tom explained that
they need to have Planning Commission sign the check list so the
can start the process with the State Division of Health.
MOTION: Be it therefore resolved to authorize staff to contact
the State Department of Health to see if Planning Commission
needs to sign off on this check list before they (State
Department of Health) can take any action. If it is necessary
that they sign it off first , the staff will bring it back to
Commission for chairman ' s signature and indicate the conditional
approval with the condition that the applicant has to come through
for a Special Use Permit before the County can give final approval
If it is not necessary, staff will send it to the State Department
of Health indicating that Commission will sign it off when the
Special Use Permit is approved by the County. Motion by Mr .
Ashley. Seconded by Ms. Kountz. A vote of "aye" by Mr. Hiatt
Mr . Carlson, Ms. Yost , Mr . Heitman, Ms. White, Mr. Ashley, Ms.
Kountz, and Mr. Nix. Motion Carried.

; DEVELOPMENT STANDARDS •
(APPROVED)
1 . The uses permitted under this Conditional Use Permit
are two ten-unit migrant farm labor houses to house
up to 100 farm employees , with an unattached bath house.
The use of these labor houses shall be restricted to the
months of May through September for occupancy during
that period by farm labor. One unit may be occupied
full time by tenant farm labor for the purpose of pro-
tection and maintenance of the hereon described use .
2 . The method of sewage disposal shall be in conformance
with all applicable State and County Health regulations .
3. All structure shall be built in conformance with the
Building Code adopted by WEld County (Uniform Building
Code) .
4 . The 20 foot access driveways and the parking area shall
be private in nature and they shall be graveled. A min-
imum of 10, 000 square feet of parking area shall be pro-
vided.
5 . A 6 foot high chain link fence shall be placed around the
facility as shown on the Conditional Use Permit plans for
security purposes .
6 . The Conditional Use Permit area shall be maintained in
such a manner so as to prevent soil erosion , fugitive dust ,
and the growth of noxious weeds.
7 ' The Conditional Use Permit shall be limited to the plans
as shown hereon and governed by the development standards
stated above and all applicable Weld County regulations .
Any change to the plans and or the development standards
shall require the approval of another Condtional Use
Permit before such changes shall be permitted.

Gentlemen:
We are herewith making formal application for a Conditional Use Permit and
will use your procedural guide to assure that we are submitting all of the
documents necessary.
1. a) Conditional User Permit Application is attached.
b & c) See M & I Inc., Consulting Engineers Plat Plan furnished herewith.
d) Application for soil survey and study has been requested from the
Soil Conservation District, Greeley, Colorado. Report enclosed.
e) We plan to build two — 10 unit housing complexes with public
bath and wash houses to house up to 100 people. These units will
only be occupied during the months of June, July, August and September.
f) Plans call for a septic tank and leach field for a minimum of 100 people.
g) Water: We have a Well Permit from the State of Colorado for deep
water and have contracted Holden and Holden of Hudson, Colorado
to drill when the building permit has been obtained. A copy of
Well Permit is enclosed.
h) Access: We will grade, gravel and maintain a private road along
the east side of our property which will be on the west side of
Neres Canal operated by the Farmers Reservoir and Irrigation Company
ditch. We have leased the necessary 620 feet of right of way of
the Farmers Reservoir and Irrigation Company right of way north of
Highway #52, as shown on the M & I Inc., Consulting Engineers
Plat Plan. A copy of the Farmers Reservoir and Irrigation Company
lease is enclosed herewith.

This is to acknowledge receipt of additional information concerning
the water supply for the above referenced application for a labor housing
project. This information consists of water use values for an identical
housing facility near Gilcrest served by a metered water line. This
facility used 318,000 gallons of water last summer which is less than the
381 ,000 gallons available to the proposed project from the deep non-
tributary well . Based upon this information, we have no objection to the
approval of this application.

Dear Mr. Fortner:
This is to acknowledge receipt of information concerning the above
referenced conditional use permit. We understand that American Products
intends to utilize water from Well No. 21904-F to serve the proposed Labor
Housing. While we have no objection to this use, we would like to point
out that this well has an appropriation limitation of 1.17 acre-feet per
year. If the housing is used at a maximum capacity of 100 people for the
entire four month period, there would be approximately 30 gallons per
person per day available . This is considerably less than the 65 to 75
gallons per person per day normally used for planning purposes . In light
of this insufficient water supply, we do not recommend approval of this
application. If additional information is provided, we would be most
happy to review it upon your request.

