The Weld County Department of Public Works has reviewed this proposal. Staff comments made during
this phase of the application process may not be all-inclusive, as other issues may arise during the
remaining application process.
COMMENTS
GENERAL PROJECT INFORMATION/LOCATION
Project description: A Site Specific Development Plan and Use by Special Review Permit for a use similar
to uses allowed by special review as long as the use complies with the general intent of the A (Agricultural)
Zone District (Event Facility) in the A (Agricultural) Zone District
This project is north of CR 50 and is west of CR 13.
Parcel number 106101200046.
Access is from CR 50.
ACCESS
Access is on CR 50, which is being annexed by the Town of Johnstown.
ROADS AND RIGHTS -OF -WAY
Currently in this location, County Road 50 is a gravel road and is designated on the Weld County Functional
Classification Map (Code Ordinance 2017-01) as a local road, which requires 60 feet of right-of-way. The
applicant shall delineate and label on the site map or plat the future and existing right-of-way (along with
the documents creating the existing right-of-way) and the physical location of the road. If the right-of-way
cannot be verified it shall be dedicated. Pursuant to the definition of setback in the Weld County Code,
Chapter 23, Article III, Section 23-3-50, the required setback is measured from the future right-of-way line.
Be aware that physical roadways may not be centered in the right-of-way. Currently this road is maintained
by Weld County.
This portion of County Road 50 is being annexed by the Town of Johnstown. The municipality will have
jurisdiction over access to the road. Please contact the municipality to verify the right-of-way requirements,
access permit or for any additional requirements that may be needed to obtain a permit.
Per Chapter 12, Article 4, Section 12-4-30.B, a Weld County Right -of -Way Use Permit is required for any
project that will be occupying, constructing or excavating facilities within, and/or encroaching upon, any
County rights -of -way or easement. Right -of -Way Use Permit instructions and application can be found at

Weld County will not replace overlapping easements located within existing right-of-way or pay to relocate
existing utilities within the County right-of-way.
TRAFFIC
Latest ADT on CR 50 counted 567 vpd with 17% trucks. The 85th percentile speed is 57 mph.
The traffic information submitted with the application materials indicated that there will be approximately
25-40 roundtrips per event.
IMPROVEMENTS AND ROAD MAINTENANCE AGREEMENT
Public Works may require an Improvements Agreement for one or all the following reasons:
• Off -Site Public Improvements
• Road Maintenance Agreement
• Construction Maintenance Agreement
• Access Improvements Agreement
An Improvements Agreement is required for sites with required off -site improvements per Chapter 12,
Article 5, Section 12-5-60. Collateral is required to ensure the improvements are completed, and
maintained.
Improvements/Road Maintenance Agreement: An example agreement is available at:

haul route(s), outline when off -site improvements will be triggered, and include a maintenance agreement
for the haul routes. Possible mitigations included in the road maintenance agreement may include but are
not limited to: dust control, specified haul routes, damage repairs, and future improvement triggers.
DRAINAGE REQUIREMENTS
This area IS within an Urbanizing Drainage Area: Urbanizing Drainage Areas typically require detention of
runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of the detained water at
the historic runoff rate of the 1 -hour, 5 -year storm falling on the undeveloped site for URBANIZING areas.
Detention Pond summarized in a Drainage Report:
The applicant has submitted a preliminary drainage report. A final drainage report and detention pond
design completed by a Colorado Licensed Professional Engineer is required prior to recording the USR
map. The drainage report must include a certification of compliance stamped and signed by the PE. A
Certification of Compliance form can be found on the Public Works Development Review website. General
drainage report checklist is available on the engineering website. More complete checklists are available
upon request.
Historic Flows:
The applicants will be required to maintain the historic drainage flows and run-off amounts that exist from
the property.
MS4
This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized
area with state mandated, higher water quality requirements
GRADING PERMIT
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant, Public Works and Planning Department have reviewed the referral
and surrounding property owner comments. The Early Release Request may or may not be granted
depending on referral comments and surrounding property owner concerns. Contact an Engineering
representative from the Public Works for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, 303-692-3575.
CONDITIONS OF APPROVAL
A. An Improvements and Road Maintenance Agreement is required for off -site improvements at this
location. Road maintenance includes, but is not limited to, dust control and damage repair to specified
haul routes. The Agreement shall include provisions addressing engineering requirements, submission
of collateral, and testing and approval of completed improvements. (Department of Public Works)
B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional
Engineer registered in the State of Colorado is required. (Department of Public Works)
C. The plan shall be amended to delineate the following:
1. County Road 50 is a gravel road and is designated on the Weld County Functional Classification

delineate and label on the site map or plat the future and existing right-of-way (along with the
documents creating the existing right-of-way) and the physical location of the road. All setbacks
shall be measured from the edge of right-of-way. This road is maintained by Weld County.

2. Show and label the approved access locations, approved access width and the appropriate turning
radii (60') on the site plan. The applicant must obtain an access permit in the approved location(s)

3. This portion of County Road 50 will be annexed by the Town of Johnstown. Please contact the
municipality to verify the right-of-way. Show and label the right-of-way. Show the approved
access(es) on the site plan and label with the approved access permit number if applicable.

