MEMORANDUM TO: Board of County Commissioners December 20, 2019 FROM: Esther Gesick, Clerk to the Board SUBJECT: 2020 Newspaper Bid #61900150 Historically, publication bids were based on different widths of columns, which made it difficult to compare prices. As a result, we ask each bidder to price three sample notice publications, and then the cost of those sample notices is calculated to acquire an estimated annual cost based upon the average number of notices to be published in the next year. In considering the bid, it is important to remember that the largest amount of publication of notices is in the Type #1 format, so it is reasonable to expect that the bidder lowest in cost in the Type #1 format is the lowest bidder. Based on the following summary, The Tributary is the apparent low bidder. The Tributary publishes on Wed. with a Fri. submittal deadline. It should also be noted that each Bidder has an online presence. The Tributary does not charge for its online access, and the subscription for printed papers is $12/year. The two bidders are the Greeley Tribune and The Tributary. Attached is a copy of a Memorandum dated December 31, 2018, which I provided the Board of County Commissioners for the 2019 legal newspaper services bid. My concerns regarding the Tributary remain largely the same as those I stated a year ago: 1. Availability and Transparency. The Greeley Tribune provided a copy of its Form 3526 with its 2020 bid (see the attached). It is dated September 22, 2019. As you can see from the Form 3526, the Tribune's "Total Distribution - No. Copies of Single Issue Published Nearest to Filing Date" is 12,453. The Tribune's website is updated daily. The website includes a portion devoted to legal notices only, which includes search capability. The website has published the County's legal notices without incident for 2019. It may be found at: https://www.greeleytribune.com/ The Tribune's website allows non -subscribers to see the legal notices it publishes. The Tributary did not provide a copy of its Form 3526, so its total distribution is unknown. The Tributary has a website located at: https://thetribnews.com/ The website includes free electronic access to issues of its newspapers for October through December, 2019. I am uncertain if issues previous to October, 2019, have been shown on the website. If The Tributary is awarded the bid, the public would be able to view the County's legal notice published in the Tributary by reviewing the electronic newspapers that are listed on the website. Between the two publications, the Greeley Tribune is superior in its availability and transparency. My concern with The Tributary is unknown distribution and lack of search capability on its website. 2. Reliability. It is vitally important that the County's legal notices be published on -time and accurately. Additionally, the County expects the legal newspaper to provide "proofs of publication" after every publication of a legal notice by affidavit of the publisher, as described in C.R.S. § 24-70-105. If the legal newspaper fails to publish accurately and meet publication deadlines, the County could be placed in legal jeopardy for failure to properly notice for hearings, such as land use, budget, etc. Additionally, failure to accurately and timely publish can cause great inconvenience to the members of the public who take time off for hearings that must be continued. Such continuances also result in lengthy delays to applicants. I am concerned about The Tributary's reliability. A year ago, after reviewing The Tributary's bid, I asked Bob Grand to provide a copy of The Tributary's Form 3526. He understood then why that form was important for the County's consideration and he sent it to me upon my request. However, this year, with prior 1 knowledge of such importance, he did not provide The Tributary's Form 3526 with his bid. There seems to be an expectation by Mr. Grand that if we need information to help us assess his bid it is incumbent upon us to contact him to get that information. This leads me to conclude that if The Tributary is awarded the 2020 bid, our working relationship with Mr. Grand will continue along the same path and he will have difficulty meeting our requirements without constant prompting and inquiry. As stated above, the Tribune included its Form 3526 with its 2020 bid. The Tribune has been accurate and timely in its publication of County legal notices for the past year. The Tribune sends its affidavits of proof of publication to the Clerk to the Board without reminder or prompting. 3. Compliance with Statutory Requirements. I checked the Colorado Press Association ("CPA") website today. The Tributary is not listed as a member of the CPA, although the online membership list may not be up to date. I sent emails to the CPA and called to leave messages, but no response as of today. As a result, I cannot at this time assess whether or not The Tributary is signed up to place legal notices on the statewide website established and maintained by the CPA for the publication of legal notices. "Public Notice Colorado" may be found at this website: https://www.publicnoticecolorado.com/ C.R.S. § 24-70-103(5) says the following: (5) When any legal notice is required by law to be published in any newspaper, the newspaper publishing the notice shall, at no additional cost to the person or entity placing the notice, place the notice on a statewide website established and maintained by an organization representing a majority of Colorado newspapers as a repository for the notices. While C.R.S. § 24-70-103(5) is a prospective requirement, meaning the legal newspaper is not required to prove it has posted on the Public Notice Colorado website in the past but is expected to do so in the future, it is important that the legal newspaper the County chooses be prepared to post immediately upon being awarded the bid. The