THIS LEASE, made this 10th day of January , gt7cg,
by and between The Farmers Reservoir and Irrigation Company, a
Colorado corporation, as Lessor, hereinafter sometimes called
"FRICO, " and American Products Company, a partnership, as Lessee,
hereinafter sometimes called "American, "
WITNESSET H:
Recitals :
1 . FRICO owns and operates that certain irrigation
canal known as the Neres Canal, a part of which is located in,
over and across the Southwest Quarter of Section 2, Township 1
North, Range 65 West, Weld County, Colorado.
2 . American owns a tract of land in the said Southwest
Quarter of said Section 2 to which it desires ingress and egress
which can be obtained by the construction and maintenance of a
private roadway over and along the ditch bank of the said Neres
Canal .
3. FRICO is willing to lease to American, upon the terms
and conditions hereinafter set forth, the strip of land herein-
after described to be used as a private roadway.
NOW, THEREFORE, in consideration of the premises, the
promises and covenants hereinafter set forth and the payment of
an annual administrative fee of Fifty Dollars ($50 .00) by American
to FRICO, the receipt of the first annual administrative fee
being duly acknowledged by FRICO as of the date of this Lease,
FRICO leases to American the following described strip of land:

A strip of land being 20 feet in width
and 620 feet in length on the extreme
west side of the west bank of the said
Neres Canal laying in, over and across
a part of the Southwest Quarter of
Section 2 , Township 1 North, Range 65
West, Weld County, Colorado.
The term of this Lease shall be for a period of one
year from the date hereof with the right in American, if not in
default or in violation of any of the terms hereof, to renew
the same for successive one-year periods upon the payment of the
annual administrative fee of Fifty Dollars ($50 . 00) to FRICO at
FRICO' s office in Brighton, Colorado, and upon the same terms
and conditions as herein set forth.
Said strip of land to be used by American for a private
roadway affording ingress and egress to American' s property in the
said Southwest Quarter of said Section 2 from State Highway 52 .
Said private roadway to be constructed and maintained by American
in accordance with plans approved and supervised by the Superin-
tendent of FRICO.
Said private roadway shall be for use by American, its
employees and agents and by FRICO, its employees and agents .
Said private roadway shall not be constructed, main-
tained or used in any manner whatsoever which might interfere
with the operation of said Neres Canal by FRICO.
American shall post and keep posted on said private
roadway signs or other markings clearly describing the same as a
private roadway and if, in the opinion of both FRICO and American,
fences or gates need to be constructed, such construction will be
done at American' s sole expense.
It is understood and agreed that if American defaults
in the performance of any of its promises or obligations as herein
imposed upon American and such default shall continue without

correction for a period of seven days after notice in writing
from FRICO to correct, American shall, without any further action
on the part of FRICO, forfeit all rights granted by this Lease and
shall immediately cease using the above-described strip of land
for roadway purposes .
American agrees to and does hereby assume full res-
ponsibility for the use of said roadway by any persons whomsoever
and further agrees to indemnify, save and hold harmless FRICO,
its agents and employees from any and all claims for damages or
injuries to person or property by any persons whomsoever arising
directly or indirectly from the construction, maintenance or
use of said private roadway.
American agrees not to assign this Lease or any right
granted hereunder without first obtaining the written consent of
FRICO.
Executed in duplicate the day and year first above

own and operate a farm near Gilcrest, Colorado on which the above
referred conpany built a low income housing unit from the same building
plans being proposed at their new site at Hudson, Colorado.
During the fir-:t years' operation of this unit on our farm there was not
one single disturbance nor were there any problems caused by the inhabitants,.
We are grateful for this housing which enables us to have labor needed in
our fields, primarily for picking cucumbers. The labor is much happier
in these unit: than In refurbished old farm house: spread throughout the
county. Perhaps it -a for this reason that with the exception of three
screen door screens there >:a s no dar:we done to the>e units this past
year.