4. Show and label the entrance gate if applicable. An access approach that is gated shall be designed
so that the longest vehicle (including trailers) using the access can completely clear the traveled
way when the gate is closed. In no event, shall the distance from the gate to the edge of the traveled

5. Show and label the accepted drainage features. Stormwater ponds should be labeled as
"Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume.

DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. The property owner or operator shall be responsible for controlling noxious weeds on the site, pursuant
to Chapter 15, Article I and II, of the Weld County Code. (Department of Public Works)
2. The access to the site shall be maintained to mitigate any impacts to the public road, including damages

3. There shall be no parking or staging of vehicles on public roads. On -site parking shall be utilized.

Environmental Health Services has reviewed this proposal for a Site -Specific
Development Plan and Use by Special Review Permit for a use similar to uses allowed
by special review as long as the use complies with the general intent of the A
(Agricultural) Zone District (Event Center) in the A (Agricultural) Zone District.
The existing house is served by Little Thompson Water District and an on -site waste
water treatment system (OWTS) permitted for 2 bedrooms (SE -0400098).
A permitted OWTS (SP -1800125) is installed for the barn. The OWTS is sized for 20
people and the original use was for family parties. The OWTS was engineer designed
due to the soil type of silty clay loam. The OWTS must be reviewed by an engineer and
may need to be increased in size to accommodate guests and employees. Also, any
OWTS with the capacity to serve 20 or more persons per day must be permitted as an
Underground Injection Control (UIC) Class V Injection Well through the Environmental
Protection Agency (EPA).
Little Thompson Water District will provide water and a letter dated October 10, 2018
indicates "service to this tap will include service to the proposed restrooms in the barn
that are to be used for special events."
Noise will be restricted to the commercial level. The application indicates noise will be
controlled by constructing a berm adjacent to CR 50.
All food facilities must adhere to the Colorado Retail Food Establishment Rules and

Services shall be contacted for plan review and licensing requirements for any proposed
food establishment at the facility.
We recommend that the following requirement be met prior to allowing the plat to be
recorded:
1. As the existing on -site waste water treatment system (OWTS) for the barn (SP -
1800125) will be utilized for business use, the OWTS shall be reviewed by a
Colorado registered professional engineer to determine sizing limitations. The
review shall consist of observation of the system and a technical review
describing the system's ability to handle the proposed use. The review shall be
submitted to the Environmental Health Services Division of the Weld County
Department of Public Health and Environment. In the event the system is found
to be inadequately sized for the proposed use, the system shall be brought into
compliance with current OWTS regulations.
We recommend that the following requirements be incorporated into the permit as
development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S., as amended) shall be stored and removed for
final disposal in a manner that protects against surface and groundwater
contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is not
meant to include those wastes specifically excluded from the definition of a solid
waste in the Solid Wastes Disposal Sites and Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner that controls
fugitive dust, fugitive particulate emissions, blowing debris, and other potential
nuisance conditions. The applicant shall operate in accordance with Chapter 14,
Article 1 of the Weld County Code.
4. Fugitive dust shall attempt to be confined on the property. Uses on the property
should comply with the Colorado Air Quality Commission's air quality regulations.
5. Adequate drinking, hand washing, and toilet facilities shall be provided for
employees and patrons of the facility, at all times. A permanent, adequate water
supply shall be provided for drinking and sanitary purposes.
6. Any septic system located on the property must comply with all provisions of the
Weld County Code, pertaining to On -site Waste Water Treatment Systems.
7. Any large -capacity septic system (a septic system with the capacity to serve 20
or more persons per day) shall comply with the Underground Injection Control
(UIC) Class V Injection Well requirements of the Environmental Protection
Agency (EPA).
8. In the event the septic system requires a design capacity of 2,000 gallons or
more of sewage per day the applicants shall adhere to the requirements of the
Colorado Department of Public Health and Environment, Water Quality Control
Division's (WQCD) Regulations.
9. The facility shall adhere to the maximum permissible noise levels allowed in the
Commercial Zone as delineated in 25-12-103 C.R.S.
10.The applicant shall comply with Colorado Retail Food Establishment Rules and
Regulations governing the regulation of food service establishments.
11.The operation shall comply with all applicable rules and regulations of the State
and Federal agencies and the Weld County Code.

Upon review of my case files and computer, an active Zoning Complaint (COMP19-00041) was noted.
This complaint was initiated due to the construction of the wedding venue without first completing the
necessary Weld County Zoning Permits. This case has not been forwarded to the County Attorney's
Office; therefore, an investigation fee IS NOT required.
Due to records release laws, staff no longer tracks complainant information, but please be aware it is
staff's policy to no longer accept staff -initiated complaints.
Approval of this application by the Board of County Commissioners would correct the outstanding
complaints. If this application is denied, the Department of Planning Services asks that the Board refer
this case to the County Attorney's Office for legal action, but to delay legal action for 30 (thirty) days to
remove all associated commercial storage and operations from the property.