Tribune is a member of the CPA and has regularly been posting the County's legal notices on the Public Notice Colorado website for the past year as required by statute. I note that this issue came up a year ago. I believe Mr. Grand knows it is an issue. However, his letter of December 3, 2019, makes no mention of membership in the CPA. Barker, Weld County Attorney Don Warden, Director of Finance and Administration SUBJECT: 2019 Newspaper Publishing Bid The Colorado Revised Statutes addressing legal newspapers has two requirements. The first is set forth in C.R.S. § 24-70-102, shown below in the bold highlighted portion: § 24-70-102. Legal publications Every newspaper printed and published daily, or daily except Sundays and legal holidays, or on each of any five days in every week excepting legal holidays and including or excluding Sundays shall be considered and held to be a daily newspaper; every newspaper printed and published at regular intervals three times each week shall be considered and held to be a triweekly newspaper; every newspaper printed and published at regular intervals twice each week shall be considered and held to be a semiweekly newspaper; and every newspaper printed and published at regular intervals once each week shall be considered and held to be a weekly newspaper. No publication, no matter how frequently published, shall be considered a legal publication unless it has been admitted to the United States mails with periodicals mailing privileges. (Emphasis added.) We have confirmed with the Denver Business Mail Entry Unit that both The Tribune and The Tributary have been "admitted to the United States mails with periodicals mailing privileges." To maintain that status, each newspaper is required to file a PS Form 3526 with its Post Master (known as the "Statement of Ownership") on or before October 1st of each year. The Tribune filed its Statement of Ownership on September 30, 2018. The Tributary filed its Statement of Ownership on November 26, 2018. Each newspaper is also required to publish its Statement of Ownership on or before October 31St of each year. The Tribune says it published its Statement of Ownership on September 30, 2018. The Tributary says it published its Statement of Ownership on December 7, 2018. Copies of both Statements of Ownership are attached hereto. In an email from Bob Grand and received by Bruce on December 18, 2018, Mr. Grand stated the following: "Attached is our form 3526 which was filed for 2018. It was late Normally the Keenebsurg Post Master sends me a note reminding me but she has been out of the office to handle supplementyal duities. I have attached a copy of her note to me which was dated in November., p70/9 -9v, Memorandum, Board of County Commissioners December 31, 2018 Page 2 The form was submitted and published in 2018. No other communication received from Post Office regarding this. Still continuing to publish weekly as required." Also attached to Mr. Grand's email was a pdf entitled, "Note from Post Mistriss in Keenesburg on USPS from 3526 Tributr." The pdf is a picture of a sticky note apparently left for Bob Grand by the Post Master from Keenesburg. It says the following: "Bob, Please fill this out + return. Thanks, Jennifer Date: 11/14/18." A copy of the pdf is attached hereto. Late filing and publication of the Statement of Ownership do not appear to be fatal to the newspaper's ability to have periodicals mailing privileges. At the end of the PS Form 3526, it says the following: "Failure to file or publish a statement of ownership may lead to suspension of periodicals authorization." (Emphasis added.) To date there does not appear to be any suspension of The Tributary's "periodicals authorization" because of its late filing and publication of its Statement of Ownership in 2018. The second requirement of a legal newspaper is set forth in C.R.S. § 24-70-103(1): § 24-70-103. Requisites of legal newspaper (1) Any and every legal notice or advertisement shall be published only in a daily, a triweekly, a semiweekly, or a weekly newspaper of general circulation and printed or published in whole or in part in the county in which such notice or advertisement is required to be published, except as provided in this section. The newspaper, if published triweekly, semiweekly, or weekly, shall have been so published in such county, except as provided in this section, continuously and uninterruptedly during the period of at least fifty-two consecutive weeks next prior to the first issue thereof containing any such notice or advertisement; and the newspaper, if published daily, shall have been so published in such county, uninterruptedly and continuously, during the period of at least six months next prior to the first issue thereof containing any such notice or advertisement. In the case of a municipality having territory in two counties, each of which counties has one or more legal newspapers within the municipality, the publication by such municipality of its legal notices and advertisements in one of such newspapers shall be construed as valid publication under this part 1. (Emphasis added.) One would think the bold highlighted portion of C.R.S. § 24-70-103(1) requires actual publication of the newspaper in Weld County "continuously and uninterruptedly" for at least the 52 consecutive weeks "next prior to the first issue thereof containing any such notice or advertisement." Esther Gesick does not have a firm date for the first County published a legal notice in 2019, but we know it will be sometime after January 2, 2019. So, a logical reading of § 24-70-103(1) would lead one to believe the legal newspaper must be published continuously, Memorandum, Board of County Commissioners December 31, 2018 Page 3 uninterruptedly, and consecutively since January 2, 2018. However, the definition of the term, "published" in C.R.S. § 24-70-101 says this: § 