These comments pertain to an application for a recently constructed 3,840 square foot agricultural
building with an 896 square foot mezzanine to be used as an assembly occupancy. Information
provided for review indicates that the facility is intended to host indoor/outdoor events and that
the building will include a small kitchen.
The building is located on the parcel currently addressed at 5194 County Road SO, within the Front
Range Fire Rescue (FRFR] Fire Protection District With regard to fire and life safety issues. Weld
County has adopted the 2018 International Codes. FRFR currently has adopted the 2006
international Fire Code (IFC) within the Johnstown portion of its response area, but is in the
process of adopting the 2018 IFC within its entire response area Given this process and the existing
codes in Weld County, the 2018 IFC has been applied to this project.
THIS PROJECT IS APPROVED BY FRONT RANGE FIRE RESCUE, NO OCCUPANCY OR USE OF THE
BUILDING IS PERMITTED UNTIL FINAL FIRE INSPECTIONS HAVE BEEN COMPLETED.
OCCUPANCY CLASSIFICATION
The primary occupancy classification for this building will be Assembly (A2) - Assembly uses
intended for food and/or drink consumption. (ag., banquet halls). The building includes accessory
use spaces for storage, restrooms, and food preparation. There is no approved commercial kitchen.
BUILDING ADDRESS
Because the building will be used for commercial purposes, it shall be addressed separately from
the single-family residential building on the property, in accordance with Section 505 of the IFC.
Applicant shall ensure that the building address is appropriately displayed on County Road SO. The
address maybe posted on a road sign or other roadside marker that is clearly visible and legible
from both directions of travel on CR 50. Alternatively, the address numerals may be posted on the
building, provided numerals are minimum 6 -inches in height and of contrasting color to their
background and are clearly visible from CR 50.
WATER SUPPLY
There is an existing fire hydrant immediately north of the barn that is proposed for the event venue.
The provided Site Plan indicates an existing access road that appears to be in very close proximity
to this hydrant The Applicant shall install appropriate protective measures to protect the hydrant
from vehicle impact, in accordance with Section 312 of the IFC.

COMMERCIAL KITCHENS
Information provided by the Applicant indicates that the buildings proposed kitchen will only be a
"prep kitchen" and that no cooking will take place inside the building. This activity is approved.
Should the Applicant desire to cook foods inside the building, then additional information shall be
required prior to FRFR approval and a Type 1 commercial hood/duct system maybe required.
MEANS OF EGRESS
Doors serving as the means of egress shall comply with Chapter 10 of the IFC.
• All exit doors shall swing in the direction of exit travel.
• Each exit door shall be appropriately marked by an illuminated exit sign.
• Exit doors shall be provided with approved hardware.
• Thumb -turn deadbolts are prohibited on any exit doors.
The floor plan for the Main Floor indicates a Refreshment Area in close proximity to the north exit
door. This exit door is a required exit based on the size of the building and the occupant load.
• A clear path of travel shall be provided and maintained at all times to this exit door.
The Applicant shall install approved emergency egress lighting within all portions of the building
interior. Emergency egress lighting shall be capable of operating in the event of a loss of power to
the building.
• Approved exterior egress lighting shall be installed and maintained outside each exit door.
FIRE PROTECTION SYSTEMS
Chapter 9 of the IFC indicates that a fire sprinkler system is required for an A-2 assembly if it meets
one of the following:
• Fire area exceeds 5,000 square feet, or
• Fire area has an occupant load of 100 or more, or
• Fire area is located on a floor other than the level of exit discharge.
Chapter 9 of the IFC indicates that a fire alarm system is required for an A-2 occupancy with an
occupant load greater than 300 persons.
Based on information presented in the Occupant Load section of these comments, a fire alarm
and/or fire sprinkler system is not required, as the Applicant has voluntarily elected to limit the
occupant load to 99.
• Should the Applicant elect to increase to o n e of the calculated and listed occupant loads,
then a fire sprinkler system and automatic fire alarm system shall be required. FRFR
requires a separate permit for any fire sprinkler systems and/or fire alarm systems.

OCCUPANT LOAD
Chapter 10 of the lFc provides three means for calculating the occupant load:
• Uneoncentrated (tables and chairs) - factor of 15 net
o 3264 / 15 = 217 persons maximum occupant load
• Concentrated (chairs only) - factor of 7 net
o 3264 / 7 = 466 persons maximum occupant load
• Standing Space - factor of S net
o 3264 / 5 = 652 persons maximum occupant Toad
Information provided by the Applicant during a conversation on 10/29/2018 and reiterated in an
email on 02/27/2019, indicates that the occupant load will be kept below 100 persons for all public
events. Information provided by the Applicant with the USR indicates that events will include a
predicted maximum attendance of 75 persons, and that the building will include an outdoor patio
area.
FRET will provide an approved occupant load sign indicating a Maximum Occupant Load of 99. This
maximum occupant load shall not be exceeded, including guests using the patio Applicant shall
ensure that the calculated occupant of the building is posted in a visible location within the building
at all times.
• If the Owner seeks to exceed the occupant load of 99 persons, then a fire sprinkler system
and an automatic fire alarm system shall be required.