24-70-101. Definitions As used in this part 1, unless the context otherwise requires: (4) "Published" means a newspaper maintains an office in the county to gather news, sell advertising, or conduct the general business of newspaper publications. (Emphasis added.) Thus, the actual requirement of C.R.S. § 24-70-103(1), is that the legal newspaper must "maintain an office" in Weld County "to gather news, sell advertising, or conduct the general business of newspaper publications" continuously, uninterruptedly, and consecutively since January 2, 2018. To date, The Tribune and The Tributary have each met this requirement. In conclusion, it is our opinion that both The Tribune and The Tributary meet the legal requirements of being a "legal newspaper," as set forth in the Colorado Revised Statutes. We have concerns about awarding the bid to The Tributary. They are the following: 1. Availability and Transparency. The Statement of Ownership for The Tributary lists its "Average No. Copies Each Issue During Preceding 12 Months" as 75. Neither of us has ever seen a copy of The Tributary. The Tributary has a website at: https://thetribnews.com/ The website does not describe how The Tributary may be subscribed to or where it may be found, and does not include any information about the publication or its contents. The Tributary's website is blank. We are concerned that although an award of the bid to The Tributary would meet the requirements of lowest price and the statutory requirements for "legal newspaper," the County would not be making its legal notices available to the public and thus transparent. By contrast, The Tribune's Statement of Ownership lists its "Average No. Copies Each Issue During Preceding 12 Months" as 13,533. The Tribune's PS Form 3526-X lists its "Total Print Distribution ... + Paid Electronic Copies" as 26,026. The Tribune's website is updated daily. It may be found at: https://www.greeleytribune.com/ The Tribune's website allows non -subscribers to see the legal notices it publishes. 2. Reliability. It is vitally important that the County's legal notices be published on - time and accurately. Additionally, the County expects the legal newspaper to provide "proofs of publication" after every publication of a legal notice by affidavit of the publisher, as described in C.R.S. § 24-70-105. Federal law requires each publication to maintain its periodicals mailing privileges by filing its Statement of Ownership on or before October 1St of each year. The publication is also required to publish the Statement of Ownership on or before October 31St. As stated above, The Tributary met neither of these deadlines. The excuse given for such tardiness by Mr. Grand was that the Keenesburg Post Master was out of the office and did not send to him the reminder he normally receives from her. We wonder if The Tributary will similarly miss deadlines for the County's legal notices. Will Mr. Grand be expecting the Clerk to the Board to provide him with reminders of dates when legal notices must be published and prompting to return the affidavits showing proof of publication? By contrast, The Tribune filed and published its Statement of Ownership on time. The Tribune has been accurate and timely in its publication of County legal notices for the past six years. The Tribune sends its affidavits of proof of publication to the Clerk to the Board without reminder or prompting. 3. Compliance with Statutory Requirements. Bruce checked with the Colorado Press Association ("CPA") today and found The Tributary is not a member of the CPA and is not signed up to place legal notices on the statewide website established and maintained by the CPA for the publication of legal notices. Employees retiring from County service must separate their regular employment from Weld County in order to draw benefits from the Weld County Retirement Plan. They do not have a right or expectation of continued employment with Weld County. Contract employment of a retired employee shall be at the discretion of the Elected Officer or Department Head. Such contract employment shall be "at will" and shall be governed by terms and conditions set forth in a con- tract signed by the Board of County Commissioners and the retired employee and pursuant to the requirements of this Section. An example of such a contract may be found in Appendix 3-C. B. Employees retiring from County service under the Retirement Plan may, upon approval by the department head or elected official, work no more than a total of one thousand nine hundred seventy-six (1,976) hours annually, January to January. The retired employee may not receive disability insurance coverage, but may be eligible for health, dental and vision insurance either as a reemployed worker, or through the retiree health plan, if he or she qualifies. 1. Hourly. An hourly retiree employee is paid only for the hours worked and is not eligible to receive benefits. 2. Part-time. A pan -time retiree employee is regularly scheduled to work less than forty (40) hours per week. The part-time employee who consistently works at least twenty (20) hours per week may be eligible for certain benefits. 3. Job Share Retired with benefits. A Job Share retiree employee works pan -time and may be eligible for certain benefits, including Step increases. The needs of the department and/or County will dictate if this status is possible. This Day in History - October 30, 1938 Welles Scares Nation Orson Welles causes a nationwide panic with his broadcast of "War of the Worlds" —a realistic radio dramatization of a Martian invasion of Earth. Orson Welles was only 23 years old when his Mercury Theater company decided to update H,G, Wells' 19th -century science fiction novel War of the Worlds for national radio. Despite his age, Welles had been in radio for several years, most notably as the voice of "The Shadow" in the hit mystery program of the same name. "War of the Worlds" was not planned as a radio hoax, and Welles had little idea of the havoc it would cause. The show began on Sunday, October 30, at 8 p.m. A voice announced: "The Columbia Broadcasting System and its affiliated stations present Orson Welles and the Mercury Theater on the air in 'War of the Worlds' by H.G. Wells." Sunday evening in 1938 was prime -time in the golden age of radio, and millions of Americans had their radios turned on. But most of these Americans were listening to ventriloquist Edgar Bergen and his dummy "Charlie McCarthy" on NBC and only turned to CBS at 8:12 p.m. after the comedy sketch ended and a little-known singer went on. By then, the story of the Martian invasion was well underway. Welles introduced his radio play with a spoken introduction, followed by an announcer reading a weather report. Then, seemingly abandon- ing the storyline, the announcer took listeners to "the Meridian Room in the Hotel Park Plaza in downtown New York, where you will be enter- tained by the music of Ramon Raquello and his orchestra." Putrid dance music played for some time, and then the scare began. An announcer broke in to report that "Professor Farrell of the Mount Jenning Observatory" had detected explosions on the planet Mars. Then the dance music came back on, followed by another interruption in which listeners were informed that a large meteor had crashed into a farmer's field in Grovers Mills, New Jersey. Soon, an announcer was at the crash site describing a Martian emerging from a large metallic cylinder. "Good heavens," he declared, "some- thing's wriggling out of the shadow like a gray snake. Now here's another and another one and another one. They look like tentacles to me ... I can see the thing's body now. It's large, large as a bear. It glistens like wet leather. But that face, it,.. it ... ladies and gentlemen, it's indescribable. I can hardly force myself to keep looking at it, it's so awful. The eyes are black and gleam like a serpent. The mouth is kind of V-shaped with saliva dripping from its rimless lips that seem to quiver and pulsate." The Martians mounted walking war machines and fired "heat -ray" weapons at the puny humans gathered around the crash site. They an- nihilated aforce of 7,000 National Guardsman, and after being attacked by artillery and bombers the Martians released a poisonous gas into the air. Soon "Martian cylinders" landed hi Chicago and St. Louis. The radio play was extremely realistic, with Welles employing sophisticated sound effects and his actors doing an excellent job portraying terrified announcers and other characters. An announcer reported that widespread panic had broken out in the vicinity of the landing sites, with thousands desperately trying to flee. The National Highway Traffic Safety Administration attributed the 2.4% drop partially to tech- nology in newer vehicles that can prevent crashes. A total of 36,560 people died on the nation>s roads in last year, the latest full -year sta- tistics available. The agency said the downward trend is continuing into 2019. First- half estimates show fatalities down 3.4%. "This is encouraging news, but still far too many perished or were injured, and nearly all crashes are preventable, so much more work remains to be done to make America's roads safer for everyone," Transportation Secretary Elaine Chao, whose department oversees NHTSA, said in a statement. The overall declines in 2017 and 2018 came after two years of large increases blamed on people driving more as the economy improved. But pedestrian deaths rose 3.4%, and the number of people killed on bicycles and other ped- aled vehicles went up 6.3%. People killed in large -truck crashes rose just under 1%. The agency reported 6,283 pedestrian deaths, the highest total in 28 years, according to Con- sumer Reports, which said pedestrian fatalities have risen about 53% since 2009. NHTSA said alcohol -impaired fatalities dropped 3.6% in 2018, while fatalities attributed to speeding fell 5.7%. Motorcycle deaths declined 4.7%, the agency said. Most of the pedestrian deaths, 76%, and half the bicyclist deaths occurred after dark, and the some pedestrians and cyclists had some alcohol in their systems. Seventy-four percent of the pedestrian deaths occurred outside of intersections, the agency reported. NHTSA also said it would look into the increase in SUVs as a factor in the increases. SUVs sit taller than cars, which can make it more difficult for drivers to see pedestrians and cyclists. The agency said in a statement that it's also studying changes in its five-star crash assessment program and will consider including new technologies such as pedestrian detection systems. It's also working with the Federal Highway Administration to reduce bicycle and pedestrian deaths. "This is an epidemic of preventable deaths," said Jake Fisher, senior director of auto testing for Consumer Reports. "We need to double down to figure out how to achieve better pedestrian detection and more widespread adoption." The agency said that the number of deaths in crashes with distracted drivers hit 2,841 in 2018, or 7.8% of total traffic deaths. But the 2018 number is down 12.4% from 2017, according to the agency. The Truck Safety Coalition, an advocacy group, said crashes involving at least one large truck killed 4,951 people last year. In a statement, the group said fatalities involving large trucks have increased 46.5% in the past decade, yet the administration of President Donald Trump has pushed for proposals that would make it easier for truck drivers to work 17 -hour days, and to remove a 3o -minute break requirement for truck drivers after eight hours of work. At the same time, the Transportation Department hasn't done anything to advance safety rules that would require automatic emergency braking or electronic speed limiters for big rigs, the statement said.
